Leszczynski, with Mr..Leszczynski and Mr. Joseph E. Kernan present. Also present was'Assistant City Attorney Carolyn Pfotenhauer. MINUTES OF PREVIOUS MEETING APPROVED Upon a motion made by Mr. Kernan, seconded by Mr. Leszczynski and carried, the minutes of the special meeting of the Board held on October 22, 1982 were approved as submitted. Since Mr. Kernan was absent from the regular Board meeting of October 18, 1982, and Mr. Hill was not present at this time to approve the minutes, no action was taken. The minutes of the October 18, 1982, regular Board meeting will be submitted for Board approval at the next meeting when ITr. Hill is present. OPENING OF BIDS - ELECTRICAL REPAIRS (JEFFERSON ST. PARKING GARAGE) This was the date wet for receiving sealed bids for the electrical repair work on the Jefferson Street Parking Garage. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri-County News which were found to be sufficient. REGULAR MEETING OCTOBER 25, 1982 13 1 0 1 OPENING OF BIDS - CONCRETE REPAIRS (JEFFERSON ST. PARKING GARAGE) This was the date set for receiving sealed bids for the concrete repair and restoration of the Jefferson Street Parking Garage. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri=County News which were found to be sufficient. The following bids were opened and publicly read: William H. Mrs. Pfotenhauer advised that the 5% bid bond submitted by the William H. Kelly Company was drawn on an out-of-state surety. She stated that an out-of-state bidder must submit a certified check or a bid bond drawn on an Indiana surety according to state statutes. Mr. Kernan stated that the Board's policy in the past has been to allow the bidder a 48-hour period to submit the proper security if the correct amount of security was submitted but the bond was drawn on an out-of-state surety. Upon a motion made by Mr. Kernan, seconded'by Mr. Leszczynski and carried, a 48-hour period was given to allow William H. Kelly Co. to submit the proper bid. security if it wished the city to consider its bid. Slatile Roofing & Sheet Metal Bid was signed by Gerald E. 1703 S. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the above bids were referred to the Engineering Department for review and recommendation. Prior to adjournment of the meeting, a bid was received from TSA Construction Services, 43 East Water Street, St. Paul, Minnesota 55107, said bid being received in at 10:30 a.m. Upon a motion made by Mr. Leszczynski, seconded by.Mr. Kernan and carried, the bid was rejected because it was received an hour past the legally -advertised bid deadline of 9:30 a.m. LWJ REGULAR FETING OCTOBER 25, 1982 OPENING OF BIDS - DIESEL REFUELING STATIONS ('14UNICIPAL SERVICES FACILITY) This was the date set for receiving sealed bids for the relocation and installation of two diesel refueling stations at the Municipal Services Facility and related work. The Clerk tendered proofsof publication of notice in the South Bend Tribune and the Tri- County News which were found to be sufficient. Upon a motion made by Mr. Kernan, seconded by Mr. Leszczynski and carried, the bid of Clifford Hamilton, Inc. 60689 U.S. 31 South, South Bend, Indiana, was rejected because it was received at 9:35 a.m., five minutes after the legally -advertised bid deadline of 9:30 a.m. Mr. Robert Lovett from Coffield Supply Company in South Bend, objected to the specifications as written which called for a used 10,000 gallon underground tank. Ile felt there was a severe problem with underground leakage and, if that situation should occur, the savings realized by the city in attempting to obtain a used tank would be of no avail and the city would be spending more money to rectify the problem. Also, he felt the city would not be able to determine the size of the tank it received. He asked that the specifications be revised and new bids sought. r1r. Leszczynski advised Mr. Lovett that he was very comfortable with seeking bids for a used tank. Ile stated that the city would have no guarantee that a new tank would not leak, and the city was very interested in saving money on the cost of the refueling station since it was operating under budget restrains. Mr. Lovett felt that, if the city was interested in saving money, other changes could be made in the specifications. Prior to adjournment of the meeting, Mr. Lovett again raised his objection to the specifications. He felt there would be no way for the city to inspect and check out a used tank for defects. He referred to an incident when a used tank had been sandblasted and was found to be defective. Mr. Leszczynski assured Mr. Lovett that the bidder would be responsible for submitting defective materials and his bid bond would protect the city in that regard. Mr. Lovett also wondered about the requirements of the State Fire Marshall regarding the underground storage tanks. Mr. Leszczynski advised Mr. Lovett that the tanks would be inspected and the city still had the option to reject the bids if it was determined there could be a potential problem. Mr. Lovett stated that he would have preferred submitting a bid to the city on a used tank because his profit would be greater than on a new one; however, he disagreed with the use of a used tank for underground storage purposes. Mr. Leszczynski thanked Mr. Lovett for his comments and concerns and assured him that the city would take the necessary precautions. 