MAY 13, 1985
The regular meeting of the Board of Public Works was convened at
9:34 a.m. on Monday, May 13, 1985, by President John E.
Leszczynski, with Mr. Leszczynski, Ms. Katherine G. Barnard
and Mr. Michael L. Vance present. Also present was Assistant City
Attorney Carolyn V. Pfotenhauer.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance and
carried, the minutes of the May 6, 1985, regular meeting of the
Board were approved.
OPENING OF BIDS:

- ONE (1) OR MORE PNEUMATIC TIRED ROLLERS.
- ONE (1) OR MORE ALLEY GRADERS
This was the date set for receiving and opening of sealed bids for
the above referred to equipment. The Clerk tendered proofs of
publication of Notice in the South Bend Tribune and the Tri-County
News which were found to be sufficient. The following bids were
opened and publicly read:

over a four year period with payments as requested. The
fixed interest rate for the four year period would be
10.47%. This rate is based on eight semi-annual
payments with the first payment being paid on delivery.
The factor for computing each payment is .14842 times
the amount of purchase (.14842 x amount of purchase).

Ms. Pfotenhauer advised the Board that the bid of The Highway
Equipment Company was not on the proper bid form and no bid
security was submitted, therefore, she recommended it be rejected.
Upon a motion made by Ms. Barnard, seconded by Mr. Vance and
carried, the bid of The Highway Equipment Company was rejected.
Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance and
carried, the above bids were referred to the Street Department for
review and recommendation.
OPENING AND AWARD OF BIDS - SALE OF ABANDONED VEHICLES
This was the date set for the receiving and opening of sealed bids
for the sale of approximately twenty (20) abandoned vehicles,
fourteen (14) of which are valued at over $100.00 and all of which
have been stored at Steve and Gene's Auto & Truck Salvage and
Repair, 3109 South Gertrude Street, South Bend, Indiana. The
Board was advised by the Department of Code Enforcement that
vehicles number one (1) and eleven (11) should not be considered
for sale as they have been reclaimed by their owners. The Clerk
tendered proofs of publication of Notice in the South Bend Tribune
and the Tri-County News which were found to be sufficient. The
following bids were opened and publicly read:

carried, the above bids were referred to the Department of Code
Enforcement for immediate review and recommendation in order that
an award could be made prior to adjournment of the meeting.

* Was not the low bidder ($1,777.00 more than Shamrock's bid) but
the type of tower bid by Dalums is preferred by our forestry staff
for the following reasons:
1. The lift all unit does not meet the required
height of 52 ft. measured at a point 12'-1" out
from the center of the turntable at the bottom
front edge of the bucket.
2. The size of the basket is smaller than specified.
3. Control at the bucket has full pressure control
rather than the master slave low pressure
system specified.
4. Has open center hydraulic system rather than the
closed center with accumulator specified.
Other Considerations
The service on the Hi -Ranger unit is in Bourbon, Indiana which
is much closer than Lift All's which is in Delphi, Indiana.
At the present time they only have approximately 100 units in
the field and in operation. They have been manufacturing this
unit for only 1 1/2 years compared to 30 some years of
Hi -Ranger.
Upon a motion made by Ms. Barnard, seconded by Mr. Leszczynski and
carried, the above recommendation was approved and the bids
awarded.
ADOPTION OF RESOLUTION NO. 17-1985 - DISPOSAL OF OBSOLETE
EQUIPMENT (BUREAU OF TRAFFIC AND LIGHTING)
Upon a motion made by Mr. Leszczynski, seconded by Ms. Barnard and
carried, the following Resolution No. 17-1985 was adopted:

WHEREAS, it has been determined by the Board of Public
Works that the following equipment is no longer needed by
the Bureau of Traffic and Lighting of the City of South
Bend:

APPROVE AGREEMENT FOR USE OF PUBLIC RIGHT-OF-WAY FOR FOOT RACES
AND SIMILAR EVENTS - MICHIANA WATERSHED, INC.
Mr. Leszczynski advised that pursuant to Resolution No. 9-1985,
establishing policies and fees for foot races and similar events,
adopted by the Board of Public Works on March 4, 1985, Michiana
Watershed, Inc., sponsor of the 15th Annual St. Joseph River Run,
has fulfilled resolution requirements and the agreement with them
is being presented to the Board for execution at this time.
It was noted that on March 4, 1985, the Board of Public Works
approved the date for this event subject to the sponsor meeting
all resolution requirements.
Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance
and carried, the above Agreement with Michiana Watershed, Inc. was
approved and executed.
APPROVAL OF EASEMENT/QUIT-CLAIM DEED - CROSSROADS INDUSTRIAL PARK
Mr. Leszczynski advised that this Easement/Quit-Claim Deed from
Larry Donica and Barbara Donica was in regard to the Crossroads
Industrial Sewer. The sewer is being installed by a private
developer and they will pay all costs. The sewer will then be
dedicated to the City. Upon a motion made by Mr. Leszczynski,
seconded by Ms. Barnard and carried, the above Easement/Quit-Claim
Deed was approved.

