However, if you are unable to currently provide a listing, please understand a listing must be provided prior to contract approval. Until the completion of the proposed project, you are under a continuing obligation to immediately notify the City of South Bend in the event that you subsequently determine that you will use a subcontractor on the proposed project. If Subcontractors will be used we will submit this information 24 hours after notification. 4. Attach a listing of equipment you have available to use for the proposed project. Persons, partnerships, corporations, associations, or joint ventures awarded a contract by the City of South Bend through its agencies, boards, or commissions shall not discriminate against any employee or applicant for employment in the performance of a City contract with respect to hire, tenure, terms, conditions, or privileges of employment, or any matter directly or indirectly related to employment because of race, sex, religion, color, national origin, ancestry, age, gender expression, gender identity, sexual orientation or disability that does not affect that person's ability to perform the work. In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or any combination of the foregoing including, but not limited to, public works contracts awarded under public bidding laws or other contracts in which public bids are not required by law, the City, its agencies, boards, or commissions may consider the Contractor's good faith efforts to obtain participation by those Contractors certified by the State of Indiana as a Minority Business ("MBE") or as a Women's Business Enterprise ("WBE") as a factor in determining the lowest, responsible, responsive bidder. In no event shall persons or entities seeking the award of a City contract be required to award a subcontract to an MBE/WBE; however, it may not unlawfully discriminate against said WBE/MBE. A finding of a discriminatory practice by the City's MBE/WBE Utilization Board shall prohibit that person or entity from being awarded a City contract for a period of one (1) year from the date of such determination, and such determination may also be grounds for terminating the contact for which the discriminatory practice or noncompliance pertains. 7. A pre -bid meeting was held on October 24, 2016, in which representatives were present from Walsh and Kelly Inc., R. Yoder, and Premium Concrete Services. The pre -bid meeting was not intended to be mandatory, and the Division of Engineering believes that bidders that did not attend should still be considered responsive and responsible bidders. For the interest of the City, the Board of Public Works is requested to waive the required pre -bid meeting attendeance. The Division of Engineering, therefore, recommends that the Board award the contracts for all Divisions to Ziolkowski Construction, Inc. for a total amount of $135,428.00. All alternates were approved and are included in the contract amount. " A math error was found within Line Item 4 of Division F in the bid from Ziolkowski Construction Inc. Correcting the math error increases their Division F Base Bid by $20.00. Ziolkowski Construction, Inc has been contacted regarding the issue and the Division of Engineering has deemed the bid to still be responsible. The amount provided in this award memo reflects the correction to the line item. As Ziolkowski Construction, Inc. remains the low bidder in this Division, The Division of Engineering recommends awarding Division F to Ziolkowski Construction Inc. The Division of Engineering has appropriated sufficient funds from the MVH Fund (202- 0619-431.31-06). Please call with your questions.
