SEPTEMBER 17, 1990
The regular meeting of the Board of Public Works was convened at
9:35 a.m. on Monday, September 17, 1990, by Board Member Patricia
E. DeClercq, with Mrs. DeClercq and Ms. Katherine Humphreys
present. Also present was Board Attorney Jenny Pitts Manier.
Board President John E. Leszczynski was not in attendance.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Ms. Humphreys, seconded by Mrs. DeClercq
and carried, the minutes of the September 10, 1990, regular
meeting of the Board were approved.
OPENING OF BIDS - LEASE PURCHASE FOUR.(4) COPY MACHINES
This was the date set for receiving and opening of sealed bids
for the above referred to equipment. The Clerk tendered proofs
of publication of Notice in the South Bend Tribune and the
Tri-County News which were found to be sufficient. The following
bids were opened and publicly read:

Ms. Humphreys made a motion that the above referred to bids be

ADOPT RESOLUTION NO. 22-1990 AND RESOLUTION NO. 23-1990 -
ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE
PROVISION OF SERVICE TO AN ANNEXED AREA IN GERMAN TOWNSHIP
Mr. David Norris, Department of Economic Development, was present

and addressed the Board concerning the above referred to
Resolutions which were submitted to the Board today for adoption.
Mr. Norris, utilizing a diagram of the areas to be annexed,
advised that attached to the Resolutions and made a part thereof,
were Fiscal Plans for each annexation. He noted that Resolution
No. 22-1990 involves the annexation of property located in German
Township north of Lincolnway West located near the Michiana
Regional Airport. Resolution No. 23-1990 involves an area to be
annexed commonly known as the Toll Road Industrial Park. Mr.
Norris stated that the fiscal plans for both of these proposed
annexations were prepared through the cooperative effort of
various City departments and bureaus.
Mr. Norris explained that the property to be annexed north of
Cleveland Road in the Toll Road Industrial Park is a part of the
Airport 2010 Plan which designates this proposed annexation area
for light industrial and warehouse/distribution uses. The
property to be annexed north of Lincolnway West near the Michiana
Regional Airport is also part of the Airport 2010 Plan and
designates this area for an office park and corporate office
campus development.
There being no further questions regarding this matter, Ms.
Humphreys made a motion that the Resolutions as submitted be
adopted. Mrs. DeClercq seconded the motion which carried and the
following Resolution No. 22-1990 and 23-1990 were adopted:

A RESOLUTION OF THE BOARD OF PUBLIC WORKS
OF THE CITY OF SOUTH BEND ADOPTING A
WRITTEN FISCAL PLAN AND ESTABLISHING A
POLICY FOR THE PROVISION OF SERVICES TO
AN ANNEXED AREA IN GERMAN TOWNSHIP
WHEREAS, there has been submitted to the Common Council of the
City of South Bend, Indiana, an ordinance which proposes the
annexation of the hereinafter described real estate located in
German Township, St. Joseph County, Indiana; and
WHEREAS, the territory proposed to be annexed is adjacent to
and/or near the Michiana Regional Airport and is to be developed,
as part of the City's Airport 2010 project, which development
will require a level of municipal public services basic to the
establishment and maintenance of such development, which services
shall include services of a non -capital nature, including street
and road maintenance, and services of a capital improvement
nature, including street construction, street lighting, sewer
facilities, and storm water facilities; and
WHEREAS, the Board of Public Works now desires to establish and
adopt a fiscal plan and establish a definite policy showing (1)
the cost estimates of services of a non -capital nature, including
street and road maintenance and other non -capital services
normally provided within the corporate boundaries, and services
of a capital improvement nature, including street construction,
street lighting, sewer facilities, and storm water drainage
facilities to be furnished to the territory to be annexed; (2)
the method(s) of financing those services; (3) the plan for the
organization and extension of those services; (4) that services
of a non -capital nature will be provided to the annexed area
within one (1) year after the effective date of the annexation,
and that they will be provided in a manner equivalent in standard
and scope to similar non -capital services provided to areas