DISCLOSURE OF A DETERMINATION OF CONFLICT OF INTEREST
In a letter to the Board Mr. Jon R. Hunt, Executive Director,
Department of Redevelopment, advised the Board that this letter is
to be received and filed at a public meeting of the Board of
Public Works and will serve as public disclosure of a
determination of conflict of interest under 24CFR 570.611 for the
following persons:
Ayanna Ydongo, employee of the South Bend Heritage Foundation,
for purchase of a house South Bend Heritage acquired and
rehabilitated with Community Development Block Grant Funds;
and
Lena Harley, former employee of the City of South Bend Bureau
of Housing, for an emergency repair grant to her house under
the Bureau of Housing Emergency repair grant program funded
with•Community Development Block Grant Funds.
It was noted that the office of the South Bend City Attorney has
determined that neither of the above situations constitute a
conflict of interest under state law, and the Department of
Redevelopment will be requesting a waiver from the United States
Department of Housing and Urban Development.
Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance and
carried, the above letter was filed with the Board.
APPROVE OFFER TO PURCHASE REAL PROPERTY - BUREAU OF HOUSING LOCAL
HOMESTEADING PROGRAM - 918 NORTH CLEVELAND AVENUE
As part of the Bureau of Housing Local Homesteading Program, Mr.
Ted Leverman, Assistant Director, Bureau of Housing, presented to
the Board for approval an Offer to Purchase Real Property for the
property located at 918 North Cleveland Avenue in the amount of
$15,000.00. It is his recommendation that the purchase price is
reasonable for this property which would fit into the Urban
Homesteading Program. Upon a motion made by Mr. Leszczynski,
seconded by Ms. Barnard and carried, the above Offer to Purchase
Real Property in the amount of $15,000.00 from Ronald and Denise
Hixenbaugh for the house located at 918 North Cleveland Avenue was
approved and executed.
REOUEST TO PURCHASE CITY -OWNED PROPERTY AT 308 FULTON COURT
In a letter to the Board, Ms. Doris Milewski, 1009 W. La Salle,
South Bend, Indiana, indicated that she was interested in
purchasing the City -owned property at 308 Fulton Court, South
Bend, Indiana. Ms. Milewski advised that she has been taking care
of this lot, which is adjacent to her backyard, for the past three
years. Upon a motion made by Mr. Leszczynski, seconded by Ms.
Barnard and carried, the above'request was referred to the
necessary City departments and bureaus for a determination as to
whether or not the City need retain the lot for any reason.
REQUEST OF WEST SIDE MEMORIAL COMMITTEE TO HOLD ANNUAL MEMORIAL
DAY PARADE (MAY 27, 1985) REFERRED
In a letter to the Board, Ms. Adeline Waslicki-Jaskowiak,
Secretary, West Side Memorial Committee, requested permission to
hold the annual Memorial Day Parade on Monday, May 27, 1985. Ms.
Waslicki-Jaskowiak advised that the parade will assemble at 8:00
a.m. at Olive and Ford Streets and will move out at 8:30 a.m. and
proceed west on Ford Street past Pierre Navarre School where it
will disband at Summit Drive. The total time from start to finish
will be approximately one and one-half hours. Upon a motion made
by Mr. Leszczynski, seconded by Ms. Barnard and carried, the above
request was referred to the Bureau of Traffic and Lighting and the
Police Department Traffic Division for review and recommendation.

