The Board of Public Works, at its regular meeting held on September 27, 2016, denied the
petition for a residential parking zone, as it did not meet the requirements of the South Bend
Municipal Code,
Chapter 20, Article 10, Section 20-114, as follows:
The South Bend Municipal Code indicates that curb space must be occupied seventy-five
percent (75%) of the time and the curb space must be occupied by non-residents at least
twenty-five (25%) of the time.
A survey was conducted by Traffic and Lighting on August 25, 2016, at 11:00 a.m. 3:00 p.m.
and 5:00 p.m.; September 1 at 6:30 p.m.; September 2 at 7:00, 9:00 & 11:30 a.m., 2:00, 3:45
and 5:30 p.m.; September 8, at 5:00 p.m., 6:00 p.m. and 7:00 p.m. Results of the survey did
not indicate curb space was occupied more than 75% of the available parking spaces

WE, THE UNDERSIGNED, BEING SIXTEEN (16) YEARS OF AGE OR OLDER AND
LEGAL RESIDENTS OF THE RESIDENTIAL AREA DESCRIBED HEREIN, request that the
Board of Public Works of the City of South Bend, in accordance with Municipal Code Article 10
Section 20-114, authorize a traffic study to be conducted for the establishment of a Residential
Parking Zone in the area of (state boundaries of residential area):

A Residential Parking Zone is needed in the above described area(s) to:
• Reduce hazardous traffic conditions that exist;
• Protect the area from polluted air, excessive noise and litter caused by the entry of
commuter vehicles;
• Protect the residents of the area from unreasonable burdens in gaining access to their
residences;
• Preserve the value of the property in the district.
The South Bend Municipal Code indicates that curb space must be occupied seventy-five percent
(75%) of the time and the curb space must be occupied by non-residents at least twenty-five
percent (25%) of the time.

Background
The Board of Public Works received a petition for a Residential Parking by Permit Only in the 100
East block of Donald Street. Residents claim that clients of the Octapharma Plasma Donation
Center (Octapharma) take up parking spaces and they are unable to park near their homes. The
photo below identifies the location of the business and the yellow lines show the parking areas
taken into consideration in the study.
The City of South Bend Code of Ordinances require that at least 25% of the available parking
spaces must be occupied by non-resident vehicles and that 75% of the available parking spaces
must be occupied by vehicles.

Result
Then parking study was conducted at varying times over a four -day period in an attempt to get
the best, most widely varied data. It was found that at the most, there were only 4 residents'
vehicles parked on the street during the time of the study (as shown in the green highlighted cells
in the tables on the following pages), which when added to the non-resident vehicles, accounted
for less than half of the total available spaces. The percentage of non-residents' vehicles
surpassed the 25% threshold 6 times during the multi -day study, but it needs to be in combination
with the total number of parking spaces utilized, to meet the ordinance requirements. While the
South Michigan Street and East Donald Street intersection does get quite congested it appears
that the Octapharma clients park either in the parking lot on the south side or along either the east
side of South Michigan Street or the south side of East Donald Street, next to the business.
Recommendation
Since the requirements of the ordinance are not met it is recommended that the request for a
Residential Parking Zone be denied.
