Barcome, City Controller, Charles A. Sweeney, Jr., City Attorney and William J. Richardson, City Engineer. Upon motion duly made, seconded and unanimously carried Charles A. Sweeney, Jr. was elected President of the Board of Public Works and Safety. FIRE DEPARTMENT - JACK R. BLAND appointed Chief At this time, upon motion made, seconded and carried, the Board confirmed the appointment of Jack R.Bland as Chief of the South Bend Fire Department. Seals Chief of Police RWS/mm Upon motion duly made, seconded and carried the Board approved the above promotions and demotions in the South Bend Police Department Chief Seals requested that Divisional Chief Loren M. Bussert be granted permission to attend the first National Symposium on Police Ethical Practice to be held in St. Louis, Mo., on January 7 and 8, 1972. This symposium is being sponsored by Law Enforcement Association on Professional Standards Education and Ethical Practice. It was requested that the expenses be born by the city for his attendance. Upon motion made, seconded and carried the above request was granted. SPECIAL POLICE COMMISSION - CECIL MCHENRY Cecil McHenry having turned in his special Police Badge #622 his commission is terminated as of December 30, 1971. BUILDING DEPARTMENT - SUB -STANDARD DIVISION Richard Liszewski, Sub -Standards Director, appeard before the Board and the following matters were taken up: 1/3/72 1_ 6 7 813 South Bendix Drive Mr. Liszewski asked permission to advertise for bids for the demolition of this property as Clemens and Lottie Wrzesien did not appear as requested. Upon motion made, seconded and unanimously carried, the Sub -Standards Director was authorized to seek bids for demolition of the structure at 813 South Bendix Drive. 1934 North Meade Street Vernon C. and Marion H. Hastings not having appeared as requested, Upon motion made, seconded and unanimously carried, the Sub -Stand- ards Director was authorized to seek bids for the demolition of the structure;at 1934 North Meade Street. 910 West Washington Street John Brand et al, not having appeared as requested, upon motion made, seconded and unanimously carried the Sub -Standards Director was authorized to seek bids for the structure at 910 West Washington Street. DEMOLITION BIDS OPENED This being the date set, bids for demolition of the following properties were opened. Non -collusion affidavits were found to be in proper order. Hahn as Trustee for Emil William Weber' was filed with the Board. O'Neal Trucking Company $535.00 Waimco 320.00 Vanek Excavating Co. 375.00 Machinery Supply Company 575.00 Upon motion made, seconded and carried, contract for demolition of the structure at 1611 South William Street was awarded to Waimco on its low bid of $320.00. 729 SSouth Rush Street: Machinery Supply Co. $675.00 Vanek Excavating Company 425.00 Waimco 320.00 O'Neal Trucking Company 535.00 Upon motion made, seconded and carried, contract for demolition of the structure at 7292 South Rush Street was awarded to Waimco on its low bid of $320.00 1215 Whitman Court: O'Neal Trucking Company $535.00 Machinery Supply Company 695,00 Waimco 668.00 Vanek Excavating Company 425.00 Upon motion made, seconded and carried, contract for demolition of the structure at 1215 Whitman Court was awarded to Vanek Excavating Company on its low bid of $425.00 COMPLAINT - MRS. HERMAN LIGHTHALL Mrs. Herman Lighthall, 1428 East Howard Street, South Bend, Indiana appeared before the Board and complained of sewage back-up in her basement, as well as the poor condition of the street in front of her home. She was referred to the Engineering Department, 1/3/72 COMPLAINT - AMY KEKKO - Damaged curb The following report was filed with the Board: In the opinion of the undersigned, it would not be proper for the City to make a payment to a private property owner for damage to a curb.. The curb is public property. The City does have the same obligation to keep the curb in repair as ;it does the street, however. (s) S. J. Crumpacker Upon motion made, seconded and carried the Legal Department is instructed to write to Mrs. Kekko informing herof the opinion given by Mr. Crumpacker, in which Mr. Sweeney concurred, and denying her request. REQUEST - GEORGE RANKEL The following report was filed with the Board: In the opinion of the undersigned, the Board of Public Works and Safety does not have the authority to grant any exceptions to zoning laws, rules and reg- ulations. (s) S. J. Crumpacker Upon motion made, seconded and carried, the Legal Department is instructed to write to Mr. Rankel