REQUEST OF WSBT RADIO TO CONDUCT 2ND ANNUAL "SALUTE.TO SUMMER" ON
RIVER BEND PLAZA - JUNE 21, 1985 - REFERRED
Ms. Mikki Dobski, Director, Office of Community Affairs, submitted
to the Board a request from WSBT Radio, 300 West Jefferson
Boulevard, South Bend, Indiana, to hold the 2nd Annual "Salute to
Summer" on the stage area on River Bend Plaza on Friday, June 21,
1985. WSBT Radio, its announcer and staff plan to grill hot dogs
and provide Coke free to the public as part of this celebration of
the first official day of summer. The time of this event would be
from 11:30 a.m. to 2:00 p.m. with a live remote broadcast during
this time span. Ms. Dobski stated that this has been a fine event
for the Downtown and requests favorable consideration of this
request. Upon a motion made by Mr. Leszczynski, seconded by Mr.
Vance and carried, the above request was referred to the Bureau of
Traffic and Lighting and the Police Department Traffic Division
for review and recommendation.
APPROVE REQUEST TO ADVERTISE FOR RECEIPT OF BIDS - SALE OF
ABANDONED VEHICLES
Ms. Katherine Barnard, Director, Department of Code Enforcement,
requested permission to advertise for the sale of approximately
twenty (20) abandoned vehicles, fourteen (14) of which are valued
at over $100.00 and all of which are being stored at Steve &
Gene's Auto & Truck Salvage and Repair, 3109 South Gertrude
Street, South Bend, Indiana. It was noted that all vehicles have
been stored more than fifteen (15) days, identification checks had
been run for auto theft and the owners and lienholders notified.
Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance and
carried, the above request was approved and a date of May 28, 1985
was established for the receiving and opening of sealed bids.
APPROVE COMMUNITY DEVELOPMENT ADDENDUM
The following Community Development addendum was presented to the
Board for approval:

APPROVE REQUEST TO WALK FROM LEEPER PARK TO NOTRE DAME UNIVERSITY
IN REGARD TO THE SITUATION IN EL SALVADOR
Mr. Leszczynski advised that Mr. Joseph J. Pluta, Director,
Division of Engineering and Captain Edward I. Friend, South Bend
Police Department Traffic Division have reviewed the request of
Marece Neagu and Lee Gloster to conduct a Walk from Leeper Park to
Notre Dame University on May 19, 1985, said request submitted to
the Board on April 29, 1985, and recommend approval. Upon a
motion made by Mr. Leszczynski, seconded by Ms. Barnard and
carried, the above recommendation was accepted and the request
approved.

Upon a motion made by Mr. Leszczynski, seconded by Ms. Barnard and
carried, the following four (4) traffic control devices were

Mr. Leszczynski advised that the Title Sheets for the Jefferson
and Eddy Realignment and Concrete Pavement Improvements - 1985
Projects were being presented at this time for execution. Upon a
motion made by Mr. Leszczynski, seconded by Mr. Vance and carried,
the above referred to Title Sheets were approved and signed.
FILING OF ENVIRONMENTAL CLEAN-UP OF LOTS REPORT
A report from the Department of Code Enforcement indicating a
total of one hundred eighteen (118) properties cleaned from May 6,
1985 to May 10, 1985 was submitted. Upon a motion made by Mr.
Leszczynski, seconded by Ms. Barnard and carried, the report as
submitted was filed.
APPROVE CLAIMS
Deputy City Controller Carol M. Sanders submitted Claim Docket No.
10233 through Claim Docket No. 10936 and recommended approval.
Upon a motion made by Mr. Vance, seconded by Ms. Barnard and
carried, the claims were approved and the report filed.
PRIVILEGE OF THE FLOOR:
COMPLAINT REGARDING CLEAN-UP OF CORNER OF WASHINGTON & IOWA
Mr. Robert Williams, 1637 Longley, South Bend, Indiana, was
present and addressed the Board. He owns the lot at the corner of
Washington and Iowa near LaSalle Park. He stated that there is a
constant problem of people stopping their cars and littering on
his property. Mr. Williams advised that the Department of Code
Enforcement sent him a bill for cleaning up the property, which he
claims they did not do and he presented pictures to the Board. He
would like to request that No Parking and No Stopping signs be
placed so the Police Department could then enforce, possibly
helping the littering problem. Ms. Barnard advised that her
Department did pick up some litter, but it probably accumulated
again in a couple of days. She also stated that a property owner,
even of a vacant lot, has the responsibility of taking care of
their property. Mr. Williams said he would like to hire a couple
of kids to clean his property, but would like the City's help in
keeping some of the litter from getting there in the first place.
Mr. Leszczynski advised Mr. Williams that the Bureau of Traffic
and Lighting would look into the possibility of having No Parking
and No Stopping signs installed on Washington Street and he would
talk to the Police Department about enforcing no parking in the
alley. Mr. Leszczynski also advised him that he is still required
to clean his property and if he did not it would be cleaned by the
City again and he would get another bill.
