February 7, 1972
A regular meeting of the Board of Public Works and Safety convened at
9:30 A.M., on February 7, 1972. All members were present. The minutes
of the previous meeting were reviewed and approved.
FIRE DEPARTMENT
Chief Bland appeared before the Board and matters pertaining to his
department were discussed.
Chief Bland presented the following letter:

Honorable Board Members:
At the present time, the South Bend Fire Department is in the process
of collecting the old Gamewell Fire Alarm Boxes, which number approximately
400. Also being collected is a two hundred sixty-five (265) mile copper
cable. These boxes as well as the copper cable need to be disposed of as
soon as collection is complete. We anticipate completion by the ist of
June, 1972.
The purchase price of each of these boxes was listed at Two Hundred Ten
(210) Dollars, and Three Hundred Fifty Dollars ($350.00) for each
Master box. Some of these boxes have been sold at Eight -five Dollars
($85.00) each by the previous administration. We feel that this is not
adequate compensation for these boxes. The sale price of each of these
boxes, however, will depend on the condition of each individual box.
At your earliest convenience, we would appreciate your investigating
possible procedures for disposition of these boxes and the cable. Your
prompt attention would be greatly appreciated.

Upon motion duly made, seconded and unanimously carried the Board agreed
to meet with the Chief and others for the purposing of appraising the boxes
and determining a fair price.
RETIREMENT OF RUDOLPH PINTER
Chief Bland presented the following letter:

Honorable Board Members:
Please find attached the application and Declaration for Retirement of the above
mentioned individual, who resides at 2029 Franklin Street, South Bend, Indiana.
Firefighter Pinter submitted his application on February 1, 1972 requesting
it be effective on that date.

Firefighter Pinter was appointed to the department on January 29, 1948,
which completes twenty-four years of service on February 1st of this
year. He was born on April 20, 1920.

POLICE DEPARTMENT
The Traffic Accident and Arrest Summary for the month of December, 1971
was filed with the Board. Also a report for the year 1971 of collision
investigations was filed with the Board.

BUILDING DEPARTMENT
Forrest West, Building Commissioner, appeared before the Board and the
following matters were discussed:
Upon motion made, seconded and unanimously carried, the bid for four
Sedans for the Building Department was awarded to Freeman -Spicer Co.,
on their low bid of $7,540.00.

Richard Liszewski, Sub -Standards Director, appeared before the Board and
the following matters were discussed:

Upon motion made, seconded and unanimously carried contract for the
demolition of the structure at 1813 Robinson Street was awarded to
Midwest Demolition Company on its low bid of $297.00
717 South Clinton Street
Mr. Harold Cook, representing the estate if Bert M. Dudley, appeared to
state the structure mentioned above had been damaged by fire and the
Insurance Company has not made a settlement as yet. He asked for a
continuation until he had contacted the Insurance Company. Mr. Lisewzki
requested that he bring the matter up at the next meeting, and the matter
of the sub -standard condition of 717 South Clinton Street was continued
for two weeks.
736 North Frances Street
Mr. Wallace Mitchell having been requested to appear before the Board
on February 7, 1972 to.show progress with reference to therehabilitation
of the structure at 736 North Frances Street, and Mr. Wallace not having
appeared before the Board, he 'is now directed to appear before the Board
on February 22, 1972 with pictures showing the improvements to the
structure and a schedule showing progress of the rehabilitation. Mr.
Liszewski reported that Mr. Mitchell was in the Building Department of the
County City Building on this date, but did not appear at the meeting.

PETITOON TO VACATE THE FIRST NORTH -SOUTH ALLEY WEST OF IRONWOOD - INDIANA &
MICHIGAN ELECTRIC COMPANY
Indiana & Michigan Electric Company, by Jack C. Dunfee, Jr., Attorney, files
its petition to vacate the first North -South alley West of Ironwood Drive,
South of the Grand Trunk Western Railroad line South'a distance of One Hundred
Thirty -Three and Forty -Five Hundredths (133.45) feet, and deposits $75.00 to
pay for costs. Upon motion made, seconded and unanimously carried, the petition
was referred, simultaneously, to the Engineering Department and the Area Plan
Commission for study and recommendation to the Board.
AREA PLAN COMMISSION RECOMMENDATION
ADOPTION OF VACATION RESOLUTION NO. 3355,1972
Area Plan Commission files with the Board its recommendation for the vacation
of the east -west alley between Colfax and Washington Avenue running West from
the West line'of Niles Avenue 150' +- to the East line of the East Race, said
alley running between Lots #45 and 46 in a part of the Original Plat of the
Town of Lowell, now a part of the City of South Bend.
Thereupon the following resolution was adopted:
VACATION RESOLUTION NO. 3355, 1972
"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH
BEND, INDIANA, That it is desirable to ;vacate the following:
The east -west alley between Colfax and Washington Avenue
running West from the West line of Niles Avenue 150' +-
to the East line of the East Race, said alley running
between Lots #45 and 46 in the part of the Origi.nal
Plat of the town of Lowell, now a part of the City of
South Bend.
"Reserving the rights and easements of all futilities and the Municipal
City of South Bend, Indiana, to construct and maintain any facilities, in-
cluding, but not limited to, the following: electric, telephone, gas, water,
sewer, surface water control structures and ditches, within the vacated
right of way, unless such rights are released by the individual Utilities.
"The following property may be injuriously or beneficially affected
by such vacation:
Lots 1 to 11 both included in Miller Green's 1st Addition
to Lowell.
Lots 25 and lots 43 to 48 both included and lots 91 to

