Farrand, President, with Mr. Farrand, Mr. Brunner and Mr. Mullen present. Deputy City Attorney Georgia Luks was also present. MINUTES OF PREVIOUS MEETING APPROVED Mr. Farrand reported that the minutes of the meeting of December 13 had been reviewed and he made a motion that they be approved as submitted. Mr. Brunner seconded the motion and it carried. Minutes of a special meeting of the Board of Public Works held on December 13 were also reviewed. This meeting was to reject all bids received for fire hose and readvertise for bids in accordance with specification changes. Upon motion made by Mr. Farrand, seconded and carried the minutes of the special meeting were approved. BID OPENING - POLICE DEPARTMENT UNIFOMIS This was the date set for receiving bids for uniforns for the Police Department for 1976. The Clergy: tendered proofs of publica- tion of notice in the South Bend Tribune and the Tri-County News. which were found to be sufficient. Deputy City Attorney Georgia Luks reported to the Board that the amount was not filled out on the bid bond and recoLuiended to the Board that the bid not be read. The Board concurred with the reconnendation of Mrs. Luks and found the bids of Court Brothers and State Equipment Company, Inc. to be defective and rejected --these bids. Upon motion made by tor. Farrand, seconded and carried, the bids, with the exception of the two rejected, were referred to the Bureau of Streets for review and recommendation. JEFF SPICED. RE: FIRE- DEPARTHEINT VEHICLE BID REJECTION Jeff Spicer, Freeman -Spicer, Inc., was present and asked to speak to the Board. On December 13 the Board rejected all bids submitted for six vehicles for the Fire Department. Freeman - Spicer was the apparent low bidder. Mr. Spicer stated that he received a letter from the Board informing him of that and he would like to express his dissatisfaction concerning the bid rejection. He feels the Board has treated Freeman -Spicer unfairly and unjustly and that the Board did not show an;T reasonable reason why the bids were rejected and why the specifications were revised. He said the Board has put them at a disadvantage should they bid again on these vehicles. Mr. Spicer expressed concern that some third party who did not bid may have approached the Board after bids were opened and influenced the Board. Fie feels that Freeman -Spicer is entitled to the bid since they bid in good faith and were the low bidder. Mr. Farrand noted that to his knowledge no one was contacted by a third party. Mr. Brunner said the Board has the ability to accept or reject bids after opening, fie said after the bids were opened an inadequacy in the bids was noticed. Mr. Brunner also wanted to emphasize that no third party approached the Board. The Board was concerned because they did not receive bids from all eligible manufacturers of this egiuipnent°ard that the bids may have been unduly restrictive. Mr. Farrand said the Board will go ahead with the readvertising bids for the six Fire Department vehicles. BIDS ADVERTISED - FUEL REQUIREMENTS FOR 1917 The Department of Public Works, in cooperation with the Controller's office, has prepared specifications for petroleumi supplies for the City during the calendar year 1977. Information now available indicates that controls have been lifted to the extend that suppliers can bid on this material. Mr. Farrand recommended that the Board advertise for petroleum products' for use throughout the City. Upon motion made by Mr. Farrand, seconded by Mr. Brunner and carried, the Board approved the advertising of petroleum bids for the calendar year 1977, with bids to be received on January 10, 1977. BIDS ADVERTISED - JANITORIAL SERVICES FOR 11. S. F. The Board received a request from Joseph Paszli, Manager of the Municipal Services Facility, to advertise for bids for Janitorial Services for the Municipal Services Facility for the period of February 1, 1977 through Januar_;r 31, 1973. Upon motion made by Mr. Farrand, seconded by Mr. Mullen°and carried, the Board approved the advertising of bids for janitorial services, with bids to be received on January 10, 1977. 1 71 P.EGULAR 11EETING DECEMBER 20, 1976 VALLEY CABLEVIS IO14 REPOP4T,; The Board received the following letter from Mr. Farrand: "By letter dated December 3, 1976, Valley Cablevision reported to this Board on their investigation into ten complaints regard- ing antenna signal reception duality where interference fropa Cablevision facilities was alleged. At the direction of the Board, the Clerk of the Board of Public Works directed letters to each of the ten residents in an attempt to verify the current quality of their signal reception Results are as follows: 1) 117 North St. Louis Street a. Valley Cablevison reported no interference b. No reply from resident 2) 745 N. Cushing Street a.. Valley Cablevision reported signal interference was found and eliminated. b. Resfdent reported by phone on Dece-ber 10, 1976 that' interference still e-,,-ists . 