within the corporate -boundaries of the City of South Bend, that
have characteristics of topography, patterns of land use, and
population density similar to that of the territory to be
annexed; (5) that services of a capital improvement nature will
be provided to the annexed area within three (3) years after the

services are provided to areas within the corporate boundaries of
the City of South Bend that have characteristics of topography,
patterns of land use and population density similar to that of
the territory to be annexed and in a manner consistent with
federal, state and local laws, procedures, and planning criteria;
and (6) the plan for hiring the employees of other governmental
entities whose jobs will be eliminated by the proposed
annexation.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF
THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. That it is in the best interest of the City of South
Bend and of the area proposed to be annexed that the real
property located in German Township, St. Joseph County, Indiana,
described in Attachment A, attached hereto and made a part
hereof, be annexed to the City of South Bend.
Section II. That it shall be and hereby is now declared and
established that it is the policy of the City of South Bend, by
and through its Board of Public Works, to furnish to said
territory services of a non -capital nature, such as street and
road maintenance, within one (1) year of the effective date of
the annexation, in a manner equivalent in standard and scope to
the services furnished by the City to other areas of the City
which have characteristics of topography, patterns of land
utilization and population density similar to said territory; and
to furnish to said territory services of a capital improvement
nature, such as street construction, street lighting, sewer
facilities, and storm water facilities, within three (3) years of
the effective date of the annexation, in the same manner as those
services are provided to areas within the corporate boundaries of
the City of South Bend that have characteristics of topography,
patterns of land use and population density similar to that of
the territory to be annexed and in a manner consistent with
federal, state and local laws, procedures, and planning criteria.
Section III. That the Board of Public Works shall and does
hereby now establish and adopt the fiscal plan described in
Exhibit B, attached hereto and made a part hereof, for the
furnishing of said services to the territory to be annexed.

CITY OF SOUTH BEND, INDIANA
FISCAL PLAN FOR THE
ANNEXATION OF THE PROPERTY LOCATED IN GERMAN TOWNSHIP
NORTH OF LINCOLNWAY WEST
INTRODUCTION
The following Fiscal Plan,
developed through the
cooperative
efforts of the City of South
Bend's Controller's
Office,
Department of Public Works,
Police Department, Fire
Department,
Department of Neighborhood
Code Enforcement, and
the Department
of Public Works, represents
the City's policy for
the annexation
of the property located north
of Lincolnway West
in German
Township, St. Joseph County
(hereinafter, "Annexation
Area").
This annexation meets the statutory contiguity requirements.
I. LOCATION
The Annexation Area is located near the Michiana Regional Airport

