CENTURY CENTER ASSIGNMENT AGREEMENTS REVOKED -NEW AGREEMENTS APPROVED
Patrick M. McMahon, Manager of the Bureau of Public Construction,
advised the Board that the Agreements of Assignment with Johnson
Burgee, Architect, and Sollitt Construction Company, Construction
Manager, for Century Center had been approved by the Board on
November 10, 1975 and had been submitted to both parties for
signature. Mr. McMahon said both Johnson-Burgee and Sollitt Con
struction Company had requested that changes be made in the agreements.
Both agreed to the assignment of part of their fee to the Civic Center
Building Authority but they did not want to release the City.from its
obligation in regard to the contracts. New Agreements of Assignment
were prepared. The new agreements have been reviewed by Deputy City
Attorney Kathleen Cekanski and she recommended to the Board that they
revoke the agreements entered into on November 10, 1975 and approve
the new agreements submitted to them today. Upon motion made by
Mr. Seitz, seconded by Mr. Farrand, and carried, the Board revoked
the Agreements of Assignment for the Architect and Construction -
Manager for Century Center entered into on November 10, 1975 and,
hereby, approved the new Agreements of Assignment by the City of South
Bend to the South Bend Civic Center Building Authority of a portion
of the contract with Johnson-Burgee, Architect, and a portion of the
contract with Sollitt Construction Company, Construction -Manager.
There being no further business to come before the special meeting,
upon motion made, seconded and carried, the special meeting adjourned
at 8:30 a.m.