3) 3010 Green Street a. Valley Cablevision reported no interference and stated that dissatisfaction was with UHF signal ,•7hich is not affected by Cablevision VHF facility. b. No reply from resident 4) 1009 11. Roosevelt a. Valley Cablevision signal interference was found and eliminated. b. No reply from resident. 5) 1710 Sunnymede Avenue a. Valley Cablevision reported no interference and that resident was. satisfied. b. Resident reported by phone on December 10, 1976 that there:is still interference and that no one from Valley Cablevision had contacted her. c. The "trouble form" signed b-xT the resident is dated 07/29/76. 6) 1622 East Fox Street a. Valley Cablevision reported interference found and eliminated. b. Resident reported by phone on December 9, 1976 that Valley Cablevision had contacted hir_z four or five times and that he was satisfied. 7) 337 S. 26th Street a. Valley Cablevision reported that they are still working to eliminate problems in this area. b. No reply from resident. 8) 1535 Rockne Drive a. Valley Cablevision reported that they are still `corking to eliminate problems in this.area. b. Resident reports that Valley Cablevision has called three times and that interference still occurs. �8 REGULAR MEETING DECEMBER 20, 1976 9) 16823 Edinburg Lane (Not,in City Franchise area) a. Valley Cablevision reported that their are still working to eliminate problems in this area. b. No reply from resident. 10) 754 32nd Street a. Halley Cablevision reported interference found and eliminated. bi No reply from resident In addition to the above complaints of signal interference identified by Mr. Tim Zeak, the Clerk of the. Board has received complaints directly from two residents on Catherwood Drive. By letter dated December 10, 1976, Valley Cablevision was notified of these complaints. To.date, no reply has been received. This summary is being furnished to assist you in your delib- erations regarding the problems of television signal interference. cc: Mr. Harry White, Valley Cablevision, Inc. " Upon motion made, seconded and carried, the letter was ordered filed. The following letter was received from Tim Zeak: "after confering late last week with Valley Cable's Chief of Engineer, I begun drafting a letter to the Board stating that because I had reason to believe an honest effort and change of attitude from Valley's reps has become visible, I felt that between them and me, we could probably be able to reach a satisfactory conclusion to this problem without the aid of third parties. Since then however, I have received new informat-ion which convinces me that we are actually no further along in solving this problem then we were when I first appeared before the Board of Public Works in early October. My customers on Rockne St., 26th St., and Edinburg, all have informed me that Valley Cable has been out to their homes between 6 and 7 times with no correction as of yet. One woman stated that they have sent 7 different men out to watch her set and although they admit their have radiation there, a problem continues to persist. This woman is so upset that she wants to forget the whole matter. The job on Sunnymeade, which Cable denied finding radiation to the Board 2 weeks ago and which was stated that their had a signed statement by the party there was extremely misleading. It turns out that Cable never even contacted them, but dug out a report 6 months old concerning a radiation leak that they found back in: July. It can be reported that although Cable denied to the Board that they could find no trace of radiation on the St. Louis site, that for some reason they revisited the site and have corrected a major leak. This leak was present for well over a year. Please note that for the exception of Green St. which still is being effected by a leak, that every single site which Valley Cable either denied a problem exists or refused to say what they have found, are sites that they either have never visited or else since admited problems do indeed exist. Of the original 9 addresses I submitted, 7 remain not corrected, although several of these have been somewhat improved. In that I still have a large number of leaks all over the City effecting other of my jobs, and with Cable's policy of harrassing my costomers with needless and numerous trips to their homes and where Cable's reps including their chief of engineers, Mr. REGULAR 14EETING DECEMBER 20, 1976 Crone from the City's legal;; pepartrient, the Board of Public Works and Antenna installers. I feel that it is absolutely impossible for the Board to properly ascertain the facts until a face to face meeting takes place. Only until the Board hears both sides with all parties free to ask questions and seek certain°explanations will we ever be able to make any progress. I am tired of "cruisading" against these violations. All I want is to be able to install my antennas without illegal interference from Cable. I trust that a meeting can be arranged in the near future. If the Board has any doubt that these leaks are not°above the 20 microvolt per meter at 10 feet