This resolution approves and adopts two new discounted rate categories, increases monthly subscription rates, and standardizes the hourly rates across the city. This action follows a series of recommendations delivered to the City of South Bend following the completion of a downtown parking study in February 2016. Several other recommendations are being implemented as a result of this study which was commissioned jointly by the Department of Community Investment and the Redevelopment Commission in the summer of 2015. The study and recommendations, conducted by Rich & Associates, Inc. involved heavy stakeholder engagement throughout and the conclusions are available on the city's website. Parking fees have not been adjusted since 2008, the longest period without an increase in more than 35 years. Approving this resolution will result in an improved parking program to meet the changing needs of downtown. It will also make available an additional $213,000 annually to be used for capital needs within the garages. Thank you for your consideration. A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING PARKING RATES, CHARGES, AND RULES FOR PUBLICLY -OWNED PARKING FACILITIES IN THE CITY OF SOUTH BEND, INDIANA WHEREAS, pursuant to Ind. Code 36- 9 -11 -7, on September 27, 2016, the Board of Public Works of the City of South Bend, Indiana, adopted its Resolution No. 42 -2016, attached hereto as Exhibit A (the "BPW Resolution "), establishing certain rates, charges, and rules for the use and operation of publicly -owned parking facilities located in the City of South Bend; and WHEREAS, the Common Council desires to approve the rates, charges, and rules stated in the BPW Resolution, in accordance with Ind. Code 36- 9- 11 -7(a). NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. The rates, charges, and rules set forth in the BPW Resolution are approved and shall be effective on the date stated in the BPW Resolution. Section II. The approval of rates, charges, and rules stated herein supersedes all prior ordinances and resolutions of the Common Council approving rates, charges, and rules for publicly -owned parking facilities, including, without limitation, Ordinance Nos. 9845 -08 and 9397 -03. Section III. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. Code 36- 9 -11 -7 authorizes the Board of.Public Works (the "Board ") to fix the rates and charges to be collected for the parking of vehicles in parking facilities owned and operated by the City of South Bend (the "City "), or for any other use of those parking facilities, and to adopt rules governing the use and operation of the parking facilities so as to promote the maximum use of the parking facilities by the public in a safe, orderly, and efficient manner; and WHEREAS, the Board desires to establish the rates, charges, and rules set forth herein and will submit the same for approval by the South Bend Common Council in accordance with Ind. Code 36- 9- 11 -7(a). NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND BOARD OF PUBLIC WORKS AS FOLLOWS: I. The following monthly parking rates will be charged for vehicles parked at City- operated garages with a monthly parking pass: Old Rate New Rate A. Standard Monthly Pass (per vehicle for parking in $45.00 spaces not designated as reserved) B. Premium Monthly Pass (per vehicle for parking in $55.00 spaces designated as reserved) C. Part -Time Monthly Pass (per vehicle for parking in None designated part -time spaces for a total of no more than 25 hours per week) D. The following hourly parking rates will be charged for vehicles parked at City - operated garages without a monthly parking pass: 3. Permitting access to City- operated facilities, designating parking spaces in City - operated facilities for particular parking purposes, issuing or renewing parking passes for parking in City - operated facilities, and all other functions incidental to managing City - operated parking facilities lie in the sale discretion of the Board of Public Works or its designee. Unless otherwise designated, parking spaces in the City- operated facilities will be allocated to users on a first -come, first- served basis. In the event the demand for parking spaces exceeds the supply ofparking spaces in the City- operated facilities, priority for parking spaces in the City- operated facilities will be given to users who pay for a monthly pass, provided payment is timely and current. Each monthly parking pass will be designated for use in only one (1) City - operated facility. Each holder of a monthly parking pass must register his or her vehicle by completing a vehicle identification form and must prominently display the monthly parking pass in the registered vehicle at all times when parked in the City - operated facility. 4. The effective date of the rates, charges, and rules established in this Resolution will be January 1, 2017, conditioned upon approval by the South Bend Common Council in accordance with Ind.
