HomeMy WebLinkAbout11/06/72 Board of Public Works Minutes5 November 6, 1972 A regular meeting of the Board of Public Works and Safety convened at 9:30 A.M. on Monday, November 6, 1972. All members were present. Mr. Richardson presided at the meeting. Minutes of the last meeting were reviewed and approved. FIRE DEPARTMENTBattalion Chief William Wilson appeared at the meeting. A request was received from Chief Bland asking for an extension of sick leave over thirty days from Dale Fortin. Firefighter Fortin had a heart attack while on duty and will probably be retired. Upon motion made, seconded and carried, the request was granted. BUILDING DEPARTMENT - SUB -STANDARD DIVISION Mr. Isaiah Steed appeared before the Board and the following matters were discussed: Mr. Jon Carpenter appeared before the Board to complain about the condition of 710 North Hill Street. He stated that the contract to demolish the structure had been awarded to the Bryant Excavating Company, but the demolition has .not taken place and the place is ? being vandalized to such an extent Mr. Carpenter fears it may be set on fire and his house is only ten feet away from it. Upon motion made, seconded and carried, the Clerk was directed to U write to Mr. Bryant telling him the house must be demolished by 5:00 O'clock P.M. on Wednesday, November 8th, or the contract will be given to the next highest bidder. 410 Pennsylvania Mr. Preston Gray', owner ,:was directed to appear before the Board on this date, to assure the Board that he had complied with their directions about cleaning up his property. He failed to appear and Mr. Steed was asked to investigate the, matter and it was continued one week. 1122 Bissell Street Mr. Masterman of Homemakers Finance appeared before the Board and informed them he had received an abandomnent order for the property. He requested a thirty days continuance in order to rehabilitate the property. Upon motion made, seconded and carried, the request was granted. 535 South Taylor Street Mrs. Esther Littow appeared before the Board and stated she is having the house rehabilitated, but it is not yet complete. She requested a thirty days continuance, and upon motion made, seconded and carried the request was granted. The sub -standard structures reported by the Redevelopment Commission were continued until the Redevelopment Commission makes another report. 1205 Dunham Street This being the date set for receiving bids for the demolition of the structure at 1205 Dunham Street, the following bids were opened and read: Michiana Builders $585.00 O'Neal Trucking Co. 650.00 B & J Demolition 795.00 Upon motion made, seconded and carried, the award was made to Michiana Builders on its low bid of $585.00. 1020 Fuerbringer Street This being the date iet for receiving bids for the demolition of the structure at 1020 Fuerbringer Street, the following bids were opened and read: Michiana Builders $790.00 O'Neal Trucking Co. 1,100.00 B & J Demolition 850.00 Upon motion made, seconded and carried the award was made to Michiana Builders on its low bid of $790.00. 162 11/6/72 625 Walnut Street This being the date set for receiving bids for the demolition of the structure at 625 Walnut Street, the following bids were opened and publicly read: Michiana Builders $685.00 O'Neal Trucking Co. 625:00 B & J Demolition , 600.00 Mr. Marvin Groves, 1223 West Thomas Street, South Bend appeared before the Board and said he was working on the rehabilitation of the structure. Mr. Steed was directed to inspect the dwelling and report back on it at the next meeting. The bids were ordered held up. 2422 Linden Avenue This being the date set for receiving bids for the demolition of the structure at 2422 Linden Avenue the following bids were opened and publicly read: Michiana Builders $685.00 O'Neal Trucking 625.00 B & J Demolition 500.00 Upon motion made, seconded and carried, the award was made to B & J Demolition on its low bid of $500.00. 