LETTER FROM MARION HAMILTON & SON, INC. - USE OF STREET WASTEWATER EQUIPMENT
The following letter was received:

Attentiop: Mr. Dave Wells and the Board of Public Works and Safety
Gentlemen:
In regards to 'the City of South Bend's Wastewarer Treatment Plan, I would
like to request the permission to use the east side of the north bound land
of Bendix Drive between the hours of 9:00 AM to 3:00 PM for the express
purpose of unloading extremely large pieces of equipment and materials for.
the construction of the Treatment Plant.
This material will be arriving on the Chicago, South Shore track running
parallel to Bendix Drive. With your permission to 'use this site, I will
assume all responsibilities of damages which may occure in the process of
unloading.
1 will Very much -appreciate your cooperation in this matter. If this is
acceptable to you, may I please receive your permission i.n a letter form at
your earliest possible convenience. I must provide this letter to the
Railroad before this action can begin. Thank you.

1. The Traffic -Engineering Division shall be notified 24 hours
in advance of the time of occupancy for the purpose of
providing the proper warning signs.
2. The use of the roadway is to be the curb lane only and
other equipment used to transfer the pipe, etc., is not
to interfere with the remaining lanes of traffic.
3. The use of the roadway will be allowed between the hours of
9:00 A.M. and 2:30 P.M. The roadway must be clear of all
equipment by -3:00 P.M.
4. In addition to the signage erected by this Division, the
Contractor must protect and mark his vehicles as,required
by law, (i.e.) flashers, flags.

LETTER FROM ROBERT MOO - DIAGONAL PARKING
The following letter was presented to the Board:
February 4, 1972

Municipal City of South Bemd
South Bend, Indiana
Gentlemen:
Mrs. Moo and myself are the owners of the real estate at the commonly
known address of 3101 Lincoln Way West, in the City of South Bend,
Indiana, wherein we have operated a restaurant for many years last
past. We have been permitted diagonal parking which served our patrons,
as well as other individuals using the area for parking, and have
not disturbed the progress of traffic on Lincoln Way West.
It has come to our attention that there is an intent to do away
with diagonal parking and not -permit us to have the use of this
facility, which is most important.
We therefore respectfully request your Board to assist us in making
an order permitting the continuance of diagonal parking, or rezoning,
or whatever legal requirement is necessary.
Thanking you for the courtesy of permitting us to submit this letter,
and we will be available for further clarification at your request.

Upon motion made, seconded and unanimously carried, the Board referred the
letter to the Engineering Department to contact Mr. Moo and make a further
investigation and recommendation.
WEIGHTS AND -MEASURES REPORT
Mr. Bert Cichowicz, City Sealer, presented his report for the month of
January to the Board. Upon motion made, seconded and carried the Board
approved the report and ordered it filed.
CITY CONTROLLER TO ATTEND IBM SCHOOL IN SAN JOSE CALIFORNIA
Upon motion made, seconded, and unanimously carried the Board approved the
request of James Barcome, City Controller, to attend the IBM School in San
Jose, California, February 21 through 25, 1972.
AWARD OF BIDS FOR CARS FOR BUILDING DEPARTMENT
Upon motion made, seconded and carried, the Board awarded the bid for
cars for the Building Department to Freeman -Spicer Company, Inc., on their
low bid of $7,540.00 for four (4) 1972 Plymouth Valiant Duster 2 Door Sedans.
EXCAVATION BOND - HERMAN F. GLASER CONSTRUCTION COMPANY
Upon motion made, seconded and carried the Board approved the Exvacatti:on
bond of Herman F. Glaser to February 16, 1972
CONTINUATION CERTIFICATE
Upon motion, made, seconded and carried the Board approved the continuation
of an Excavation Bond for Earl Handley d/b/a Handley Plumbing Service to lIZ 8/72.

STREET LIGHT OUTAGE REPORTS
Street light outage reports were ordered filed for the period of 1/28/72
to 2/3/72.
STATEMENT ON JANITORIAL SERVICES
Mr. William Richardson, City Engineer, made the statement that the bid
for Janitorial Services for the Municipal Services Facility was awarded
to the Eder -Bailie Company because they are a National Service and have
much experience in this sort of work, and the Board, consequently, felt
they were better equipped to do the work than the other companies bidding,
and not because there was any dissatisfaction with any company.

Special Meeting February 9, 1972
A Special Meeting of the Board of Public Works and Safety convened at
10:05 A.M. on Wednesday, February 9, 1972. Present were William J.
Richardson, City Engineer and James V. Barcome, City Controller.
POLICE DEPARTMENT:
The following letter was presented to 'the Board:

Attention: William Richardson, City Engineer:

South Bend, Indiana
Sir:
Division Ch.ief Frank Arsenault will appear in my behalf requesting the
use of condemned houses loeated at 1809, 1813 and 1821 Randolph Street,
this City, by the Police Department for training purposes.
The subject locations will be used to mount crime -scene problems
involved in the training of the Felony Squad personnel and the inser-
tion of projectiles into wall areas, wood trim, etc., as evidence
involved in such training problems will undoubtedly be used.
Police Department personnel will contact neighboring residents for the
purpose of advising them of the activities, to prevent any unseemly re-
action to the appearances of police personnel.
The consideration of the Board of Public Works and Safety in this matter
will be sincerely appreciated.
