REGULAR MEETING
MARCH 22, 1982
The regular meeting of the Board of Public Works was convened at
9:30 a.m., on Monday, March 22, 1982, by President John E.
Leszczynski, with Mr. Leszczynski and Mr. Joseph E. Kernan
present. Also present was Assistant City Attorney Carolyn
Pfotenhauer.
MINUTES OF PREVIOUS MEETING APPROVED
Upon a motion made by Mr. Kernan, seconded by Mr. Leszczynski and
carried, the minutes of the March 15, 1982, regular meeting of
the Board -were approved as submitted.
AGENDA ITEMS ADDED
Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and
carried, the following items were added to the agenda following
the handicapped parking permits:
1. List of lots cleaned by the environmental crews
as ordered by the Director of the Neighborhood
Code Enforcement Office.
(� 2. Emergency powers used by Board of Works for
flood damage repairs.
Q OPENING OF BIDS —MAINTENANCE GRADER AND CAB & CHASSIS (STREET DEPT.
This was the date set for receiving and opening sealed bids for a
maintenance grader, three tandem axle cabs and chassis, and two
or more single axle cabs and chassis for the Street Department.
The Clerk tendered proofs of publication of notice in the South
Bend Tribune and the Tri-County News which were found to be
sufficient. The following bids were opened and publicly read:

Mrs. Pfotenhauer explained that the bid bond of Tractor and Equip-
ment Company was not secured by an Indiana surety. Upon a motion
made by Mr. Leszczynski, seconded by Mr. Kernan and carried,
Tractor and Equipment Company was allowed a 48-hour period in
which to submit the proper bid security in order for the Board
to consider the bid.

Mrs. Pfotenhauer stated that the secretary of the corporation had
signed the official bid form. She asked for verification that the
secretary was authorized to. execute bid documents on behalf of
the corporation. There was no one in attendance from Roseman
Tractor Equipment Company. Upon a motion made by Mr. Kernan,
seconded by Mr. Leszczynski and carried, consideration of the
above bid was withheld pending confirmation that the secretary
of the corporation was authorized to execute the bid document.

Mrs. Pfotenhauer advised that, although'. the non -collusion
affidavit was properly signed by David T. Maloney, the bid itself
contained only the typewritten name of Mr. Maloney. She suggested
that the Board allow a 48-hour period for Mr. Maloney to properly
execute the bid document. Upon a motion made by Mr. Kernan,
seconded by Mr. Leszczynski and carried, Tom Wood Pontiac was
given a 48-hour period in which to have the bid document
properly executed in order for the Board to consider the bid.
Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and
carried, the above bids were referred to the Park Department for
review and recommendation.
OPENING OF BIDS - SALE OF CITY -OWNED PROPERTY
(1115 S. LAFAYETTE AND 263 MAPLE STREET)
This was the date set for receiving sealed bids for the sale of
city -owned property located at 1115 S. Lafayette and 263 Maple
Street. The Clerk tendered proofs of publication of notice in
the South Bend Tribune and the Tri-County News which were found
to be sufficient.

