HomeMy WebLinkAbout07/26/71 Board of Public Works Minutes40 July 26, 1971. A regular meeting of the Board of Public Works and Safety convened at 9:30 A.M. on July 26, 1971, with all members present. The minutes of the previous meeting were reviewed and approved. REMONSTRANCES - MUNICIPAL TRASH AND GARBAGE COLLECTION Mrs. Conchita Washington, President of the local branch of the National Association for the Advancement of Colored People (NAACP) appeared before the Board and presented a petition,.signed by herself and 12 others, to ex- tend the time beyond July 26, 1971, for submitting bids for hauling trash and garbage, stating that enough time was not allowed for preparing the bid and obtaining a bond. Mrs. Washington also presented a petition on behalf of Consolidated Rubbish Company, 749 S. Sheridan Street, South Bend, Indiana, signed by Horace Woods and seven others, to extend the time beyond July 26, 1971, for submitting bids for hauling trash and garbage or, in the alternative, to accept a bid without bond until such bond can be obtained. Also submitted by Mrs. Washington was a letter signed by Mary F. Reid and Jean Glass, as co-chairman for the Fighters for Welfare Rights Organization, P. 0. Box 1183, South Bend, Indiana, requesting that the time be extended beyond July 26, 1971 for submitting bids for the hauling of trash and garbage. Also submitted by Mrs. Washington were letters from Joseph A. Sanders, Director of the National Alliance of Businessmen, 320 W. Jefferson Boulevard, South Bend, Indiana, requesting that the time for receiving bids be extended 10 days beyond July 26, 1971, and a letter from Robert Derrickson, Sr., President of Consolidated Negro Contractors, Inc., III N. Olive Street, South Bend, Indiana, 46628, requesting an extension of time beyond July 26, 1971, for sub- mitting bids. The petitions and letters were read aloud by the President and ordered filed. Attorney Peter J. Nemeth, Tower Building, South Bend, Indiana, appeared be- fore the Board and filed a written protest on behalf of independent trash haulers against municipal trash pick-up in the city of South Bend and re- questing the Board to reject all bids received. The letter was ordered placed on file. The President of the Board stated the date of July 26, 1971, was set as the time for receiving bids since figures must be available to the Common Council at its meeting this evening in order to be considered for the 1972 budget. It was moved, seconded and carried that the bids be opened but that time be extended for the receiving of bid bonds. BIDS OPENED - MUNICIPAL COLLECTION OF TRASH AND GARBAGE This being the date set for receiving bids for the collection of trash and garbage by the City of South Bend from approximately 20,000 residences, the Clerk tendered proofs.of publication of notice in the South Bend Tribune and the Tri County News on July 16 and July 23, 1971,.which were read and found to be sufficient. The following bids were received: B & M Trash Removal, by Peter F. Rogers, Owner, 3821 Riverside Drive, South Bend, Indiana. Non collusion affidavit was found to be proper. The bid was accompanied by a bank money order No. 607945 on the St. Joseph Bank and Trust Company in the amount of $2,200.00. Financial statement of bidder (Indiana State Board of Accounts Form 96-a was not provided. The bid was as follows: Item #1 20,000 residences @ $1.85 per mo. per unit or $444,000.00 per yr. Item #2 no bid. Consolidated Rubbish Co., 749 S. Sheridan Avenue, South Bend, Indiana, 46619. Non collusion affidavit was found to be proper. The bid was accompanied by a financial statement of bidder (Indiana State Board of Accounts Form 96-a). Bid bond is in the process of being obtained and will be provided as soon as possible. The bid was as follows: 7/26/71 41 Item #1 20,000 residences - No bid. Item #2 6,000 residences - C $1.65 per month per unit if contractor does not provide for dump. Or $112,800.00 per yr. $1.95 per month per unit if contractor must provide for dump. Or $140,400.00 per yr. Sanitas Waste Dis osal of South Bend, Inc., 17903 State Road 23, South Bend, Indiana, 466,35. Non collusion affidavit was fouhd to be proper. The bid was accompanied by a financial statement of bidder (Indiana State Board of Accounts Form 96-a) and bid bond in the amount of 5% of the bid. The bid was as follows: Item #1 20,000 residences - @ $1.65 per unit per month. Or $396,000.00. per yr. Item #2 6,000 residences - @ $1.78 per unit per month. Or $128,160.00 per yr. 1114 e-4 Mr. Sanitation, (no address given). Bid labeled "on behalf of the independent in trash haulers of St. Joseph County." Bid was signed "Mr. Sanitation" by ;-+ "Max S. Bray and William C. Brown." Non collision affidavit not provided. No bid bond, certified check nor bidder's financial statement (Indiana State Board of Accounts Form 96-a) accompanied the bid. The bid was as follows: Item #1 20,000 residences - @ $31.84 per unit per year. Or $636,829.12 per yr. Item #2 6,000 residences - @ $18.84 per unit per year. Or $113,040.00 per yr. Upon motion made, seconded and unanimously carried, the bids were referred to the Engineering Department for study and recommendation. BIDS OPENED - UNIFORMS FOR POLICE DEPARTMENT This being the date set for receiving bids for uniforms for the South Bend Police