in part of Sections 29, 30, 31 and 32, Township 38 North, Range 2
East, German Township, St. Joseph County, Indiana. The Legal
Description for the Annexation Area, marked as Exhibit 1, is
attached hereto and made a part hereof. A map showing the
Annexation Area, marked as Exhibit 2, is attached hereto and made
a part hereof. There are approximately 489.50 acres of land
within the Annexation Area. The Annexation Area is within the
Airport 2010 Project area.
II. EXISTING LAND USE
There are three residential lots which comprise approximately
21.5 acres of the entire Annexation Area. The remaining 468
acres are vacant land.
III. PROPOSED DEVELOPMENT
The Airport 2010 plan designates this proposed Annexation Area
for an office park and corporate office campus development. The
office park and corporate office campus project will include a
golf course and hotel. The golf course will be privately owned
and opened for public play.
All surface drainage is to be handled in compliance with the City
of South Bend's Subdivision Standards. The developer of the
project will be responsible for infrastructure improvements that
are directly related to building sites, the golf course and the
hotel site. The City will be responsible for the development of
city streets and utilities and will finance its portion of the
improvements through the sale of a Tax Increment Revenue Bond.
State funds are being sought for a portion of the improvements,
including an expanded Toll Road interchange. Should state funds
not immediately be available in the amount required, the project
schedule will be revised and the extent of the initial
development revised.
IV. PROVISION OF CITY SERVICES
A. Public Works
No additional expenditure from the City's general fund or
operating budget will be required to provide the proposed street
and utility improvements. Funds for the development of the
internal city street system will be provided by a Redevelopment
Commission and Authority's Tax Increment Bond Issue. The
Redevelopment Commission and Authority will sell bonds of
approximately $6,000,000 to finance the City's portion of the
improvements by December 1990. Development in this manner of an
internal city street system shall be complete within three (3)
years after the effective date of the annexation. Additional
improvements to the major roads in the area, including the Toll
Road interchange, will be sought from the State of Indiana's
Transportation Improvement Fund and Toll Road General Reserve
Fund. Private developers will be required to provide capital
improvements directly related to the development sites, golf
course and hotel site.
The proposed streets represent less than one percent (1%) of the
City's current road system and can be easily maintained with
existing personnel and equipment without additional expenditure
of money.
The existing wastewater treatment and collection systems can
provide service to the proposed area without any additional
expenditures by the City. The existing water system is adequate
and currently available to the Annexation Area. These services
shall be furnished to the Annexation Area immediately upon the
effective date of the annexation.

The City can also provide solid waste collection services as
needed to the Annexation Area without additional equipment or
personnel and without additional expenditure of money.
B. Police Protection
The Annexation Area's use, as well as its size and location,
necessitate the creation of a new police patrol beat adjacent to
the existing Beat 24 to provide adequate and comparable police
protection to the area. The additional beat will require 4.5
patrol officers to cover all three shifts and days off.
Personnel will spend approximately 20 percent of their time on
patrol within the area. Total yearly cost for personnel
associated with the new patrol beat is approximately $31,550,
including supervision, vacation coverage, and overtime as
required. An additional patrol vehicle, costing approximately
$13,000 will also be needed for the new beat. Total costs
attributable to the creation of the new beat is $44,550.
Personnel costs will be included in the annual operating budget
of the Police Department. Vehicle costs will be paid from the
Cumulative Capital Development Fund or the General Fund. Police
protection of the scope detailed herein shall be furnished to the
Annexation Area within one (1) year after the effective date of
the annexation.
C. Fire Protection
Fire protection can be furnished immediately upon the effective
date of the annexation.
No site plan has been developed for this particular development.
When one is submitted, however, adjustments in personnel and
equipment will be made as necessary to provide adequate fire
protection.
Depending upon the final configuration of the roads and the
location of the buildings and golf course within the complex,
fire protection will be provided by either Station *11 at 3505
North Bendix Drive, Station 7 at 1616 Portage Avenue, or Station
4 which is located at 220 North Olive Street. Response times
will be comparable to other parts of the City near the Annexation
Area which are also served by stations 4, 7 and 11.
D. Neighborhood Code Enforcement
The Department of Neighborhood Code Enforcement can perform code
enforcement activities without acquiring additional equipment or
hiring of additional personnel.
The Humane Society of St. Joseph County currently provides animal
control services on a County -wide basis.
These services shall be furnished to the Annexation Area
immediately upon the effective date of the annexation.
E. Public Parks
There are adequate park facilities in the northwest area of the
City which can be utilized by persons within the Annexation Area,
immediately upon the effective date of the annexation. Parks and
facilities which are reasonably close to the Annexation Area
are: 1) Voorde Park which is comprised of fourteen (14) acres,
containing- a softball field, picnic tables and playground
equipment; and, 2) Boland Park, comprised of twenty-one (21)
acres containing three lighted tennis courts, a lighted softball
diamond, basketball courts and various picnic and playground
facilities.