Mr. Leszczynski noted that the city's offering price was $270.00 and
that Mrs. Lewis was an adjacent property owner. Upon a motion made
by Mr. Kernan, seconded by Mr. Leszczynski and carried, the bid of
Mrs. Lewis in the amount of $270.00 was accepted, and the matter
referred to the Legal Department for drafting of the appropriate
purchase agreement.
Mr. Leszczynski advised that no bids had been received for the
property at 263 Maple Street.
AWARD OF BIDS - COMPUTER SERVICES
Mr. Kernan stated that the city had been studying and reviewing its
present computer services for two years and it had been determined
the city should advertise for sealed bids for such computer services
which involved the general and financial accounting, police computer
services and utility billing. He explained that, in November, 1981,
computer specifications were compiled with the assistance of Crowe
Chizek & Company and bids were actively sought for a bid opening
on January 4, 1982. Following the bid opening of that date, the
police computer bids were referred to Dr. Richard Metzcus, a
professor at Indiana University at South Bend, and the utility
billing and general and financial accounting bids referred to
Crowe Chizek & Company for review and recommendation. Mr. Kernan
advised that Dr. Metzcus subsequently recommended the bid of
Simcon, Inc., 7655 Old Springhouse Road, McLean, Virginia, be
awarded for the police computer services. Crowe Chizek & Company
recommended the award of the general and financial accounting
services to South Bend Community School Corporation and the
utility billing computer services to Network Computing Corporation,
5301 77 Center, Charlotte, North Carolina.
Upon a motion made by Mr. Kernan, seconded by Mr. Leszczynski and
carried, the above bids as recommended were awarded. Mr. Kernan
then advised that the city would proceed immediately to enter into
discussions with the successful bidders in order to arrive at
contracts for said services which are agreeable to the city and
the respective bidders. Mr. Stephen Van Ooteghem, representing
On -Line Data, Inc., a Mishawaka firm which had bid on the utility
package, asked why the Board had accepted the bid of out-of-state
companies on two of the awards when the economy was so bad and
local firms were experiencing cutbacks, layoffs and even closure.
Mr. Kernan explained to Mr. Van Ooteghem that the city is required
by statute to follow public bidding procedure which includes the
award of any bid to the lowest and best bidder. Mr. Kernan
addressed the utility billing package, stating that the lowest
and best bid was awarded based on the formula method used by
Crowe Chizek & Company. He stated that, in any case where all
other things are equal, the local bidder is given first considera-
tion. He stressed that the Board would like to award its bids to
local firms, but is bound by law to award to the lowest and best
bid. Mr. Van Ooteghem asked if Crowe Chizek would be assisting in
the set-up of the services and the training of the necessary
personnel, and Mr. Kernan advised that they would be. Mr. Van
Ooteghem asked about the possibility of word processing equipment
for city offices and the expenditure of $75,000.00 to accomplish
that purpose. Mr. Kernan stated that the Mayor had indicated at
an informal meeting with the Council that he would like to set
aside that sum of money for such services for other city depart-
ments and would include some hardware and software purchases if
necessary.
APPROVE ADDENDUM TO RELEASE AND SETTLEMENT AGREEMENT
(MURPHY/JAHN - CONCRETE COLUMN DAMAGE AT FIRST BANK CENTER)
Mr. Leszczynski explained that the Board had, on October 5, 1981,
entered into a Release and Settlement Agreement with Murphyy/jahn
Architects as a result of columnar damage at the First Bank Center.
The agreement provided for the repair of the concrete column at a
cost of approximately $80,000.00, $50,000.00 of which would be

paid by Murphy/Jahn and $30,000.00 to be paid by Shand, Morahan
& Company on behalf of the Potomac Insurance Company. Mr.
Leszczynski advised that the addendum was necessary because
the actual amount of the remedial work exceeded the $80,000.00
figure by $13,181.72. The addendum acknowledged receipt of
the additional amount from Shand, Morahan & Company, said amounts
to be paid to the general contractor, Brown & Brown, for the
remedial work. Mr. Kernan stated that, on the basis of the work
completed and the agreement on a final settlement of costs,
Murphy/Jahn was being released from any further claims, damages
and costs arising out of the cracked column and related
structural failure in the parking facility. Upon a motion
made by Mr. Leszczynski, seconded by Mr. Kernan and carried,
the addendum was approved.
APPROVE STREET LIGHTING CONTRACTS WITH INDIANA & MICHIGAN ELECTRIC
Mr. Leszczynski submitted three contracts between the city and
I & M Electric for street lighting throughout the city. He
explained that the city's present contracts with I & M would
be updated by the execution of the new contracts in accordance
with the rate increase approved by the Public Service Commission
in 1981, to be effective on April 1, 1982. lie advised that the
city had anticipated the rate increases in the current budget.
Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan
and carried, the contracts were approved.
APPROVE COMMUNITY GARDENS PROJECT FOR 1982
Mr. Leszczynski stated that requests had again been received by
the Board for permission to garden on city -owned lots. He
explained that the program has been in effect for the past few
years and interested citizens are asked to sign a release form
which sets forth certain rules and regulations pertaining to
the use of the property. Upon a motion made by Mr. Kernan,
seconded by Mr. Leszczynski and carried, the project was approved.
REQUEST OF MICHIANA WATERSHED FOR ANNUAL ST. JOSEPH RIVER RUN
A request was received from Richard D. Carey, President of the
Michiana Watershed, for permission to again hold the annual St.
Joseph River Run on Saturday, May 15, 1982, beginning at Leeper
and Veterans Memorial Parks between 11:00 a.m, and 1:00 p.m.
Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan
and carried, the request was referred to the Bureau of Traffic
and Lighting and the Police Traffic Division for review and
recommendation.
REQUEST TO CONDUCT MICHIANA BLOOD DONORS RUN -
SOUTH BEND MEDICAL FOUNDATION
A request to conduct.a marathon or run on Sunday, May 23, 1982,
commencing at 9:00 a.m, from Leeper Park running northwest along
Riverside Drive to Pinhook Park and back was received from the
South Bend Medical Foundation. Upon a motion made by Mr.
Leszczynski, seconded by Mr. Kernan and carried, the request
was referred to the Bureau of Traffic and Lighting and the
Police Traffic Division for review and recommendation.
REQUEST TO CONDUCT JULY 4TH RACE - PAUL BOEHM MINI -MARATHON
The South Bend Public Recreation Department submitted a request
for permission to conduct a Fourth of July mini -marathon utilizing
Howard Park and Northside Boulevard and a diversion to the old
railroad foot bridge to the west side of the river and the side-
walk on Jefferson Street back to Howard Park. It was noted that
the race, commonly called the Paul Boehm Mini -Marathon, had been
held in the past in June in the Rum Village neighborhood. Upon
a motion made by Mr. Leszczynski, seconded by Mr. Kernan and
carried, the request was referred to the Bureau of Traffic and
Lighting and the Police Traffic Division for review and recommendation.