114 North Shore Drive A letter was received from Builder's United Enterprises, Inc., 1530 Kemble Avenue, South Bend, Indiana, wherein they stated they are interested in purchasing the house on a 235-1 program. They would bring the house up to standard and then sell it. They requested a ninety (90) continuance to make all arrange- ments with HUD. Upon motion made, seconded and carried, the Board granted a thirty (30) day continuance, and asked that a written committment from HUD to show their intent in the matter. NOTICE TO DEMOLITION CONTRACTORS The following notice to demolition contractors was presented to the Board: DEPARTMENT OF PUBLIC. WORKS BUREAU OF BUILDINGS AND PERMITS SUB -STANDARD BUILDING SECTION CITY OF SOUTH BEND, INDIANA PART I NOTICE TO DEMOLITION CONTRACTORS To Whom IT MAY CONCERN: Notice is hereby given by the Building Commissioner, as agent for Who has interestin the following described real estate: The dwelling has not been demolished in accordance with the orders issued by the Building Commissioner. Therefore, the Building Commissioner, as agent for the owners or persons described having an interest in said property, does hereby advertise and solicit bids for the following work and conditions: A. General Conditions 1. Demolition of the above described building in its entirely and including the removal of the following: accessory buildings and sheds, sidewalks, driveways, slabs, fences retaining walls, basements, dead trees, bushes and all other such items that might be a part of the property that should be removed. 6 1 r� J 11/6/72 2. Sever all utilities to the building in accordance with each Utility's rules and regulations, to wit: Northern Indiana Public Service Co. Indiana & Michigan Electric Co. Indiana Bell Telephone Co. South Bend Water Works (Attached) South Bend Sewer Dept. (Attached) 3. Remove all materials and all debris resulting from said demolition from the basement before such opening is back - filled. 4. Fill to grade level and grade the lot with 3 inches of top soil and seed with 50% rye grass seed and 50% blue grass seed. 5. Leave all live trees unless specifically requested to remove, and protect them from further damage as the result of the demolition. 6 No fires of any size will be permitted for the disposing of materials as the result of the demolition, upon the site. Only salamanders will be permitted for warmth. 7. All debris and residue resulting from the demolition is to be hauled away and deposited in an approved landfill. 8. Secure authority for barricading and traffic control from the Department of Public Works, Bureau of Traffic and lighting in instances of demolition of structures adjacent to arterial streets when traffic control measures are nec- essary. A. PROGRESS & COMPLETION 1. The Contractor shall secure a permit within three (3) cal- endar days after receipt of "Notice to Proceed" from Building Official. 2. The conditions as set forth in Section A, "General Con- ditions" shall be complete and ready for final inspection within thirty (30) calendar days after the issuance of the permit. 3. Final inspection of the premises will be made upon com- pletion of all work. C. INSTRUCTION TO BIDDERS 1. All bids to demolish shall be submitted in accordance with the following: a. Bid to be based upon bidder retaining for his own use or resale all salvable materials at the site of demo- lition. b. Contractor will be liable for damage resulting to side- walks, curbs, alley -ways, and streets, and on any other property as the result of the demolit-ton or equipment used in the demolition. 2. The successful bidder shall submit and have on file a per- formance bond as required by the Building Code in the penal sum of $5,000 for the City of South Bend. z 11/6/72 3. Bids shall be submitted in a sealed envelope on forms sup- plied by the Board of Works to the Building Commissioner in Room #1308, County -City Building on or before 9:30 A.M. on Monday at which time and place said Board of Works shall open atl bids and award contract to the best bidder. 4. The owners shall pay all costs incurred through the award- ing and through the completion of the terms of the -contract. Upon failure of the owners to pay such costs, the Building Commissioner, shall, by paying all costs, secure all liens which shall have been filed against the property. D. FAILURE TO PERFORM 1. Contractor agrees that failure to comply with Section B "Progress and Completion" wIll result i'n the Board of Public Works and Safety of the City of South Bend, im- posing liquidated damages in an amount of $10,00 per day for each day the demolition contract remains incompleted. 2. Payment of the contract prices will be made to the Con- tractor after setting off against the award price the liquated damages said Contractor incurs, and any ex- penses necessarily incurred in the administration of the contract. 