V. HIRING PLAN

A RESOLUTION OF THE BOARD OF PUBLIC WORKS
OF THE CITY OF SOUTH BEND ADOPTING A
WRITTEN FISCAL PLAN AND ESTABLISHING A
POLICY FOR THE PROVISION OF SERVICES TO
AN ANNEXED AREA IN GERMAN TOWNSHIP
WHEREAS, there has been submitted to the Common Council of
the City of South Bend, Indiana, an ordinance which proposes the
annexation of the hereinafter described real estate located in
German Township, St. Joseph County, Indiana; and
WHEREAS, the territory proposed to be annexed is adjacent to
and/or near the Michiana Regional Airport and is to be developed,
as part of the City's Airport 2010 project, which development
will require a level of municipal public services basic to the
establishment and maintenance of such development, which services
shall include services of a non -capital nature, including street
and road maintenance, and services of a capital improvement
nature, including street construction, street lighting, sewer
facilities, and storm water facilities; and
WHEREAS, the Board of Public Works now desires to establish
and adopt a fiscal plan and establish a definite policy showing
(1) the cost estimates of services of a non -capital nature,
including street and road maintenance and other non -capital
services normally provided within the corporate boundaries, and
services of a capital improvement nature, including street
construction, street lighting, sewer facilities, and storm water
drainage facilities to be furnished to the territory to be
annexed; (2) the method(s) of financing those services; (3) the
plan for the organization and extension of those services; (4)
that services of a non -capital nature will be provided to the
annexed area within one (1) year after the effective date of the
annexation, and that they will be provided in a manner equivalent
in standard and scope to similar non -capital services provided to
areas within the corporate boundaries of the City of South Bend,
that have characteristics of topography, patterns of land use,
and population density similar to that of the territory to be
annexed; (5) that services of a capital improvement nature will
be provided to the annexed area within three (3) years after the
effective date of the annexation in the same manner as those
services are provided to areas within the corporate boundaries of
the City of South Bend that have characteristics of topography,
patterns of land use and population density similar to that of
the territory to be annexed and in a manner consistent with
federal, state and local laws, procedures, and planning criteria;
and (6) the plan for hiring the employees of other governmental
entities whose jobs will be eliminated by the proposed
annexation.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. That it is in the best interest of the City of
South Bend and of the area proposed to be annexed that the real

FISCAL PLAN FOR THE
ANNEXATION OF THE PROPERTY LOCATED IN GERMAN TOWNSHIP
NORTH OF CLEVELAND ROAD
INTRODUCTION
The following Fiscal Plan, developed through the cooperative
efforts of the City of South Bend's Controller's Office,
Department of Public Works, Police Department, Fire Department,
Department of Neighborhood Code Enforcement, and the Department
of Public Works, represents the City's policy for the annexation
of the property located north of Cleveland Road in German
Township, St. Joseph County (hereinafter, "Annexation Area").
This annexation meets the statutory contiguity requirements.
I. LOCATION
The Annexation Area, commonly known as the Toll Road Industrial
Park, is located in part of Section 21 and 22, Township 38 North,
Range 2 East, German Township, St. Joseph County, Indiana. The
Legal Description and map of the Annexation Area, marked as
Exhibit 1, are attached hereto and made a part hereof. There are
approximately 261.56 acres of land within the Annexation Area.
The Annexation Area is within the Airport 2010 Project area.
II. EXISTING LAND USE
Approximately 28 percent of the Annexation Area is currently in
industrial use. The remaining portion is vacant land.
III. PROPOSED DEVELOPMENT
The Airport 2010 plan designates this proposed annexation area
for light industrial and warehouse/distribution uses. The
proposed development will be similar to the existing light
industrial and warehouse/distribution uses in the project area.
All surface drainage is to be handled in compliance with the City
of South Bend's Subdivision Standards. The individual developers
and businesses will be responsible infrastructure improvements
that are directly related to individual site development.