Department for the period from July 1, 1971 to July 1, 1972, the Clerk tendered proofs of publication in the South Bend Tribune and the Tri County News on July 16 and July 23, 1971, which were read and found to be sufficient. The only/ bid received was from Gerber Manufacturing Company, 1655 E. 12th Street, Mishawaka, Indiana, which was received upon delivery of the mail at 10:15 A.M., July 26, 1971. The bid being postmarked July 23, 1971, was acceptable and was opened. Non collusion affidavit accompanied the bid, together with bid bond in the amount of 10% of the bid. The President of the Board stated that since the bid was by items and there were approximately 60 items the bid would not be read in detail unless requested but that the bid was open for inspection. No request was made that the bid be read in detail. FIRE DEPARTMENT - REQUEST TO TRANSFER FUNDS Upon motion made, seconded and unanimously carried, the request of Fire Chief Joseph L. Zurat for a transfer of funds as follows: From Acct. Q-11 (services personal) to Acct. Q-262 (medical, surgical & dental), $2,000.00. From Acct. Q-11 (services personal) to Acct. Q-43 (repair parts) $4,000.00. was referred to theCity Controller for review and recommendation. CONTRACT AWARDED - FIRE DEPARTMENT UNIFORMS Upon motion made, seconded and unanimously carried, contract for Fire Depart- 7/26/71 ment uniforms for the period 8/1/71 to 8/1/72 was awarded to Gerber Manufactur- ing Company on their bid of July 19, 1971. POLICE DEPARTMENT - REQUEST TO ATTEND FBI SESSION, WASHINGTON, D.C. Upon motion made, seconded and unanimously carried, the Board approved the request of Chief of Police Loren M. Bussert for Assistant Chief of Police Kenneth E. McDonald to attend the 88th session of the FBI National Academy commencing August 16-, 1971, for a period of 12 weeks. in Washington, D. C. POLICE DEPARTMENT - SPECIAL POLICE COMMISSION - ALBERT W. WRIGHT Albert W. Wright appeared before the Board for clarification of requirements for appointment as a special police officer, stating he is required to carry a gun in his employment at Robert Hall Clothes and it was his understanding that in such case he must be a special police officer. It was explained to Mr. Wright that a special police commission is not necessarily warranted because an employee is required to carry a gun, and that due to recent change In the law affecting special police officers special police commissions are being issued only where necessary. POLICE DEPARTMENT - APPLICATIONS FOR SPECIAL POLICE COMMISSION Upon motion made, seconded and carried, the applications of Stanley Lee Plump, as an employee of the South Bend Housing Authority, and Magdalene Scott, as an employee of Robertson's Store, were referred to the City Attorney for review and recommendation; also the application of William 1. Dreibelbis, as an employee of the South Bend Tribune, BUILDING DEPARTMENT - SUB -STANDARDS DIVISION Richard Liszewski, Sub -Standards Director, appeared before the Board and the following matters were taken up. 125 E. Keasey Street. Roscoe Claxton, owner, and William Leggett, 827 Rush Street, South Bend, Indiana, land contract buyer, appeared before the Board. Mr. Leggett stated he is in the process of cleaning up the premises. Upon motion made, seconded and carried, the matter of 125 E. Keasey Street was continued one week to permit the land contract buyer to clean up the premises. Lot 24, Elder Street. Neither Grant Lewis nor J. W. and Georgia Howard appeared as requested. Mail addressed to J. W. and Georgia Howard at 2716 N. 17th Street, Milwaukee, Wisconsin, their last known address, was returned with the notation "moved, left no address." Upon motion made, seconded and carried, the Sub -Standards Director was authorized to seek bids for the cleaning up of Lot 24 on Elder Street and the partially demolished accessory building. 1528-1530 S. Magnolia Street. Mr. Liszewski reported this property has been taken down by the owner. 724 Victoria Street. Mr. Liszewski reported this accessory building has been torn down by the owners. 325 S. Taylor Street. Mrs. Frank DeFreese, 315 S. Taylor Street and Mrs. Marie Wyatt, 205 S. Taylor Street, South Bend, Indiana, appeared before the Board and complained of the condition of the property at 325 S. Taylor Street. Mrs. David Whitman, 1905 S. Chapin Street, South Bend, Indiana, also complained of several dogs on the premises. Mr. Liszewski reported the occupant has moved and the property is to be demolished. PURCHASING DEPARTMENT - REQUEST TO ADVERTISE FOR SALT BIDS Upon motion made, seconded and carried, the Board approved the request of the Purchasing Department to advertise for salt bids for the 1971-1972 winter season. August 91971, was set as the time for receiving bids and the Clerk was directed to give notice by publication in the South Bend Tribune and the Tri County News on July 30 and'August 6, 1971. LAGOON A, PONSHA AND 33RD STREETS - AREA PLAN COMMISSION RECOMMENDATION Area Plan Commission files with the Board its recommendation for the vacation of portions of Ponsha and 33rd Streets. 