as the FCC's limit, I see no value at all in further delaying a request to the FCC for an investigation. In his absence, I an acknowledging your letter of Decenber 10, 1976, regarding cable television signal leaks affecting: 1235 Catherwood Dr., Mr. Michael Tomolak 1233 Catherwood Dr., Mr. William Hazelton Each address has been referred to our service department for investigation and any necessary correction, I will forward a report of our findings at the above addresses by your Decenber 27, 1976 Board neeting. Thank you for calling this to our attention. Sincerely, VALLEY CABLEVISION CORPORATION s/ Gregory J. Giczi. December 20, 1976 At this time, Valley Cablevision Corporation would like to present additional information asa follow-up of our letter of December 3, 1976, and your letter of November 17., 1976: 117 Id. St. Louis St. Rechecked area using specialized signal -leakage detection equip- nent. A low level of leakage was detected and traced to a location in an alley, 1 block east of the residence. Such leakage was eliminated by the replacement of broken shields on 4 service -drop cables, replacing 4 "F" fittings on. 4 additional service -drop cables, and the tightening of loose screws on a tap faceplate. The resident's antenna was rotated 3600, and no evidence of cable TV leakage was found. 1535 Rockne Dr. A 4 to 5 block area around this address was inspected.. A severe signal -leakage problem was found west of this address. Such problem was caused by sor_ze person illegally attaching to Valley Cablevision facilities. In addition, minor leakage problems were cleared with the replacement of broken or loose shields on 3 service -drop cables, 4 locking terminator devices were tightened, and the interior wiring of 3 cable television customer homes was repaired. No cable TV related signal interference could be detected at the resident's television set. W. REGULAR 11EET IN G' DECEMBER 20, 1976 16323 Edinburg Lane Signal ea.age was found, Most of this leakage was attributed to tree libb damage to a section of cable. This damage was repaired by inserting a splice in the damaged cable.. In addition, 10 defective connectors, 4 loose connectors, and 2 bad splices were found to be causing small leaks. All these were repaired. Additionally, a reported CATV interference call was investigated on Oakmont St. The service technician assigned to this °call reported that he could not =detect any evidence of signal leakage up to the -BOdb signal level measurement, which is the limit of his test instrument. Our efforts will continue to investigate and correct any such signal - leakage problems, as they are reported. Sincerely, VALLEY CABLEVISIO14 CORPORATION s/ Gregory J. Giczi Mr. Farrand made a motion that the Board initiate contact with the Federal Corr_iunications Commission asking for their assistance and advise concerning the leakage. Mr. Mullen seconded the notion and it carried. Mr. Brunner abstained. MORP.IS CIVIC AUDITORIUM PATE INCREASE APPROVED The Board received a request from Floyd 11. Jessup of the Morris Civic Auditoriuri to consider'increasing the rental rates of the 1.1orris Civic Auditorium.to help compensate for the inflationary increase in costs of operation over recent years. It was noted that the same rental set-up established in 1960 is still being used. Mr. Jessup recommended that a $100.00 across the board increase be put in effect the first of the year, excluding leases already signed. Upon notion made by Mr. Farrand, seconded by TZr: Mullen and carried, the Board approved the $100.00 across the board increase for rental rates at the Morris Civic Auditorium. ALCOHOLISM COUNCIL AGREEMENT APPROVED The Board approved an Agreement between the City of South Bend and the Alcoholism Council, Inc. of St. Joseph County for°counseling services to City employees with alcohol problems. The Board took note of the fact that the contract provided for training of City personnel in recognizing and dealing with alcoholism problems. The City will pay the Alcoholism Council $500.00 for the period of December 15,,1976 through December 14, 1977. Upon notion made by Mr. Farrand, seconded by Mr. 11u.11en and carried, the Board approved the Agreement with the Alcoholism Council. HUD P.EQUIREHL?NTS FOR BID ADVERTISEMENTS Mr. Farrand advised the Board that Mr. Frank Alford had forwarded to the Board contract bid requirements as received from. the Federal Department of Housing and Urban Development (HUD). It was explained that, while such Federal requirements as those for Equal Employment Opportunity were included in all City contracts, State wage rate requirements were used rather than Federal wage rates in projects not involving Federal funds. Mr. Farrand noted that this requirement appeared to be an attempt to mandate HUD requirements for both federally funded and non -federally funded contracts. STREET LIGHT REQUEST - 1616 PROVINCIAL DRIVE. The Board received a request from Councilman Rober Taylor, who was contacted by Anthony Luber, for a street light at 1616 