HomeMy WebLinkAbout11/26/73 Board of Public Works Minutesd_ 1 7 REGULAR MEETING NOVEMBER 26, 1973 A regular meeting of the Board of Public Works was convened at 9:30 a.m, on Monday,.November 26, 1973 with all members present. City Attorney James A. Roemer was also present. Minutes of the previous meeting were reviewed and approved. HEARING ON VACATION RESOLUTION NO. 3387, 1973 This being the date set_,,'hearing was held on Vacation Resolution No. 3387, 1973 for the vacation of the east -west alley between Hill Street and St. Louis Avenue from the east right-of-way line of Hill Street to the west right-of-way line of the north -south alley between Colfax and Washington Streets, situated between Lots 147 and 148 as shown on the recorded plat of the Town of Lowell, not part of the City of South Bend. The Clerk tendered proofs of publication of notice in the South Bend Tribune and in the Tri-County News on November 2 and November 9, 1973. Mr. F. Gerard Feeney, Attorney for the petitioner Northern Electric Company, and Joseph Dosmann were present. Mr. Feeney explained to the Board that all the property owners affected have joined Northern Electric in this petition to vacate the alley. He then presented to the Board a statement, signed by these property owners, supporting the request to vacate. Mr. Feeney said the residents are hoping to eliminate through Q traffic and speeding in the alley. Q No remonstrators appeared and no written remonstrances having been filed, upon motion made, seconded and carried, the Board ratified and confirmed Vacation Resolution No. 3387, 1973 and said alley is vacated. The City Engineer is directed to prepare an assessment roll showing the award of damages and the assessment of benefits to the surrounding properties. HEARING ON VACATION RESOLUTION NO. 3388P 1973 This being the date set, hearing was held on Vacation Resolution No. 3388, 1973 for the vacation of the northwest -southeast alley between George Avenue and Marietta Street north of the Cooper Bridge right-of-way from the bridge northwest to the south right-of-way line of the first southwest -northeast alley between Lots 14 and 14 of Frantz 2nd Addition and Lot 13 of Frantz 3rd Addition, City of South Bend. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri-County News on the 2nd and 9th day of November, 1973. Mr. William E. Voor, Sr., Attorney for the petitioner Roland Goheen, was present and explained to the Board that this alley is on the right-of-way of the new Cooper Bridge and is not used. The petitioner is going to request a zoning change for the property and plans to erect a billboard. Mr. Isaiah Steed, owner of Lot 12, was present and told the Board that his lot is adjacent to the alley. He said he does use the alley in question and would like it to remain open. He said there are accessory structures on Lots 13 and 14 and the alley should remain open for emergency vehicles. Mr. Voor displayed a map to the Board indicating that the alley can only be used by crossing the State Highway right-of-way. It was the feeling of the Board that a visual inspection of the area should be made before any decision is made. Upon motion made, seconded and carried, the matter was tabled until December 3, 1973. Mrs. Glenda Rae Hernandez, 706 E. South Street, presented a petition to the Board opposing the vacation. Mrs. Hernandez said the petitioners were concerned about further deterioration of the neighborhood. Mr. Voor said the idea behind the vacation of the alley was to clean up the area. REPORT ON VERNON STREET CROSSING The Board received a report from Clem Hazinski, Manager of the Bureau of Traffic and Lighting, regarding a complaint about the condition of the Penn Central Railroad crossing at Vernon Street. Mr. Hazinski attached a copy of a letter written to the Track Superintendent in Elkhart advising him of this problem and requesting that repairs be made. Mr. Farrand said that the Division of Engineering will follow up on this matter to see that the repairs are completed. Upon motion made, seconded and carried,the report was ordered filed. REGULAR MEETING NO VEMBER 26, 1973 APPROVAL OF EXCAVATION BOND FOR FRED SPROMBERG & SON The Board received a recommendation from Ray S. Andrysiak, Division of -Engineer- ing, recommending approval of the Excavation Bond for Fred'Spromberg &`Son to 11/30/74. Upon motion made, seconded and carried, the bond was approved to that date. APPROVAL OF PANEL AD ADVERTISING Mrs. Mardella Hensler, Panel -Ads, Inc., requested approval for advertising material from the I & M Electric Company, Terry Horein Builders and Weaver Electric and Heating Services for use on Panel -Ad trash containers. Upon motion made, seconded and carried, the Board approved the advertising. APPROVAL OF TRAFFIC CONTROL DEVICES The Board received the following recommendations from Clem Hazinski, Manager of the Bureau of Traffic and Lighting, for traffic control devices: A. No Parking Signs on the West side of Main Street from Bronson to 300' south of Chippewa and on the East side of Main Street from Sherwood to 3001, south of Chippewa. B. No Parking Signs on the West Side of North Main, north 1/2 block and No Parking, Except Sunday 6-6, West Side of 400 North Main, south 1/2 block. C. 30 Minute Parking Limit, 6 to 6, both sides of the east 1/2 block of 200 W. Marion Street, D. No Parking Signs on the East side of 500-N. Michigan, south 1/2 block. Upon motion made, seconded and carried, the installations were approved. TRAFFIC CONTROL DEVICES RETURNED FOR FURTHER STUDY The Board received recommendations from Clem Hazinski, Manager.of the Bureau of Traffic and Lighting, for removing parking meters and installing no parking signs on the east side of 400 N.'Michigan and on the west side of 300 N. Main Street. Mr. Barcome noted that the Bond Ordinance for the parking garages stipulates that meters removed must be relocated. Upon motion made, seconded and carried, the Board referred these recommendations back to Mr. Hazinski for further study and asked him to make a recommendation for relocating these 20 meters. STREET LIGHT OUTAGE REPORT The Street Light Outage Report for the period of November 12 to November 15 was received and ordered filed. SPECIFICATIONS FOR FIRE DEPARTMENT RESCUE VEHICLE Specifications for the Rescue Vehicle for which the Fire Department has adver- tised for bids were received by the Board and ordered filed.
