The Board of Public Works, at its meeting held on November 8, 2016, approved your request
for the installation of an historical marker marking the birthplace of poet Kenneth Rexroth in
the tree lawn at 828 Park Avenue subject to you working with the Historic Preservation
Society on a smaller design and the installation of the sign be parallel with the street and
sidewalk and centered in the tree lawn. The Building Department requires the sign not exceed
four (4') feet in height above grade and must stay ten (10') feet away from any driveway
unless the sign is three (3') feet or less above grade per S172 Zoning. Enclosed please find a
copy of the permit.
The encroachment will be permitted to remain and continue until such time as the Board of
Public Works of the City of South Bend shall determine that such encroachment is in any way
impairing or interfering with the highway or with the free and safe flow of traffic thereon.
Said encroachment shall not in any way prejudice or preclude the City's rights with respect
to the future use of that portion of the right-of-way.

Herein, "APPLICANT".
The encroachment will be permitted to remain and continue under the following terms and conditions:
1) Until such time as the BOARD OF PUBLIC WORKS (BOARD) of the CITY OF SOUTH BEND (CITY) shall
determine that such encroachment is in any way impairing or interfering with the highway or with the free and safe flow
of traffic thereon;
2) Said encroachment shall not in any way prejudice or preclude the CITY'S rights with respect to the future use of the
portion of the right-of-way;
3) The encroachment as it now exists shall in no manner be added to or enlarged in its present scope or dimensions;
4) In the event of change of ownership of the fixture or any other item of personal property which constitutes the aforesaid
encroachment, this permit shall become null and void;
5) The CITY shall not be liable to APPLICANT for any damages caused to APPLICANT that arise out of or is incidental to
any activity and/or incidences authorized by this permit;
6) In consideration of the granting of this Permit by the BOARD, APPLICANT shall indemnify, hold harmless and defend
the CITY from and against any and all actions or causes of action which the CITY may suffer or incur by reason of
bodily injury, including death, to any person or persons, or by reason of damage to or destruction of any property,
including the loss thereof, arising out of or in any manner connected with any activity and/or incidences authorized by
this permit and/or any activities and/or incidences incidental thereto, or which the CITY may sustain or incur in
connection with any litigation, investigation, or other expenditures incidental thereto, including any suit instituted by the
CITY to enforce the obligation of this agreement of indemnity.
It is the intent of the parties hereto that the APPLICANT shall indemnify the CITY under this indemnification clause to
the fullest extent permitted by law, except that APPLICANT shall not indemnify CITY for any damage or expense
caused by the sole negligence of the CITY.
This approval shall be binding upon everyone past or present, claiming any interest in and to the aforementioned encroachment.

Kenneth Rexroth
1905-1982, South Bend, IN
On December 22, 1905, Kenneth Charles Marion Rexroth was
born in South Bend, Indiana. Orphaned at fourteen, Rexroth
moved to live with his aunt in Chicago, where he was expelled
from high school. He began publishing in magazines at the age of
fifteen. As a youth, he supported himself with odd jobs —as a
sodajerk, clerk, wrestler, and reporter. He hitchhiked around
the country, visited Europe, and backpacked in the wilderness,
reading and frequenting literary salons and lecture halls, and
teaching himself several languages.
Rexroth and his first wife, the painter Andree Shafer, moved to
San Francisco in 1927. There he published his first poems in a
variety of small magazines, while also pursuing an interest in
eastern mysticism and leftist politics. He kept company with
like-minded left-wing poets such as Grnrve Omen
(/oortcor net/georgedoner) and I nuic 7ukovakv
(/noetcnr�poet/In fa-� knfskvl, and with them aimed to rescue
poetry from its supposed downslide into formalist
sentimentality. They organized clubs to support struggling
writers and artists.
By the early 1930s, through a correspondence with Ezra Pound
(/oor.t.gnrg/poet/e7ra-po ind), Rexroth was introduced to James
Laughlin of New Directions press, who included Rexroth's poems
of in the second volume of Laughlin's pivotal annual, New
Directions in Poetry and Prose in 1937. Rexroth's first collection,
/n What Hour, which articulated the poet's ecological
sensitivities along with his political convictions, was published by
Macmillan in 1940. In 1944 another collection, The Phoenix and
the Tortoise, continued his exploration of the natural and the
erotic, presented his pacifist stance on World War II,
incorporated references to the work of classical poets from the
East and the West, and expanded his tonal range with poems
touching on world religions and the history of philosophy. A
consummate activist, during the war Rexroth aided Japanese -
Americans in escaping West Coast internment camps.