REQUEST OF BROADWAY CHRISTIAN PARISH FOR ROAD RUN
A similar request from the Broadway Christian Parish for permission
to conduct a third annual Human Race in conjunction with the YWCA
to be held on Saturday, October 23, 1982, starting at the parish
and utilizing Broadway Street to Franklin, Franklin to Ewing, Ewing
to Gertrude and other surrounding streets in the Rum Village area
with the race finishing in.Rum Village Park, was received. Upon
a motion made by Mr. Leszczynski, seconded by Mr. Kernan and
carried, the request was referred to the Bureau of Traffic and
Lighting and the Police Traffic Division for review and recom-
mendation.
APPROVE LICENSE APPLICATIONS
Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and

approved.
FILING OF CERTIFICATE OF INSURANCE
Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and
carried, the certificate of insurance for St. Joseph Valley
Structural Steel Corporation for work performed on the First Bank
Center Project was accepted and filed.

ENVIRONMENTAL CLEAN-UP OF LOTS
In accordance with the March 15, 1982, authorization of the Board,
the Director of the Neighborhood Code Enforcement Office submitted
a list of 11 lots which had been cleaned by the environmental
crews, in addition to the pick-up of 25 Christmas trees and the
cleaning of bridges in the city. It was noted that property
owners had been advised to clean up the lots and had failed to
do so. The Director of the Neighborhood Code Enforcement had,
therefore, ordered cleaning of the lots by the city's environmental
crews. Upon a motion made by Mr. Leszczynski, seconded by Mr.
Kernan and carried, the list was filed.
AUTHORIZE EMERGENCY POWERS FOR FLOOD CAVE-IN REPAIRS
Mr. Leszczynski requested permission from the Board to waive the
public bidding process for the repair of several street cave-ins
which have occurred recently because of the river flooding,
specifically in the areas of Fox and St. Joseph Streets; Carroll
at Bowman Creek; and Miami and Chippewa Streets. He asked that
any cave-ins which occur as a result of the flooding in any part
of the city be handled in this manner. State Statutes provide
that, in the case of an emergency, the Board may contract for a
public works project without advertising for bids so long as at
least two quotes for the work are obtained. Upon a motion made
by Mr. Kernan, seconded by Mr. Leszczynski and carried, the
street cave-ins were determined to be emergency situations and
the requirements for public bidding were waived. It was noted
that Ziolkowski Construction, Rieth-Riley and McIntyre & Jones
would be contacted to submit a quote for the repair work.
FILING OF STREET LIGHT OUTAGE REPORT
The report indicated a total of five outages for the period of
March 10 through March 13, 1982. Upon a motion made by Mr.
Leszczynski, seconded by Mr. Kernan and carried, the report
was filed.
APPROVAL OF CLAIMS
Mr. Elroy J. Kelzenberg, Director of the Michiana CETA Consortium,
submitted P. 0. No. 657 through No. 673 and recommended approval.
Chief Deputy Controller Sherrie L. Petz submitted Claim Docket
No. 4832 through No. 5405 and recommended approval. Upon a
motion made by Mr. Kernan, seconded by Mr. Leszczynski and
carried, the reports were filed and the claims approved.
There being no further business to come before the Board, upon a
motion made by Mr. Kernan, seconded by Mr. Leszczynski and carried,
the meeting was adjourned at 10:30 a.m.
