HomeMy WebLinkAbout02/14/72 Board of Public Works Minutes1206' February 14, 1972 A regular meeting of the Board of Public Works and Safety convened at 9:30 A..M., on February 14, 1972. All members were present. The minutes of the previous meeting were reviewed and approved. FIRE DEPARTMENT Chief Bland appeared before the Board and matters pertaining to his department were discussed. Chief Bland requested that Captain Michael Wegenka and Lieutenant James Cole be permitted to attend the Fire Department Instructors' Conference at Kansas City, Missouri, on March 14 through 17, 1972, at their own expense. Upon motion duly made, seconded and unanimously carried the request was granted for the two officers to attend the conference. Chief Bland recommended that the request for the use of the Fire Stations #3, #4 and #11 by the St. Joseph County Heart Association, for drop off and collection points on Heart Sunday, February 27, 1972 be granted. Upon motion made, seconded and unanimously carried, the Board approved the Chief's recommendation and instructed the Clerk to write to the St. Joseph County Heart Association informing them of the decision. POLICE DEPARTMENT Chief Seals appeared before the Board and matters pertaining to his department were discussed. Chief Seals presented a report that officer Thomas Balogh had been off sick more than thirty days, but that he is now back to work and the Chief suggested that he be used for light duty until such time as he is released for active duty by his Doctor. Upon motion made, seconded and carried the Board approved the recommendation and Officer Balogh will be used for light duty in the Police Department. CHARGES AGAINST PATROLMAN MAURICE VAN WOODS Robert W. Seals,,.. eals,, Chief of the Police Force of the City of South Bend, does hereby prefer charges against Patrolman Maurice Van Woods, said charges being that on the 26th day of January, 1972 at or about 3:00 P.M. at S. S. Kresge's Store, 201 S. Michigan Street, in South_ Bend, Patrolman Maurice Van Woods did violate sections 1.4 and 1.8 of the Code of Ethics and the Cannons of Police Ethics of the Duty Manual and that Patrolman Maurice Van Woods did violate Section 4.2 of the General Rules and Regulations of the Poli-ce-Department of the City of South Bend, as contained in the Duty Manual and that Patrolman Maurice Van Woods did violate Section 4.50 of the Rules and Regulations of the Police Department of the City of South Bend as contained in the Duty Manual of the South Bend Police Department. Wherefore, the under- signed Chief requests that the Board of Public Works and Safety order a hearing had upon the charges, fix a date and time for said -hearing before said Board, and that proper notice of the time and place of said hearing on the charges be served upon Patrolman Maurice Van Woods forthwith. Upon motion duly made, seconded and unanimously carried, the Board directed the Legal Department to prepare a notice of hearing to be served to Patrolman Maurice Van Woods, and set the hearing at 9:30 A.M. on February 17, 1972, in the hearing room of the Board Room 1308, County City Building. The notice is to be servied by an assistant to the City Attorney. 20 7 2/14/72 BUILDING DEPARTMENT - HOUSE MOVING NORTH OLIVE STREET Mr. Forrest West, Building Commissioner, appeared before the Board and presented a letter from Mrs. Eleanor A. Guess, 1857 North Olive Street, who states she is in favor of moving the structure from 709 North Olive Street to 1849 North Olive Street. The Board informed Mr. West that they had not had the opportunity to view the house in question and continued the matter until the next meeting, Mrs. Dovie Bryant, who was also present, was given this information. Demolition Co. $435.00 + Waimco 458.00 e--i Midwest Demolition Co. 431.00 Machinery Supply Co. 325.00 O'Neal Trucking Co. 585.00 Upon motion made, seconded and unanimously carried, contract for the demolition of the structure at 423 Kosciuszko Street was awarded to Machinery Supply Company on its low bid of $325.00. 1125 Bissell Street O'Neal Trucking $488.00 Midwest Demolition 460.00 B & J Demolition 365.00 Waimco 534.00 Machinery Supply Co. 345.00 Upon motion made, seconded and unanimously carried, contract for the demolition of the structure at 1125 East Bissell Street was awarded to Machinery Supply Company on its low bid of $345.00. 