1 1 15 REGULAR MEETING OCTOBER 25, 1982 Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the above bids were referred to the Division of Transportation and the Engineering Department for review and recommendation. OPENING OF BIDS - STREET DEPARTMENT TRUCES AND EQUIPMENT This was the date set for receiving sealed bids for the purchase of four single axle cab and chassis, five pickup trucks and one rubber tire loader. OPENING OF BIDS - PROFESSIONAL TESTING SERVICES - POLICE RECRUIT TEST This was the date set for receiving sealed bids for the professional testing services to be conducted in connection with the police recruit test. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri-County News which were found to be sufficient. Colfax Avenue by Paula N. Auburn. South Bend, Ind. 46601 Administering TABE test to police recruits $10.00 per test given Mrs. Pfotenhauer noted that the proposal of Consulting Resources was not provided on the required bid forms, nor was any bid security submitted. In the proposal submitted, Ms. Auburn indicated that the required Bid Form 96 and 96A applied to public construction projects and were not applicable to the professional testing services which were being bid. Upon a motion made by Mr. Kernan, seconded by Mr. Leszczynski and carried, the bid of Consulting Resources was rejected because it was not submitted on the proper bid form and no bid security was included. At the time bids were opened for the psychological testing of police officer candidates immediately following, concern was expressed over the confusion caused to bidders in using the required Form.96 and 96A and the submission of bid security. See that portion of the minutes for further discussion of this problem. Upon a notion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the bid of Norrell Services was referred to the Police Department for review and recommendation. OPENING OF BIDS - PSYCHOLOGICAL TESTING OF POLICE OFFICER CANDIDATES This was the date set for receiving sealed bids for the psychological testing of police officer candidates. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri- County News which were found to be sufficient. The following bids were opened and publicly read: Michael Niewiadomski, PhD. Bid was signed by Michael 418 S. Lombardy Dr. Niewiadomski, non -collusion South Bend, Ind. 46619 affidavit was in order and a check in the amount of $80.00 $640.00 was submitted. Mrs. Pfotenhauer advised that no certified check had been submitted as required under the bid specifications. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried,the above bid was rejected because the proper bid security was not submitted. Leonard E. James, PhD. Mrs. Pfotenhauer advised that no certified check had been sub- mitted as required under the bid specifications. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the above bid was rejected because the proper bid security was not submitted. Upon a motion made by Mr. Kernan, seconded by Mr. Leszczynski and carried, the bid of Leonard E. James was referred to the Police Department for review and recommendation. i 9 REGULAR MEETING OCTOBER 25, 1982 There was discussion on the apparent confusion caused to the bidders on the professional testing services for police recruits and the psychological testing of police officer candidates in utilizing the formalized bidding process. Mr. lernan suggested that the formal bidding process not be used for professional testing services and,psychological testing. He stated that he was concerned about the procedure to be used in submitting proposals for such services in view of the need to reject a number of bids because the proper bid form was not used or not filled in correctly, or the proper bid security as required not submitted. Mrs. Pfotenhauer stated that the procedure outlined in the statutes relative to the formalized bid process was followed even though Form 96 and 96A were not completely applicable to the services. Mrs. Pfotenhauer advised that, in using the formalized bidding procedure, no other forms were available as approved by the State Board of. Accounts for bids concerning professional services to be furnished. PUBLIC HEARING ON HOUSE MOVE (112 E. NAVARRE TO 322 W. MARION Mr. Leszczynski noted that Southhold Restoration, Inc., owner of a 28' by 45' flat -roofed structure at 112 East Navarre Street, was requesting permission to have Lykowski Construction Company move the building to 322 West Marion Street utilizing Navarre west to Lafayette; thence south on Lafayette to Marion and west on Marion to its destination. It was noted that the Building Department and the Bureau of Traffic and Lighting had no objections to the proposed house move. It was also noted that all adjacent property owners had been notified of the move. Mr. Charles H. Beutter, residing at 2324 Homewood Avenue, Mishawaka, and owner of property next to 322 West Marion Street, stated that he and his sister who resided at 318 W. Marion had no objection to the house being moved by Southhold but objected to the type and style of the flat - roofed structure in the neighborhood. He felt itwouldnot conform to the neighborhood and would reduce the current values of the properties in the immediate vicinity. Mr. John Oxian, President of Southhold Restoration, explained