3. Failure to perform in the manner prescribed in this agree- ment will result in notification of such non-performance to the Board of Public Works and Safety. PART II PUBLIC WORKS DEMOLITION CONTRACT THIS AGREEMENT, made and entered into this day of 19 by and between hereinafter called the Contractor & the Board of Public Works and Safety herin called the "Board". WITNESSETH: That the Contractor covenants and agrees to demolish the following, as fully set out in the Notice to Contractors, Standard Specifications, Special Provisions, and Bid Proposal for: PROJECT NO. DESCRIPTION STRUCTURE COMPLETION DATE See "Notice to Proceed'! The price for this demolition was received and accepted by the Board on the day of 19 The Contractor further agrees to guarantee the materials and workman- ship against any defects for a period of (1) year from the date of final acceptance of this improvement by the Board. Upon written notice from the Board, the Contractor will remove and replace with no cost to the Board, any defective workmanship or materials which may appear within the 1 year period and pay for any damage to other property caused by this defect. The Contractor further agrees to notify the Building Official when this demolition is completed. This notification shall be in the form of a written notice, signed by the Contractor. Upon final acceptance of the work by the Building Official, the Contractors final payment will be presented to the Board. 65 11/6/72 VACATION�RESOLUTION NO. 3371, 1972 - DEAN STREET - ADOPTED Area Plan Commission having filed with the Board it's favorable recommen- dation for the vacation of a". -portion of Dean Street lying between the West line of the first North -South alley West of Main Street and the West line of Section 24. T37N., R2E, the following Resolution is now adopted: VACATION RESOLUTION NO. 3371, 1972 RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: A portion of Dean Street lying between the West line of the first North -South alley West of Main Street and the West line of Section 24. T37N., R2E Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facil- ities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the indi- vidual Utilities. The following property may be injuriously or beneficially affected by such vacation: John E. Walz's Revised Addition Notice of this Resolution shall be published on the 10th day of November and the 17th day of November, 1972, in the South Bend.Tri- bune and in the Tri County News. This Board, at its office, on the 20th day of November, 1972, at 9:30 o'clock, A.M., will hear and receive remonstrances from all per- sons interested in or affected by these proceedings. Noble, -Clerk COMMUNICATION CONCERNING PROPOSED RECONSTRUCTION OF IRONWOOD ROAD A communication was received from Congressman John Brademas relative to a letter from Mrs. L. C. Magyar. Upon motion made, seconded and carried, this was referred to the Bureau of Engineering for investigation and report. LETTER FROM MRS. LONNIE BOTTOMS - CONSTRUCTION IN FRONT OF 612 S. MAIN STREET The following letter was presented to the Board: October 30, 1972 Board of Public Works and Safety Dear Sir: I'm writing you in regard to construction on the street in front of my house. I have an apartment I rent which is part of my income. I haven't been able to rent it since about the mid- dle of August, there is no way to get to the front of 612 South Main Street. 11/6/72 I've lost ten (10) weeks of rent already the amount of $250.00 ( $25.00 per week ). The Spot Bar around the corner on South Street had a way arranged for them that they had no interuption to their business from the front. That is their income, this apartment is mine. I don't think its anything but fair, that I be reimbursed for my loss. Sincerely, s/ Mrs. Lonnie Bottoms 612 S. Main Street South Bend, Indiana 46601 It was the consensus of the Board that there is no way they can re- compense Mrs. Bottoms for not having access to the front of her build- ing. It was noted by the City Engineer that it has been made pos- sible for her to have access to the rear of her home from the alley off South Street as well as the alley from Michigan Street. LETTER FROM FRANK KOLOSZAR - UNIT DECLARED SCRAP The following letter was presented to the Board: October 25, 1972 Mr. William Richardson City Engineer South,Bend, Ind. Dear Mr. Richardson: The below listed unit is hereby declared scrap and should be dispositioned soon as possible: One (1) Mayrath Portable Washer, with