1613 Leer Street B & J Demolition $515.00 O'Neal Trucking 735.00 Machinery Supply Co. 560.00 Midwest Demolition Co. 887.00 Waimco 634.00 Upon motion made, seconded and unanimously carried, contract for the demolition of the structure at 1613 S. Leer Street was awarded to B & J Demolition Company on .its low bid of $5I5.00. Mrs. Lot€ie King appeared before the Board to protest the demolition of the structure at 1613 S. Leer Street, but as a letter was received from her attorney stating that the estate was not interested in making any repairs and that it was to the best interest of the estate to have it demolished, the Board suggested she talk to the attorney who is also her guardian. 827 S. Rush Street O'Neal Trucking Company $575.00 Machinery Supply Company 525.00 Midwest Demolition Company 605.00 Waimco 587.00 B & J Demolition Company 485.00 Upon motion made, seconded and carried the contact for the demolition of the structure at 827 S. Rush Street was awarded to B & J Demolition Company on its low bid of $485.00. 2/14t72 1315 South Main Street B & J Demolition Company $385.00 Machinery Supply Company 399.50 O'Neal Trucking 475.00 Midwest Demolition Company 431.00 Waimco 534.00 Upon motion made, seconded and unanimously carried, contract for the demolition of the structure at 1315 South Main Street was awarded to B & J Demolition Company on its low bid of $385.00. 125 E. Dayton Street The Board was informed .that Mrs. Garnet Horner had called and asked for a continuance of two weeks because a settlement had not been made with the insurance company and it would take at least `two `weeks before settle- ment could be made. After discussion, it was decided that Mr. Liszewski could advertise for bids for the demolition of the structure at 125 East Dayton Street, and before bids could be awarded settlement should be made. This was done upon motion made, seconded and carried. 910 West Washington Street Mrs. Ruth Price, representing Southhold Restorations, Inc., appeared before the Board to ask that the structure at 910 West Washington Street not be demolished at this time. She stated this structure is within the Model Cities Neighborhood and there is a way it could be rehabilita- ted under Government Project 235-J. Mrs. Price presented a personal check in the amount of $25.00 to go to the Demolition' Contractor if the house is not demolished, inasmuch as bids have been received and a bid awarded. Mr: Liszewski was instructed by the Board to contact the demolition company ,Who holds the award and instruct him to hold up demolition pending notifi- cation of the Board. During this pendancy, the house must be boarded up. This matter has been continued until the next Board Meeting. DIAGONAL PARKING - MR. & MRS. MOO Mr. William Richardson, City Engineer, presented the following letter: February 10, 1972 Mr. & Mrs. Robert Moo 3101 Lincoln Way West South Bend, Indiana Subject: Your letter February 4, 1972 Dear Mr. & Mrs. Moo: The City of South Bend has programmed the intersections of Bendix Drive and Lincolnway West; Ardmore Trail and Lincolnway West; and Ardmore Trail and Bendix Drive for improvements under the TOPICS program. The preliminary drawings have been completed and the consulting engineer has been instructed to make the final drawings for this improvement. Upon the completion of the final drawings, we will be in contact with yourselves and the other property owners in the general vicinity that are going to be affected by this improvement. Athat time, we will be able to show you exactly the type of construction and the limits of construction that are going to take place. The problem that comes in is that the City will need the parkway area which is now being used for diagonal parking, as additional traffic lanes on Lincolnway. Whether paralle 1 parking will be allowed at this location has not been determined yet, but I am assuming that even the parallel parking will be removed from this area. 2/14/72 209 I will be in touch with you as soon as the final plans are developed so that we can come to some kind of an agreement in the area. I dont think that the project will be constructed in 1972 but most likely will be completed during the summer of 1973. Director Upon motion made, seconded and unanimously carried the Board approved the above letter and instructed the clerk to write to Mr, and Mrs. Moo and tell them diagonal parking will be permitted until such time as they purchase property for parking cars, or until the state starts construction of the property, whichever comes first, but provided no cars are parked on the public sidewalk. 