Home My WebLink AboutResolution No. 49 Policy for Establishing and Posting Reduced Speed LimitsRESOLUTION NO. 49-2016 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA FOR A POLICY FOR ESTABLISHING AND POSTING REDUCED SPEED LIMITS WHEREAS, the Board of Public Works ("BPW") is a contracting body of the City of South Bend (the "City") and exists and operates under the provisions of I.C. 36-4-9-5, as amended from time to time (the "Act"); and WHEREAS, pursuant to I.C. 36-4-4-2(a); 36-4-5-3(7); 36-1-3-2; and 36-1-3-3, the BPW has the power and duty to assist the Executive in the efficient and effective operation of government of the City; and WHEREAS, pursuant to the City of South Bend Municipal Code Section 20-6 ("Code"), the BPW has the power to impose certain speed limits on City streets; and WHEREAS, the BPW has determined it to be in the best interest and safety of the City's citizens to take into consideration nature and characteristics as well as land use and zoning to establish the appropriate speed limits in residential areas and neighborhoods; and WHEREAS, residents of a neighborhood/residential area often request traffic speed reduction controls on their streets and therefore establishing residential speed limits may be helpful in providing such traffic calrning; and WHEREAS, the BPW shall empower the City Engineer's Office to establish residential speed limits; and WHEREAS, the City may initiate reduced speed zones without a petition and reduced speed limits may be applied to blocks or street segments on their own or as part of traffic calming device installations, or in school or park areas, or as roadway operating speed warrants; and WHEREAS, the process for evaluating the need for residential speed limits shall include a petition process and shall take into consideration the street character, non -motorized and pedestrian traffic, and surrounding land -use; and WHEREAS, the BPW shall empower the City Engineer's Office to establish procedures, warrants and reasonable measures to establish the need for residential speed limits in a defined area. Refer to Exhibit A, attached, for outline of policy and procedures and Exhibit B for the Petition form. Page 1 of 2 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS THAT: The Board of Public Works for the City of South Bend, under the pourer vested by the City of South Bend Municipal Code Section 20-6, shall hereby allow neighborhoods to request reduced speed limits designation on their streets, as well as allow the City's team of engineers, street, and public safety officials to designate residential speed limits. In school areas there are specific speed zones during specified hours of the day and days of the week. Due to several requests for reduced speed limits in residential areas and to provide for better driver information and easier enforcement a process for reviewing and implementing lower speed limit zones it was determined that a policy and process is needed. In order to objectively and completely consider reduced speed zone requests the following criteria (warrants) are to be evaluated: • A petition indicating basic neighborhood/community support of the residential speed zone Street character (functional classification, width and parking, traffic volume, speed) Geometric considerations (street geometry, sight distance, parking, sidewalks) Surrounding land use Warrant analysis for reduced speed limit implementation 1. Implementation must be approved by the City of South Bend Board of Public Works 2. The reduced speed limit may be implemented with or without additional traffic calming devices, if either combination of Warrants 1 and 2 or Warrants 1 and 3 are met. • In order to ensure that only requests which are supported by the community are investigated, the affected area shall be defined. A petition signed by at least 25% of the residents within the affected area is to be submitted to the City Engineer, Division of Engineering, Department of Public Works, City of South Bend. • The Division of Engineering reserves the option to initiate the implementation of a residential speed zone without a petition. a.