gasoline starter, two (2) wheels 6.40xl5 4 ply tires, ring hitch. Value is approximately $75.00. Please advise what action I should take to remove the unit from the MSF garage. REQUEST TO PUT CHRISTMAS TREE 1/3 OVER PUBLIC PROPERTY - GILBERT'S MEN'S STORE The following letter was presented to the Board: November 2, 1972 Mrs. Freda Noble, Clerk of BOARD OF PUBLIC WORKS & SAFETY Rm 1316 City -County Bldg. South Bend, Ind. 46601 Re: Gilbert's Christmas Tree Dear Mrs. Noble: I am writing you to request permission to place a Christmas decor- ation for Gilbert's Men's Store about one third over public property. This is the same Christmas tree that was used last year, and it will be placed in the same position as last year. The center of the tree sets 11/6/72 2' inside Gilbert's property line in their parking lot. Since the bottom of the tree" -has a 9' radius, it would extend 7' over,the sidewalk. People are free to walk under the tree whether it is on the parking lot or over the sidewalk. Of course, there are hundreds of. signs hanging over the sidewalks; practically every town and city in the United States puts Christmas displays on streetlight poles or strings them across streets and sidewalks to celebrate Christmas. The same insurance forms which were supplied to your Board are again being sent to you. I hope it is possible for you to act on this at your next meet- ing as Mr. Paul Gilbert wishes the tree installed soon. Thank you again. Sincerely yours, s/ Noel H. REQUEST TO PURCHASE TWO VACUUM STREET SWEEPERS A request was received from the South Bend Street Commissioner, Donald L. Deeker, that the City purchase two (2) Vacuum Street Sweepers. Upon motion made, seconded and carried, the Clerk was directed to advertise for the street sweepers, with bids to be received on November 20, 1972. REQUEST TO HAVE STREET LIGHTING ON SOUTH WELLINGTON INVESTIGATED A letter was presented to the Board from the LaSalle Park District Council, Inc. requesting the Board to investigate the need for street lighting on South Wellington Street between Western and_ Washington Avenues. It was their understanding there is no light- ing at all in those two blocks. This request was referred to the Bureau of Traffic and Lighting for study and report back to the Board. TRAFFIC CONTROL DEVICE APPROVED Upon motion made, seconded and carri-ed, the Board accepted the recom- mendation of the Bureau of Traffic and Lighting and approved the following Traffic Control Device: Installation of a STOP sign on Walsh Street at Cedar Street A.C.T.I.O.N. IN -KIND VOUCHERS FOR FIRE STATIONS #10, 7 & 8 In -Kind vouchers for contributions covering estimated rental valua- tion for Fire Stations #10, #7 and #8 were filed for the month of November, 1972. COMPLAINT FROM COUNCILMAN NEWBURN Councilman Odell Newburn appeared before the Board to complain that after a collision debris and broken glass was allowed to litter the pavement. Upon motion made, seconded and carried, the Clerk was directed to write to the towing services and in- struct them to make sure all debris and broken glass was removed from the pavement after an accident. 6 11/6/72 WEIGHTS AND MEASUR Board and presentee October, 1972. REPORT Mr. Bert Cichowicz appeared before the the report of the City Sealer for the month of motion made, seconded and rcarried, the report The Special Police Commissions of Hozie Simmons and John J. Zielinski were denied inasmuch as Drewrys, Ltd., has closed operations. CONTRACTOR' S BOND A Contractor's Bond in the amount of $1,000.00 was approved for Marion McCaskill to. October 27, 1973. Mr. Harley of Weisberger Brothers appeared before the Board to complain that the widening of the intersection of Calvert and Main Street had left a fourteen foot drop between the sidewalk and the loading dock of their company. Mr. Richardson informed him he would make an in- vestigation of the matter. 202 East Pennsylvania Mr. Myron Duncan, 1232 Woodlake Avenue appeared before the Board to discuss the sub -standard condition of the structure at 202 East Pennsylvania. At his request the matter was continued for two weeks.COMPLAINT FROM MISS GUTHRIE Miss Virginia Guthrie appeared before the Board to complain about the condition of the pavement on Michigan Street near the new Post Office building. Mr. Richardson said he would look into the matter. STREET LIGHT OUTAGE REPORTS Street light outage reports were filed for the period of 10/26/72 to 11/2/72.