414 AMOUNT OF RETAINAGE - WASTEWATER PLANT CONTRACTORS T--I Mr. William Richardson, City Engineer, presented the following letter: U February 10, 1972 U Board of Public Works and Safety County City Building South Bend, Indiana 1 Gentlemen: In regard to the Contract Documents for the Wastewater Treatmant Plant Addition and specifically, Article 31 of the General Conditions (Page GC-24) we request a change in the amount retained by the City of South Bend from ten (10) to five (5) percent. The request is based on the present money market and interest rates. We further suggest that in the event situations develop which we do not presently anticipate, the City of South Bend as "Owner" reserve the right to unilaterally restore the amount of retainage to the original figure. MARY MON•DOVICS A letter was received from Mrs. Mary Mondovics, 1641 South Magnolia Street, South Bend, Indiana complaining that her street was in bad condition, and the intersection of Magnolia and Dubai] Streets was heavily used and there should be some work done there. Upon motion duly made, seconded and unanimously carried, the above letter was referred to the Street Department for proper action. YORK ROAD DEDICATION A dedication p lat showing a portion of York Road at the intersection of Georgian Drive, was presented to the Board for their approval. Upon motion made, seconded and unanimously carried, the Board approved the said plat and accepted the dedication of a portion of York Road. 210 BIDS 2/14/72 This being the date set, bids were opened for vehicles for the Street Department and for the Traffic Engineering Department as follows: STREET DEPARTMENT VEHICLES GROUP 1 GATES CHEV. LETTER FROM HOUSING AUTHORITY The following letter was presented to :the Board: February 9, 1972 Board of Works City of South Bend County City Building South Bend, Indiana Attention: Attorney Charles A. Sweeney, Jr. President Gentlemen: Harber Homes is a housing development being constructed by the Consolidated Negro Contractors, Inc., for The Housing Authority of the City of South Bend, Indiana. According to the information given to this writer, the streets therein have been dedicated to and accepted by the City of South Bend. However the Street Department is not authorized to maintain the streets because the Developer has not and cannot post the three year bond as is required. The reasons for this situation are: 1) The Company is broke 2) It's Financial status will preclude consideration by any reliable bonding company. 21 2/14/72 This communication is for the purpose of exploring any process or consid- eration that will allow maintenence by this City's Street Department. Can there be a waiver of the requirement, repercussionsinotwithstanding? The location is at the point where Lombardy runs into Linden. There are 1610 feet of improved streets in the development. EXCAVATION BOND - GUY RIZEK PLUMBING HEATING COOLING The bond for Excavation in Streets was presented to the Board, and upon motion made, seconded and carried was approved till February 4, 1973 for Guy Rizek Plumbing Heating Colling. EXCAVATION BOND - JOHN RENSBERGER PLUMBING & HEATING Upon motion made, seconded and carried the bond of John Rensberger Plumbing & Heating was approved to January 1, 1973. CONTINUATION BONDS Upon motion made, seconded and carried, continuation certificates were approved for the following: Rieth-Riley Construction Co. to 2/l/73 Aulm Construction Co.,Inc. to 2/l/73 Sollitt Construction Co. to 3/5/73 TRAFFIC SIGNS AND LIGHTS Upon motion made, seconded and unanimously carried, the Board approved the following signs and lights recommended by the Traffic Engineering Department: 1. STOP Sign on Jackson Street at Indiana Avenue 2. STOP sign on Grant Street at Indiana Avenue 3. STOP sign on Warren Street at Indiana Avenue 4. STOP sign on Calvert Street at Warren:Street 5. YIELD signs replace with STOP signs at Dubail and Warren Streets 9. YIELD signs replaced with STOP signs at Dubail and Jackson 10. STOP signs on Parkovash at Marquette. "NO PARKING COMMERCIAL VEHICLE LOADING ZONE," signs on the West side of the service Court running north from 100 East Jefferson. One 7,000 lumen Street light in the area of North Johnson Street one 7,000 lumen Street light in the area of Almond Court. STREETLIGHT OUTAGE REPORT Street light outages reports were filed for 2/4/72 to 2/11/72.
