Home My WebLink About02/12/73 Board of Public Works MinutesREGULAR MEETING FEBRUARY 12,1973 A regular meeting of the Board of Public Works convened at 9:30 a.m. on Monday, February 12, 1973 with all members present. Minutes of the last meeting were reviewed and approved. AWARDING OF BIDS - STREET SWEEPERS The Board received a recommendation from William J. Richardson, Director of Public Works, that the bid of Ries Equipment Company, Indianapolis, for four street sweepers at a net bid of $79,960 be accepted, subject to approval by the Common Council. Upon motion made, seconded and carried, the Board accepted the recom- mendation and awarded the bid to Ries Equipment Company. AREA PLAN COMMISSION RECOMMENDATION - VACATION OF ALLEY BETWEEN ROGER AND BERTRAND A favorable recommendation was received from the Area Plan Commission in regard to the petition to vacate the first east -west alley between Meade and Fremont, from Fremont Street west to the north -south alley between Roger Street and Bertrand Street. Upon motion made, seconded and carried, the Board ordered the recommendation filed and referred the petition to the Bureau of Engineering for preparation of the Vacation Resolution. AREA PLAN COMMISSION RECOMMENDATION - VACATION OF ALLEYS KNOWN AS HIBBARD COURT A favorable recommendation was received from the Area Plan Commission in regard to the petitions to vacate two alleys known as Hibbard Court, running East and West of Michigan Street, between Michigan and Main and Michigan and St. Joseph Streets, in the Downtown Renewal Project, Indiana R-66. Upon motion made, seconded and carried the Board accepted the recommendation and ordered it filed. ADOPTION OF VACATION RESOLUTION - ALLEY WEST OF MICHIGAN BETWEEN MICHIGAN AND MAIN Upon motion made, seconded and carried, the following resolution was adopted: VACATION RESOLUTION NO. 3374-1973 RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: Fourteen (14) foot alley, sometimes known as Hibbard Court, between Washington Street and Jefferson Boulevard, running West from Michigan Street to the East line of the North -South alley between Michigan and Main Streets, a distance of one hundred sixty-five (165) feet. Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual utilities. The following property may be injuriously or beneficially affected by such vacation: Lots 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35 and 36 of the Original Plat of South Bend, Indiana. Notice of this Resolution shall be published on the 16th and 23rd day of February, 1973 in the South Bend Tribune and in the Tri-County News. This Board, at its office, on the 5th day of March, 1973, at 9:30 o'clock A.M., will hear and receive remonstrances from all persons interested in or affected by these proceedings. Barcome ATTEST: s/ Patricia DeClercq, Clerk REQUEST FOR PARADE - AVALON GROTTO MIDWEST GROTTO CONVENTION Mr. Homer Cuthbertson, representing the Avalon Grotto, appeared before the Board and asked for permission to hold a parade at 1:30 p.m. on October 5, 1974 in connection with the Midwest Grotto Convention to be held in South Bend. The Board referred the matter to Mr. Clem Hazinski, Director of the Bureau of Traffic and Lighting and asked that he contact Mr. Cuthbertson in regard to this request. MEMO FROM BUREAU OF ENGINEERING RE: ALLEY VACATION EAST OF MICHIGAN BETWEEN MADISON AND MARION The Board received a report from the Bureau of Administration and Design that there were no objections to the vacation of the alley East of Michigan Street, between Madison and Marion. Upon motion made, seconded and carried, the Board referred the petition to the Area Plan Commission for their recommendation. MEMO FROM BUREAU OF ENGINEERING RE: ALLEY VACATION NORTH OF WESTERN BETWEEN SCOTT AND TAYLOR In response to a letter from Rev. Richard Kennedy, C.S.C., St. Patriek's Church, regarding vacation of the alley North of Western between Scott and Taylor Streets, the Bureau of Administration and Design reported that there were no objections to the vacation of the alley. The Clerk was instructed to write Father Kennedy that action on the vacation would proceed upon receipt of the petition, the fee and -the names of the affected property owners. 2/12/73 REQUEST FOR TRAFFIC CONTROL DEVICE - 631 LINCOLNWAY EAST A recommendation was received from the Bureau of Traffic and Lighting for the installation of a one hour parking time limit at 631 Lincolnway East to create a turnover of parking space for the Sofa Shop. Upon motion made, seconded and carried, the Board approved the request_. PAYMENT REQUEST NO. 17 -WASTEWATER TREATMENT PLANT ADDITIONS Upon motion made, seconded and carried, the Board approved Paymnt_Request No. 17 to Sollitt Construction Company, Inc. in the amount of $138,454.90 for the Wastewater Treatment Plant Additions. REQUEST FOR VAN ON STREET - EMERSON AND NORTHSIDE BOULEVARD The Board received a request from the United Association of Plumbers and Pipe - fitters Local No. 172 to set a van on the street for two weeks, from February 18 to March 5, 1973 for physical examinations for members and their wives. Upon motion made, seconded and carried, the Board approved the request subject to approval by the Bureau of Traffic and Lighting and referred it to that Bureau for investigation. LETTER FROM MRS. F. S. GISH RE: STUDENT DRIVERS AT LA SALLE HIGH SCHOOL A letter was received from Mrs. F. S. Gish, 2801 Elwood Avenue, regarding student drivers causing noise pollution. The Board referred the letter to the Board of Public Safety. CERTIFICATE OF INSURANCE-_AU_LM CONSTRUCTION COMPANY. INC. A Certificate of Insurance was received from Auim Construction Company, Inc, and upon motion made, seconded and carried, the certificate was approved. CONTINUATION CERTIFICATES APPROVED A memo from the Bureau of Engineering was received stating that the following continuation certificates were in order and, upon motion made, seconded and carried, they were approved by the Board: Excavation - Earl C. DeVan Ito 12/31/73 Excavation - Charles F. Stickler, Jr. to 12/31/73 EXCAVATION BONDS AND CONTRACTOR'S BONDS APPROVED A memo from the Bureau of Engineering was received which stated that the following Contractor's and Excavation Bonds were found to be in order: Contractor's Bond Hickey Company, Inc. 1/2/73 to 12/31/73 Contractor's Bond All American Concrete Co. 1/24/73 to 1/24/74 Excavation Bond Alex C. RESCHEDULING OF BOARD OF PUBLIC WORKS MEETING Because of the legal holiday next Monday, February 19, 1973, the Board of Public Works meeting will be held at 10:30 a.m. on Tuesday, February 20, 1973 immediately following the Board of Public Safety meeting. The Water and Wastewater Treatment Board meeting will be held at 11:15 a.m. on Tuesday, the 20th. 2/12/73 STREET LIGHT OUTAGE REPORT Street Light Outage reports for the period of 2/2/73 to 2/9/73 were received and ordered filed. REPORT ON COMPLAINT OF MRS,ANTON LENCHEK. 2850 ROCKNE DRIVE Mr. Richardson reported that, following a complaint by Mrs. Anton Lenchek, 2850 Rockne Drive, that her driveway and the street in front of her house have washed away because of faulty drains in the street, the drains have been checked and are working properly. There has been some sinking of the driveway but there is no evidence of the problem having been caused by catch basins. There is some cracking of the slurry seal in the street but there is not much that can be done about it until warm weather comes.
