Parrand. Mr. Farrand announced that the meeting would recess and move to the 4th Floor Council Chambers for the opening of the bids for the Century Center. The meeting reconvened at 9:35 a.m. All members of the Board were present, as was Deputy City Attorney Kathleen Cekanski. OPENING OF BIDS - CENTURY CENTER This was the date set for receiving bids for various contracts for the construction of Century Center. PUBCHASE AGREEMENT APPROVED - SALE OF OLD FIRE STATION FOUR The Board received a purchase agreement for the sale of Old Fire Station Number Four, 1210 W. Thomas Street, to Richard Kennedy for a total purchase price of $8310. Kathleen Cekanski, Deputy City Attorney, advised the Board that she had prepared the contract and had reviewed it with Mr. Kennedy. It is now ready for Board approval. Upon motion made, seconded and carried, the Board approved the purchase agreement. !A I REGULAR MEETING AUGUST 4, 1975 REPORT. RE: INQUIRY REGARDING WILLIA14 STREET'PARKING The following report was received: "To: Board of Public Works From: Bureau of Traffic and Lighting The resident of an apartment house at 229 S.William requested a parking space in front of the residence. The City Legal Department was contacted and provided information from Burns Statutes, 'a case in 1943. Briefly, a property owner's right does not include the privilege of storing autos in front of the property. It was also determined that a parking meter in front of a person's property does not interfere with his/her right of ingress and egress. The solution, as directed by the City Code with the exception of the Central Business District, is offstreet parking. (This location is not within the exempted central business core area as depicted in SEc. 21-104. s/ Ralph Wadzinski " Ttl Upon motion made, seconded and carried, the report was ordered filed. LETTER RE: TRAFFIC PROBLEM ON MAIN STREET W The Board received a letter from Charles Rinkus calling attention to traffic problems on S. Main Street from the 2800 block to Chippewa, particularly in the area of Copco. Upon motion made, seconded and carried, the letter was referred to the Bureau of Traffic and Lighting for review and recommendation. FILING OF PETITION TO VACATE ALL STREETS, ALLEYS AND LOTS NOT HERETOFORE VACATED IN RIVER BEND ADDITION The Department of Redevelopment, by the Redevelopment Commissioners, files its petition with the Board to vacate all streets, alleys and lots not heretofore vacated in the plat of River Bend Addition. Mr. Farrand noted that the Department of Public Works has reviewed the petition. Upon motion made,seconded and carried, the petition was filed and referred to the Area Plan Commission for their review and recommendation. FILING OF PETITION BY TRUSTEES OF INDIANA UNIVERSITY TO VACATE THREE ALLEYS The Trustees of Indiana University, by their Attorney Philip Carlton Potts, file their petition to vacate the north -south alley from Mishawaka Avenue to Vince Street, running parallel to and located approximately 133.5 feet west of 20th Street in the City of South Bend; the east -west alley running west from 20th Street to and intersection the alley described above, said alley being north of lot 9 of Shank's 2nd Addition and approximately 133.5 feet in length, east and west; and the east -west alley running west from 20th Street to and intersecting the alley described first above, said alley being south of Lot 7 of Shank's 2nd Addition and approximately 133.5 feet in length, east and west. Upon motion made, seconded and carried, the petition was ordered filed and referred to the Department of Engineering for review and recommendation. ADOPTION OF VACATION RESOLUTION NO. 3417 Upon motion made, seconded and carried, the following resolution was adopted: REGULAR MEETING AUGUST 4, 1975 RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: The first East-West alley south of Madison Street, between Lots 171 and 172 in the Original Plat of South Bend, running from Michigan Street West 165 Feet to East right of way line of_N.orth-South alley. Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual Utilities. The following property may be injuriously or beneficially affected by such vacation: Lots 171 and 172 1n the Original Plat of South Bend. Notice of this Resolution shall be published on the 15th and 22nd day of August, 1975 in the South Bend Tribune and in the Tri-County News. It was noted that this is a violation of the Municipal Code, Section 3-5. Upon motion made,seconded and carried, the request was denied. APPLICATION APPROVED - RIVER BEND PLAZA R.E.A.L. SERVICES The Board received an application from R.E.A.L. Services to have a display booth on River Bend Plaza on August 7. Upon motion made, seconded and carried, the application was approved. Reinke and Sons to August 4, 1976 - Contractor's Bond Circle Lumber Company to August 31, 1976 - Contractor's Bond Upon motion made, seconded and carried, the bonds were approved to the dates listed. 11 REGULAR MEETING AUGUST 4, 1975 STREET LIGHT OUTAGE REPORT FILED The Street Light Outage Report for the period of July 23 through August l was received. Upon motion made, seconded and carried, the report was ordered filed. RECOMMENDATION TO AWARD BID APPROVED - WALNUT STREET SIDEWALK AND RETAINING: WALLS`,`G.T.W.'R,'R. The Board received a recommendation from the Bureau of Design and Administration that the bid of the Ziolkowski Construction Company for the retaining walls and sidewalk on Walnut Street at the Grand Trunk Western Railroad crossing be accepted. Upon motion made, seconded and carried, the recommendation was approved and the bid for the Walnut Street retaining walls and sidewalk was awarded to the Ziolkowski Construction Company on their low and only bid of $52,459.90. RECOMMENDATION TO AWARD BID APPROVED - HURON STREET CURBS The Board received a recommendation from the Bureau of Design and Administration that the low bid of the Rieth-Riley Construction Company be accepted for the construction of curbs on Huron Street. Upon motion made,seconded and carried, the Board accepted the recommendation and awarded the bid for the construction of curbs on Huron Street to the Rieth Riley Construction Company on their low bid of $7,010.00. e� RECOMMENDATION TO AWARD BID APPROVED - CURBS ON WESTMOOR STREET The Board received a recommendation from the Bureau of Design and Administration that the low bid of the Rieth Riley Construction Company be accepted for the curb construction on Westmoor Street. Upon motion made, seconded and carried, the recommendation was approved and the Board accepted the low and only bid of the Rieth Riley Construction Company for the construction of the Westmoor Street curbs for a total bid price of $28,027.65. RECOMMENDATION TO AWARD BID APPROVED — MIAMI STREET SIDEWALKS The Board received a recommendation from the Bureau of Design and Administration that the low bid of the McIntyre and Jones Construction Company be accepted for the construction of sidewalks on Miami Street at the Bowman Cemetery. Upon motion made, seconded and carried, the Board approved the recommendation and accepted the low bid of the McIntyre and Jones Construction Company of $6,953.00 for the construction of sidewalks on Miami Street. RECOMMENDATION TO AWARD BID APPROVED - CONSTRUCTION OF ONE BLOCK OF DONMOYER STREET - MICHIGAN TO MAIN The Board received a recommendation from the Bureau of Design and Administration that the low bid of the Rieth Riley Construction Company, including Alternate A - 8"reinforced concrete pavement, be accepted for the construction of one block of Donmoyer Street, from Main to Michigan Street. Upon motion made, seconded and carried, the Board approved the recommendation and accepted the low bid of the Rieth-Riley Construction Company, including Alternate A, 8" reinforced concrete pavement, of $31,558.25 for the construction of one block of Donmoyer Street, from Main to Michigan Street. The bid award was subject to the appropriation of funds. 46 REGULAR MEETING AUGUST 4, 1975 RECOMMENDATION TO AWARD BTD'APPROVED'-'PORTAGE-ELWOOD INTERSECTION The Board received a recommendation from the Bureau of Design and Administration that the low bid of the Rieth Riley Construction Company be accepted for the Portage Avenue -Elwood Avenue radii improvements be accepted. Upon motion made, seconded and carried, the Board approved the recommendation and accepted the low and only bid of the Rieth Riley Construction Company for the Portage Avenue -Elwood Avenue. Radii Improvements at a total bid price of $12,38.8.86. The bid award was made subject to the appropriation of the funds.