that the house was saved from demolition by his organization, and, with the assistance of $8,120.00 from the Housing Authority, and the further expenditure of approximately $50,000.00 of Southhold's funds, the house would be moved to a permanent location on the lot owned by Southhold at 322 W. Marion. He stated that he felt the house should remain in the neighborhood and, as an Italinate-style structure, was listed as a historically significant house in the records of the Historic Preservation Commission. He advised that the ground would be elevated so the one- story structure would be approximately the same height as the home on its left. lie stated that he felt the flat roof made the house unusual and rare. He advised that the houses west of 322 West Marion were one-story homes, and the houses east were two-story homes. He did not feel objection should be raised because the home was a one-story building when other one-story buildings were in the immediate vicinity. He advised that there were no set standards on how high houses should be and what type of roof is required. He explained that considerable amount of money would be spent on the restoration of the building which would include outside repairs, after which Southhold would attempt to sell the structure. He submitted a rendering of the home as it would look in its permanent location with the horses on either side of it. Residents in the immediate vicinity objected to the rendering, stating that it was not drawn accurately. One woman objected to the way the house looked on the outside and felt that taxpayers' money should not be used to renovate it. Mr. Oxian stated that the home would be restored to its original condition and shape using $50,000.00 of Southhold's private funds and $8,000.00 from the federal government. .�V REGULAR MEETING OCTOBER 25, 1982 Another neighbor talked about the slope and grade of the property next to 322 W. Marion Street. She stated that the structure to be moved to that location would be considerably lower in height because of a six-foot high embankment on.one side. She felt that, if the property was going to be built up, it would take considerable time and would not be an easy task. She wondered what would happen with run-off of storm water and melted snow onto the lower property on the other side. She also stated that Marion was a truck route and the city had plans to widen the street. 11r. Leszczynski assured the neighbors that there were no plans to widen Marion Street and advised them that any talk they had heard concerning widening was merely rumor. He stated that he felt some definite questions had arisen regarding the elevations of the property, and he felt a site visit by the Board members was in order prior to making a decision on the house move. Mr. Kernan felt there was also some questions as to the Board's authority on deciding whether or not a home would fit into an existing neighborhood. He stated that the Board may not have that discretion as long as the home complied with applicable building codes and was built according to required specifications. He agreed that some questions were raised which needed to be answered and he felt the Board should delay a decision until the problems and questions were cleared up. He felt that, if the Board was limited to technical compliance only, its options on addressing whether or not a home was the proper style for a particular neighborhood would be restricted. He asked that the Board attorney review the Board's responsibility in the matter. Mr. Beutter filed with the Board a petition containing 19 signatures of residents and property owners in the vicinity of 322 W. Marion who objected to the house relocation. Upon a motion made by Mr. Kernan, seconded by Mr. Leszczynski and carried, the public hearing on the house move was continued to the November 1, 1982, meeting of the Board in order to allow a site visit by Board members and a clarification from the Legal Department as to the Board's responsibility and obligation in the matter. APPROVE CERTIFICATE OF SUBSTANTIAL COMPLETION AND FILE WAIVER OF LIEN - INTERSTATE GLASS COMPANY (FIRST BANK CENTER) A Certificate of Substantial Completion was submitted by Interstate Glass Company for its work on the First Bank Center vertical atrium curtainwall in the total amount of $540,917.00. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the Certificate of Substantial Completion was approved and the Waiver of Lien filed. APPROVE CONTRACT - LINDSEY STREET IMPROVEMENTS (McINTYRE & JONES CONSTRUCTION) Mr. Leszczynski stated that a contract was -submitted for Board approval for the Lindsey Street Improvements Project with McIntyre u Jones Construction, the low bid which was received and awarded on October 18, 1982, in the amount of $97,496.90. It was noted that the required Performance Bond was submitted. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the contract was approved subject to the filing of the required Labor and Materials Payment Bond. The Performance Bond was filed. APPROVE COIIMU14ITY DEVELOPMENT CONTRACT ADDENDUM - PARK DEPARTME14T Ms. Betsy Harriman of the Community Development staff requested Board approval of Addendum No. II to a previously -approved contract between the Community Development Department and the Park Department for improvements at the Walker Field softball diamond. She advised that the addendum provided for an addition of $35.93 to the original contract, bringing the revised contract total to $37,840.93. