MAY 21, 1973
A regular meeting of the Board of Public Works was convened�at 9:30 a.m. on Monday,
May 21, 1973 with all members present. Minutes of the previous meeting were
reviewed and approved.
BID OPENING - R & s 63 - BENDIX DRIVE
This being the date set for receiving bids for Project R & S 63, Bendix Drive
widening, the following bids were opened and publicly read, the Clerk having
tendered proofs of publication in the South Bend Tribune and the Tri-County News
which were found to be sufficient:
The total amount of the bid was read and the bids were available for inspection
by any interested persons.

LETTER - RE: FLOOD INSURANCE
Mr. Donald Germann, Director, St. Joseph County Civil Defense, presented the
following letter to the Board:

I suggest that you urge your respective governmental officials that they
contact the Federal Insurance Administrator in HUD, Washington, D.C.
(202) 755-5581 immediately. Flood insurance can be made available to a
community within 6 working days after HUD receives a completed application
containing the required land use measure.

LETTER IN REFERENCE TO STREET LIGHT OUTAGE REPORTS .
The Board had requested a report from Police Chief Robert J. Urban in regard
to the low number of street light outage reports being filed. The following
letter was received:

Reference street light outage reports, I have directed all officers
to pay special attention to all street lights within the city and to

AREA PLAN RECOMMENDATION - VACATION OF ALLEY NORTH OF WESTERN
The Board received a favorable recommendation from the Area Plan Commission in
regard to the proposed vacation of the alley North of Western Avenue, between
Scott Street and Taylor Street. Upon motion made, seconded and carried, the
petition was sent to the Division of Engineering for the preparation of the
Vacation Resolution.
AREA PLAN RECOMMENDATION - VACATION OF EAST -WEST ALLEY SOUTH OF PRAIRIE
The Board received a favorable recommendation from the Area Plan Commission in
regard to the proposed vacation of the east -west alley south of Prairie Avenue.
Upon motion made, seconded and carried, the petition was sent to the Division
of Engineering for the preparation of the Vacation Resolution.

SIGNING OF CONTRACT AND PERFORMANCE BOND - PROJECT R & S 58, NORTHSIDE BLVD.
Upon motion made, seconded and carried, the Board signed the contract and approved
the maintenance bond with Rieth-Riley Construction Company for Project R & S 58,
Northside Boulevard from 130' west of -Francis Street to Wayne Street, in the
amount of $54,680.00.
RECOMMENDATION ON REQUEST -TO HOLD TENT SERVICES ON CITY -OWNED LOT
The Board received a memorandum from James A. Roemer, City Attorney concerning
a request made by the Emanuel Church of Deliverance to use a city -owned lot for
tent services. Mr. Roemer recommended that the Board disallow the request because
of the possibility of liability in case of falls, fire, etc. His recommendation
continued that the church could probably find private property to use for their
tent services and work out lease and indemnification arrangements with the owner.
Upon motion made, seconded -and carried, the Board accepted Mr. Roemer's recommendation
and disapproved the request.
REQUEST FOR MEETING ON GUIDELINES FOR WALKS AND BIKE RIDES
Miss Cynthia J. Remke, Co -coordinator for the Michiana Walk for Development, asked
for a meeting with a representative of the Board on setting up guidelines for
future walks. Upon motion made, seconded and carried, the Board directed that
Mr. Clem Hazinski, Manager, -Bureau of Traffic and Lighting, be asked to set up a
meeting with Mr. Seitz, Captain Sweitzer of the Police Department, Donald Germann,
V St. Joseph Count Civil Defense a representative of the Charitable Solicitations

Commission and Miss Remke to work out guidelines for any future activitiesofthis
nature.

which the City has not been installing. However, a field check indicated

time. (Note: due to its close proximity to the C.B.D. and the type of

Petitioner - Ralph Mclnerny and Councilman Serge. The original' petition was
on the 2111 block, however, Portage is one of the diminishing few unlighted
modernized arterials. It is recommended that the existing pole line on the
"east" side of Portage (which is approximate arterial spacing of 1501) be

Petitioners: Western Avenue -businessmen via Councilman Szymkowiak
The present lighting under the viaduct light both the walk and the street.
However, the light cut-off from this fixture is quite severe and does leave
dark areas on the walkway. It is recommended that 3 - 10,900 Lumen
fluorescent fixtures be added to the viaduct. This lighting system will
eliminate any dark spots.

Mr. Richardson explained that the problem is, although there is unspent money since
the first of the year, the City cannot contract for more than the budgeted amount
of $450,000 divided by 12. A melting will be held with Mr. Wadzinski to work out
the installations which can be made with the money budgeted for this year and
additional money will be requested in next year's budget to complete the installations.
Upon motion made, seconded and carried, the Board approved the list of recommended
installations.