Provincial Drive. Upon motion made by Mr. Farrand, seconded by Mr. Mullen and carried, this request was referred to the Bureau of 'Traffic and Lighting for a field investigation and possible inclusion on the.chronological list of new installations being compiled. The Bureau of Traffic and Lighting was instructed to notify the Board of the results of the field investigation. SUB -STANDARD BUILDING DEPARTIMIT REPORT OF VEHICLE PURCHASE Raymond Newton, Director of the Bureau of Sub -standard Buildings, sent a letter to the Board inf_orraing them his Bureau has purchased a used 1976 Chevrolet Chevette from Gates Chevrolet. There was �2,350.00 in the Bureau's Motor Vehicle Account. They contacted established car dealers in the area and test drove eleven cars. Jim Meehan checked out this car and gave a favorable report.on its condition. Upon notion made by Mr. Farrand, seconded by Mr. PZullen and carried, the Board concurred in the car purchase and the report was ordered filed. White°be approved to December 1, 1977. Upon motion made by Mr. Farrand, seconded by Mr. Mullen and carried, the bond was approved, STREET LIGHT OUTAGE REPORT°FILED The Street Light Outage report for the period of, December 13 through December 15 was received. The report indicated 40 outages. Upon motion riiade by Mr. Farrand, seconded by Mr. Mullen and carried, the report was ordered filed. CLAIMS APPROVED Walter F. Lantz, Chief Deputy City Controller, and Michael L. Vance, City Auditor, submitted to the Board Claim Docket numbers. 18410 through 13605 and their recommendation that the claims be approved. Upon motion made by Mr. Farrand, seconded by Mr. Mullen and carried, the claims were approved and checks for payment were ordered issued. CHANGE ORDERS - ISLA14D PARK AITD WHITE WATER WAY A change order to the Island Park Development contract, the Hickey Company, Inc., contractor, was submitted to the Board. The change order increases the contract by 1,034.00. Upon notion nade by Mr. Farrand, seconded by Mr.•IZullen and carried, the change order was approved. A change order in the -White Water Way contract awarded to The Hickey Company was submitted to the Board. The change order increases the contract by $16,990. This change order was for work covered in the contract specifications but which would not. be defined until an investigation performed as part of the contract was completed. An amount of $20,000 was included in the project budget for this word:. Upon notion made by Mr. Farrand,. seconded by Mr. Mullen and°carried, the Board approved the change order. SOLID WASTE HOLIDAY SCHEDULE The Board received a report from Joe Kuninecz, Manager of the Bureau of Solid Waste, that his Bureau will be working its regular schedule on Friday, December 24, 1976. This schedule will also apply to New Years Day, Monday, January 3, 1977. All routes will be picked as usual. Upon motion made, seconded and carried, the Board filed the report, BID ADVERTISED - BUREAU OF ENGINEERING CAP. Mr. Farrand riade a notion to advertise for bids for a car included in the 1977 Engineer's budget, with bids to be received on January 4, 1977. The motion was seconded and carried. IMPROVEIENT RESOLTUI014 NO. 3437 ADOPTED AND TITLE SHEET SIGITED The title sheet approving the plans for the Crestwood and Edison intersection street improvements was submitted to`the Board. The notion was seconded and carried. 1 0 M REGULAR MEETING DECEMBER 20, 1976 Upon motion made by Mr. Farrand; seconded and carried, the Board adopted the following resolution: IMPP.OVEMENT RESOLUTION 140. 3437 , 1976 I-MEREA S, the Board of Public Works, has found it necessary in the best interest of the public safety and welfare to construct certain street improvements at Crestwood and Edison Intersection, and` 1711ERE,AS, the improvements to the aforesaid street are compatible with the Urban Area Transportation Study, and WHEREAS, the costs for these certain improvements are to be pro -rated at 10% to the Cumulative. N SPECIAL MEETING DECEMBER 20, 1976 A special meeting .of the, -Board of Public Works was convened by President Rollin E. Farrand at 11:45 a.m. on Monday, Decenber 20, 1976 with Mr.. Farrand, Mr. Brunner and Mr. Mullen present. Also in attendance was Deputy City Attorney Georgia Luks. Mr. Farrand reported that the purpose of the special meeting was to open a bid which was received for Police Department uniforms from Zuckerbergs Uniforms, Inc. after_ the meeting adjourned. The bid was postrlarked Decerlber 18 and was in the building before 9:30 a.m., meeting Notice to Bidders requirerzents, but did not get to the Board office in time. Deputy City Attorney Georgia Luks determined that since the bid was in the building in tirle, it could be opened. Mrs. Luks reviewed the bid and inforrled the Board thtere was no bid bond or certified check submitted with the bid and recommended it not be read. The Board accepted Mrs. Luks' recori�r_iendation and found the bid defective, did not read the bid, and directed that it be returned to the bidder.