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the above addendum was approved. 1 REGULAR MEETING OCTOBER 25, 1982 APPROVE REQUEST TO ADVERTISE FOR BIDS — POLICE PATROL CARS In a letter to the Board, Police Chief Dan Thompson requested permission to advertise for the receipt of sealed bids for thirty-five 1983 police patrol cars in accordance with specifications drawn up by Lieutenant Harold Grounds, Division Chief Spandward Mitchem, Chief Thompson and Division of Transportation Manager Sean Watt. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried,_ the request was approved and a bid.date of November 15, 1982, established. APPROVE INTENDED USE HEARING ON REVENUE SHARING FUNDS Chief Deputy Controller Sherrie L. Petz requested Board approval for an intended use hearing on the proposed expenditure of $14,000.00 for the repair of lifts on trucks for the Bureau of Traffic and Lighting. Upon a motion.mnade by Mr. Leszczynski, seconded by Mr. Kernan and carried, the request was approved and a date of November 8, 1982, set for public hearing on the intended use.of the revenue sharing funds. APPROVE USE OF CITY SIDEWALKS FOR SALE OF POPPIES - VETERATIS OF FOREIGN WARS A request to use the city sidewalks for the sale of poppies made by the veterans on November 5 and 6, 1982, was received from George Grenert, a member of the South Bend Post 1167 of the Veterans of Foreign Wars. Upon a motion made by Mr. Kernan, seconded by Mr. Leszczynski and carried, the request was approved. APPROVE TRAFFIC CONTROL DEVICES Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the following traffic control devices as recom- mended by Ralph J. Wadzinski, Manager of the Bureau of Traffic and Lighting, were approved: REVISE TO 140 PARKING - East side of southern two- thirds of Rasmussen's Court. INSTALL 2 HOUR PARKING 6AM - 6PM - 502 W. LaSalle. REVISE TO 1 HOUR PARKING 6AM - 6PM - 113 W. Colfax. INSTALL NO PARKING - TOW ZONE (TEMPORARY) - Both sides of Michigan Street from Navarre, north as needed (approximately 200' maximum) for traffic control around proposed utility construction. DENY APPLICATION ON RIVER BEND PLAZA - DENNIS SMITH D/B/A B.A.G., INC. Mr. Leszczynski noted that the Board had received an application from Dennis Smith, d/b/a B.A.G., Inc., 4308 Vistual Road, for issuance of an Open -Air Stand license on River Bend Plaza for the sale of his invention known as "Inflatable Comfort". Mr. Leszczynski advised that, in accordance with the Board's policy governing such licenses on the Plaza, the application had been referred to the Redevelopment Department, in addition to other city agencies, for a determination as to whether or not such a stand would have a negative impact on the downtown. According to comments from Rick Pitts of the Redevelopment staff, the downtown merchants were surveyed and were opposed to the location of a temporary table, chair and sign for the promotion of the invention. Mr. Pitts, in a memo to the Board, pointed out that there were several distinctions between the present existing open air stands which are permitted to operate on the Plaza and the request by Mr. 22 REGULAR MEETING OCTOBER 25, 1982 Smith: the existing vendors' installation have some permancy; all signs are located on the units themselves; and the vendors sell snack -type items as opposed to general merchandise. The Redevelopment Department discouraged the sale of any promotional merchandise of this type because it was felt such sales could lend to "hawking" which would not be a desirable atmosphere to create on the Plaza. Upon a motion made by Mr. Leszczynski seconded by Mr. Kernan- nd carried, the license application was denied based upon the above recommendation. FILE ENVIRONMENTAL CLEAN-UP OF LOTS A list containing 84 lots ordered cleaned by the Director of the Neighborhood Code Enforcement Office was submitted. It was noted that property owners had been advised to clean up the lots and had failed to do so. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the environmental list was filed. APPROVE CONTP.ACTOR'S BOND - EUGENE TURNER Mr. Ray S. Andrysiak, P.E., recommended Board approval of the Contractor's Bond of Eugene Turner retroactive to October 18, 1982. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the above Contractor's Bond was approved. APPROVE HANDICAPPED PARKING PERMITS Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the following handicapped parking permits were approved - and referred to the Deputy Controller's Office for issuance: George M. Verhaeghe, 3223 Rue Voltaire, Apt. 913 Charles W. Emery, 1648 E. Fox, S.B. James Ulis, 53308 Portage, S.B. Mark R. Brumbaugh, 19553 Darden, S.B. Claude C. Paree, 1009 21st, S.B. APPROVAL OF CLAIMS Mr. Elroy J. Kelzenberg, Director of the Michiana Area CETA Con- sortium,.submitted purchase orders totalling 17 to be paid out of FY 1982, and purchase orders totalling 21 to be paid out of FY 1983 funds, and recommended approval. Chief Deputy Controller Sherrie L. Petz submitted Claim Docket No. 20103 through No. 20829 and recom- mended approval. Upon a motion made by Mr. Kernan, seconded by Mr. Leszczynski and carried, the above claims were approved and the reports filed.