Streets, street lighting, water facilities, sewers, and storm
water drainage facilities exist throughout the developed portion
of the Annexation Area. The developer of the rest of the
Annexation Area will be responsible for seeing that similar
infrastructure improvements are provided to the remaining vacant
parcels as the light industrial park develops.
IV. PROVISION OF CITY SERVICES
A. Public Works
No additional expenditure of funds by the City will be required
to provide capital improvements due to the fact that the
Industrial Park's developer will be providing street
construction, street lighting, sewer, water, and storm water
drainage facilities throughout the Annexation Area.
The proposed streets represent less than one percent (1%) of the
City's current road system and can be easily maintained with
existing personnel and equipment without additional expenditure
of money.
The existing wastewater treatment and collection systems can
provide service to the proposed area without any additional
expenditures by the City. The existing water system is adequate
and currently available to the Annexation Area and no additional
expenditures of money are necessary to serve the Annexation
Area. These services shall be furnished to the Annexation Area
immediately upon the effective date of the annexation.

which are located at 1616 Portage Avenue, approximately 2.3 miles
from Station 11. Response times will be comparable to other

APPROVE FINANCING AGREEMENT, CHANGE ORDER NOS. 1 & 2, INSTALLMENT
PAYMENT AGREEMENT - CONTRACT - IBM COMPUTERS
Mr. John E. Leisenring, Deputy City Controller, advised that
submitted to the Board for approval were the above referred to
documents related to the City's purchase of computer equipment
from IBM.
Mr. Leisenring explained that the Financing Agreement is for
additional software for communication lines and is part of the
original bid. He noted that the cost for this equipment is
$40,908.00 which will add $736.00 a month to the City's payment.
Mr. Leisenring reminded the Board that they will be receiving
more documents as more equipment is added to the computer
system. He noted that equipment is not being purchased any
quicker than it can be put on line.
Mr. Leisenring informed the Board that Change Order #1 allows the
City to use some of its existing equipment from the old system.
The equipment to be used includes current terminals and a
printer. He stated that it was discovered that some of the
existing equipment could be used and therefore the cost of the
contract could be reduced.
Change Order #2 is to add equipment in order to set-up training
facilities in the Water Works. Mr. Leisenring noted that this
equipment will be part of the overall system.
Finally, the Installment Payment Agreement reflects an addition
of $34,154.00 to the price of equipment the City has purchased.
Ms. Humphreys made a motion that the documents submitted in
regards to the IBM computer system and outlined above be approved
and executed. Mrs. DeClercq seconded the motion which carried.