RECOMMENDATION - WEST SIDE MEMORIAL DAY PARADE REQUEST
The Board received a recommendation from Mr. Clem Hazinski, Manager, Bureau
of Traffic and Lighting, that approval be given for the West Side Memorial Day
Parade on May 28, 1973 at 9:30 a.m. The City had been indemnified and the
Police Department has been notified. Upon mot,lon made, seconded and carried,
the Board approved the recommendation and granted the parade request.
RECOMMENDATION - HAMMES COMMUNITY LITTLE LEAGUE PARADE REQUEST
The Board received a recommendation from Mr. Clem Hazinski, Manager, Bureau

and carried, the Board approved the recommendation and granted the parade request.
CONTRACTOR'S BOND FILED - GENE V. SCHLUETER AND CHARLES DICKEY
The Board received a Contractor's Bond from Gene V. Schlueter and Charles Dickey.
It was not on an approved City Bond Form and the Clerk was directed to notify
them that they should use the City Bond Form.
APPROVAL OF PLANS AND BID REQUEST FOR MIAMI AND IRE,LAND INTERSECTION
Upon motion made, seconded and carried, the Board approved and signed plans for
the Miami -Ireland Road Intersection construction. William J. Richardson, P.E.,
Director of Public Works, requested that bids be received for the Project, R & S
62, Miami and Ireland Intersection on June 4, 1973. Upon motion made, seconded
and carried, the Clerk was instructed to advertise for bids on May 25 and June 1,
1973 with bids to be received at 9:30 a.m. on Monday, June 4, 1973.
REQUEST FOR TEMPORARY CLOSING OF ALLEY - 740 S. WALNUT STREET

To the Honorable Board of Public Works:
The undersi.gned, Carl J. Reinke & Sons, Inc. wish to secure permission
from the Board to temporarily close an alley during the construction
period for.an Addition to the Sobieski Savings & Loan Association at
740 S. Walnut St., South Bend, Indiana.
The alley is that running East & West, situated at a point 1.32 ft. North
of Dunham St. on Walnut St. This alley, running to the East, 145'8" is
met with another cross alley as shown on the enclosed plot plan. It is
the desire of the undersigned to close off the access to the alley
starting at Walnut St., on the North side_of the Sobieski Savings & Loan
and running East approximately 60 ft. It is requested that we be allowed
to temporarily close this alley for a period of 60 days.
It is requested that permission be granted to close this alley for the
safety of the neighborhood during the period of construction and also to
permit access for constructing the Addition to the Sobieski building.

REGULAR MEETING
MAY 21, 1973
SIGNING OF CONTRACT AND PERFORMANCE BOND - KENSINGTON FARMS SANITARY SEWERS
Upon motion made, seconded and carried, the Board signed the contract and
approved the €lerformance Bond for the Kensington Farms Sanitary Sewer Project
with Howell Construction Company.
COMPLAINTS - VALLEY CABLE VISION
The Board received two complaints from citizens received by the Mayor's Action
Center regarding tree trimming and use of utility poles by Valley Cable Vision.
Upon motion made, seconded and carried, the Board requested that Mr. James Roemer,
City Attorney, write to Valley Cable Vision regarding this matter.
EAST MILL RACE PROPERTY
Mrs. Jean Sharpe, Portage Park Committee, was present and asked what progress
had been made in checking the property in the East Mill Race area and researching
the lease between the City and Aays Rent -all Company. Mr. Roemer said that he
has made a contact to have title to all the property in the area researched and
that he hoped to have a report on the lease agreement to make to the Board at
r_4 its meeting next week.

t+ CERTIFICATION OF PERSONNEL - WASTEWATER TREATMENT PLANT

Mr. Richardson reported to the Board that he had received a letter from Mr. Louis
Rague, Manager, Bureau of Wastewater, that the following people from the South
Bend Plant passed Certification exams and advanced their classification:
Dave Irwin Class III
Vern Forsgren Class II
Felix Jasinski Class II
Walter Brown Class II
The plant now has the following inventory of certified operators: Class IV -3;
Class 111 -2; Class II -10; and Class 1 -7. Mr. Rague commended Casimir Rzepnicki
and Joe Fedor for conducting the classes and encouraging people to work towards
advancement. Upon motion made, seconded and carried, the Board ordered the letter
filed.
STREET LIGHT OUTAGE REPORT
The Street Light Outage Report for the period of 5/11/73 to 5/16/73 was received
and ordered filed.