that his request is denied. BUILDING DEPARTMENT - REQUEST TO ATTEND MEETING, PROVIDENCE, R.I. A request from Forrest West, Building Commissioner, for permission to attend the Building Officials and Code Administrations International meeting in Prov- idence, R.I., having been deferred to this date, upon motion made, seconded and carried, permission was granted. Area Plan Recommendation - Department,of Redevelopment Area Plan Commission files with the Board its favarable recommendation for the vacation of Lincolnway East from 55 feet south of Jefferson to St. Joseph Street; East Jefferson Street from St. Joseph to the curve on Jefferson -Wayne connector; East Washington Street from St. Joseph to Artesian Avenue; Artesian Avenue from East Washington to the southerly end of Artesian Avenue as petitioned for by the Redevelopment Department. The City Engineer is directed to prepare a vacation resolution. AREA PLAN RECOMMENDATION - MASTIC CORPORATION Area Plan Commission files with the Board its favorable recommendation for the vacation of a portion of Kaley Street for Mastic Corporation. The City Engineer is directed to prepare a vacation resolution. AREA PLAN RECOMMENDATION - HANSEL NEIGHBORHOOD SERVICE CENTER Area Plan Commission files with the Board its favorable recommendation;for the vacation of an alley between Linden and Orange Streets. The City Engineer is directed to prepare a vacation resolution. AREA PLAN RECOMMENDATION - DEPARTMENT OF REDEVELOPMENT Area Plan Commission files with the Board its favarable recommendation for the vacation of Monroe Street from the East Line of Rush Street extended to the North Line of Monroe Street, east to the west Line of Lincoln Way East for the Department of Redevelopment. The City Engineer is directed to prepare a vacation resolution. 1/3/72 16 LETTER -CATHOLIC CHARITIES DAY CARE CENTER The following letter was filed with the Board of Works: State of Indiana State Board of Health Catholic Charities c/o Crumlish-Sporieder & Associates 100 Center Street Mishawaka, Indiana 46544 Gentlemen: Indianapolis Indiana State Board of Health 1330 West Michigan Street Indianapolis, Indiana 46206 December 28, 1971 Re: Approval of Plans and Specifications for Day Care Center for Catholic Charities 2208 Linden, South Bend, St. Joseph County The plans and specifications for the proposed day care center for 914 Catholic Charities, to accommodate 40 children, have been reviewed and are hereby approved this 28th day of December, 1971. Lf� (.� This project includes the construction of a 2-inch water supply connection U and a 6-inch sanitary sewer connection to local facilities. U This approval is given with the following conditions: 1. That all required local permits be obtained before construction is begun on this project. 2. That plans and specifications for any changes, alterations additions to this child care facility as herewith approved be submitted to and approved by the State Board of Health prior to such construction. 3. That the Children's Division, Department of Public Welfare be notified in time to schedule final inspections before any children are admitted to the facility. These plans and specifications were prepared and certified by Brian Crumlish, A.I.A.,'and Donald E. Sporleder, A.I.A., Mishawaka and submitted on November 17 and December 14, 1971. EXCAVATION BONDS Upon motion made, seconded and unanimously carried, the Board approved the following: Excavation bond for Indiana and Michigan Electric Co. to 1/1/73 Continuation certificates for: Delbert M. Hull to 1/1/73 Midland Engineering Co. to 1/1/73 0. J. Shoemaker to l/l/73 1/3/72 CONTRACTOR'S BOND Upon motion made, seconded and unanimously carried the Board approved a Contractor's bond for Midland Engineering Company, Inc. EXCAVATION BOND CANCELLED - BUILDERS UNITED INC. A letter was received from the Hartford Insurance Group, Indianapolis, Indiana asking to be relieved from further liability under bond No. N4063108 Builders United Inc. Upon motion made, seconded and unanimously carried, the bond was cancelled for all work done from and after January 3, 1972 and the Clerk was instructed to notify the Hartford Insurance Group and send a carbon copy of the letter to Builders United Inc. STREET LIGHT OUTAGE REPORTS Street light outage reports for the period 12/24/71 to 12/28/71 were ordered filed.„ At this time Mr. James Barcome, City Controller, on behalf of the Board of Public Works and Safety, thanked Mr. Jim Bickel for his co-operation and help, and for being present at the Board meeting.