Mrs. DeClercq advised that the Board is in receipt of Railroad
Agreements as submitted by Mr. R. E. Wheeler, Area Engineer,
Division of Local Assistance, Indiana Department of
Transportation, 100 North Senate Avenue, Room 1101, Indianapolis,
Indiana, in regards to the above referred to locations.
Therefore, Mrs. DeClercq made a motion that the Agreements be
approved and executed. Ms. Humphreys seconded the motion which
carried.
APPROVE NEONATAL AMBULANCE LEASE AND STAFFING AGREEMENT
MEMORIAL HOSPITAL
In a letter to the Board, Fire Chief Luther Taylor submitted a
renewal Neonatal Ambulance Agreement between the City and
Memorial Hospital. Chief Taylor stated that this Agreement has
been in operation by the South Bend Fire Department for
approximately one (1) year and is working fine for the City and
the hospital. He also noted that during this past year, the
Department responded to approximately one hundred fifty-five
(155) calls with this specialized unit, which was within their
projections. After evaluating the revenue generated from this
unit, Chief Taylor stated that he believes it to be to the City's
advantage to continue this Agreement.
It is noted that the Agreement, which shall be in effect until
December 31, 1991, reflects a ten per cent (10a) increase over
the previous Agreement and indicates that Memorial Hospital shall
pay to the City the sum of $3,025.00 per month to assure
adequate staffing to meet the lowest possible response time.
Therefore, Mrs. DeClercq made a motion that the Agreement as
submitted be approved and executed. Ms. Humphreys seconded the
motion which carried.
APPROVE CHANGE ORDER NO. 2 - VIEWING PARK PROJECT
Mrs. DeClercq advised that Kaser-Spraker Construction, Inc., P.O.
Box 3605, South Bend, Indiana, has submitted Change Order No. 2
indicating that the Contract amount be decreased by $1,031.00 for
a new Contract sum including this Change Order in the amount of
$296,868.00. Upon a motion made by Ms. Humphreys, seconded by
Mrs. DeClercq and carried, the Change Order as submitted was
approved and executed.
APPROVE PROJECT COMPLETION AFFIDAVIT - NILES AVENUE PHASE II
PROJECT
Mrs. DeClercq advised that Walsh & Kelly, Inc., 24358 State Road
23, South Bend, Indiana, has submitted the Project Completion
Affidavit for the above referred to project indicating a final
cost of $400,558.06. Also submitted was the required three (3)
year Maintenance Bond. Mrs. DeClercq made a motion that the
Project Completion Affidavit be approved and executed and the
Maintenance Bond be accepted for filing. Ms. Humphreys seconded
the motion which carried.
APPROVE REQUEST OF THE SOUTH BEND REDEVELOPMENT COMMISSION THAT
THE BOARD OF PUBLIC WORKS ACT AS ITS REPRESENTATIVE FOR THE

APPROVE REQUEST OF RILEY HIGH SCHOOL MARCHING BAND TO CONDUCT
MARCH_-A-THON - SEPTEMBER 22, 1990
Mrs. DeClercq advised that the appropriate City departments and
bureaus have reviewed the above referred to request which was
submitted to the Board on September 10, 1990, and approval is
recommended. Therefore, Mrs. DeClercq made a motion that the
request be approved. Ms. Humphreys seconded the motion which
carried.
APPROVE TRAFFIC CONTROL DEVICES
Upon a motion made by Ms. Humphreys, seconded by Mrs. DeClercq
and carried, the following three (3) traffic control devices were
approved:

FILING OF ENVIRONMENTAL CLEAN-UP OF LOTS REPORTS
Two (2) reports from the Department of Code Enforcement
indicating a total of forty (40) City -owned and miscellaneous
properties cleaned from September 4, 1990 to September 7, 1990,
and thirty (30) other properties cleaned from September 4, 1990
to September 7, 1990, were submitted. Upon a motion made by Mrs.
DeClercq, seconded by Ms. Humphreys and carried, the reports as
submitted were filed.
FILING OF HUMANE SOCIETY MONTHLY REPORT - AUGUST
Mrs. DeClercq advised that the Board is in receipt of the monthly
report for the month of August as submitted by the Humane Society
of St. Joseph County, IN, Inc. Mrs. DeClercq noted that the
report indicates the number and types of animals handled for the
City of South Bend. Mrs. DeClercq made a motion that the report
as submitted be accepted for filing. Ms. Humphreys seconded the
motion which carried.
APPROVE CLAIMS
Mr. Juan Manigault, Executive Director, Employment & Training
Services of St. Joseph County, submitted a list containing eighty
(80) claims and recommended approval. Additionally, Chief Deputy
Controller John D. Leisenring, submitted Claim Docket No. 13619
through 13839 and No. 13892 through 14169 and recommended
approval. Upon a motion made by Ms. Humphreys, seconded by Mrs.
DeClercq and carried, the claims were approved and the reports as
submitted were filed.
PRIVILEGE OF THE FLOOR:
POLITICAL SIGNS IN THE PUBLIC RIGHT-OF-WAY
Mrs. Patricia E. DeClercq, Director, Department of Code
Enforcement, again sent a message to the general public
requesting that political or other type of signs not be placed in
the public right-of-way or treelawn areas but should be placed on
private property.