1 IR 7/26/71 ASSESSMENT ROLL FILED - IMPROVEMENT RESOLUTION NO. 3324 - OLIVE STREET SIDEWALK For the improvement of S. Olive Street, from Ford Street to Western Avenue, by constructlfng sidewalk and curb repairs. Clyde E. Williams and Associates, Inc., consulting engineers, file with the Board its certificate of completion of said improvement by Rieth Riley Construction Company under Improvement Resolution No. 3324 in accordance with the plans and specifications for said project. And the City Engineer files assessment roll, with the,names of the owners and description of properties subject to be assessed, with the amount of the prima facie assessment. August 16, 1971, at 9:30 A.M., in Room 1308 County City Building, was set as the time and place for receivingr remonstrances against the amounts assessed on said roll, and at which time the Board will determine whether such Pots or tracts of land have been or will be benefited by said improve- ment to the amounts named. And the Clerk is directed to give notice of such hearing by publication in the South Bend Tribune on July 30 and August 6, 1971. DEDICATION - VACATION RESOLUTION NO. 3322 - UNIVERSITY OF NOTRE DAME AND STANLEY PIETZAK It was moved, seconded and carried that acceptance of the dedication of a strip of land,by the University of Notre Dame for the extension of Twycken- ham Drive iDes postponed until August 2, 1971. FARNEMAN STREET SEWER Elmer P. Schulz, 604 E. Farneman Street, South Bend, Indiana, appeared before the Board and requested that the proper steps be taken to initiate proceedings for a sewer on E. Farneman Street. The City attorney advised a resolution will be filed at the next meeting of the Board. TOPICS PROGRAM - UTILITIES AGREEMENTS WITH INDIANA BELL TELEPHONE COMPANY The motion was made that the Board of Public Works and Safety enter into agreements with the Indiana Bell Telephone Company for telephone lines at the following intersections being constructed under the TOPICS (Traffic Operations Program for Increasing Capacity and Safety) program: Corby-Ironwood-Rockne Lincolnway West -Williams Portage -Elwood Twyckenham-Ewing The motion was seconded and unanimously carried, and the agreements were signed by the Board. TOPICS PROGRAM - UTILITIES AGREEMENTS WITH SOUTH BEND WATER WORKS The motion was made that the Board of Public Works and Safety enter into agreements with the South Bend Water Works for water lines at the following intersections being constructed under the TOPICS (Traffic Operations Program for Increasing Capacity and Safety) program: Corby-Ironwood-Rockne Lincolnway West -Williams Portage -Elwood Twyckenham-Ewing The motion was seconded and carried, and the agreements were signed by:. the Board. 7/26/71 COMPLAINT(HOUSE INSPECTIONS) - MRS. JAMES CLARK Mrs. James Clark, 1322 King Street, South Bend, Indiana, appeared before the Board in reference to the inspection of residences by the Sub -Standards Department. It was explained to Mrs. Clark that these inspections are made at the request of the Federal Government in order for the City to be eligible for aid from the Federal Government.. ON AMENDED ASSESSMENT ROLL - AMENDED VACATION RESOLUTION NO. 3337 - This being the date set for hearing on the amended assessment roll in Vacation Resolution No. 3337, 1971, adopted February 22, 1971, and amended June 7, 1971, to include the following language: "all portions of streets and alleys located within the real estate described as follow! . %, A �� the Clerk tendered proofs of publication in the South Bend Tribune and the Tri County News on July 2, July 9 and July 16, 1971, which were found to be sufficient. No remonstrators having appeared and no written remonstrances having been received, upon motion made, seconded and unaimously carried, the assessment roll was approved as presented and the Resolution= -as :amended June.7, 19717, in all things ratified and confirmed. REQUEST TO RESERVE PARKING METERS - J. C. PENNEY COMPANY - APPROVED Upon motion made, seconded and unanimously carried, the Board approved the recommendation of the Traffic Engineering Department for the J. C. Penney Company to use three parking meters in front of their store on September 16, 1971, upon the payment of $2.00 per meter per day. TRAFFIC REGULATION - 200 BLOCK W. WASHINGTON AVENUE Upon motion made, seconded and unanimously carried, the Board approved the recommendation of the Traffic Engineering Department to change parking meters numbered 10, 12 and 14 in the 200 block of West Washington Avenue from 12 minute meters to 60 minute meters. And the Legal Department was directed to prepare an ordinance for the consideration of the Common Council. TRAFFIC REGULATION - 200 BLOCK WEST COLFAX AVENUE Upon motion made, seconded and unanimously carried, the Board approved the recommendation of the Traffic Engineering Department to change parking meters numbered 1 and 3 on the north side of the 200 block of West Colfax Avenue from one hour parking to 12 minute parking. And the Legal Department was directed to prepare an ordinance for the consideration of the Common Council. CONTRACTORS` BONDS APPROVED Contractor's bond for Daniel Skwarcan commencing July 21, 1971 was approved and ordered filed. Certificate continuing contractor's bond of Carl J. Reinke & Sons to 8/4/72 was approved and ordered filed. Certificate continuing contractor's bond of Emmett K. Troyer to 8/29/72 was approved and ordered filed. STREET LIGHT OUTAGE REPORTS Street light outage reports for the period 7/15/71 to 7/21/71 were ordered filed.
