Dear Mr. Danch:
The Board of Public Works, at its meeting held on September 13, 2016, approved your request
for the installation of a 15' 5" x 36" sign to project 55" into the right-of-way sign at the Comer
of Main Street and Washington Street on the JMS Building. This encroachment was approved
subject to the improvements not becoming a safety hazard and meeting the requirements and
approval from Design Review Committee for the South Bend Central Redevelopment Design
Area. Enclosed please find a copy of the permit.
The encroachment will be permitted to remain and continue until such time as the Board of
Public Works of the City of South Bend shall determine that such encroachment is in any way
impairing or interfering with the highway or with the free and safe flow of traffic thereon.
Said encroachment shall not in any way prejudice or preclude the City's rights with respect
to the future use of that portion of the right-of-way.

The encroachment will be permitted io remain and continue under the following terms and conditions:
1) Until such time as the BOARD OF PUBLIC WORKS (BOARD) of the CITY OF SOUTH BEND (CITY) shall
determine that such encroachment is in any way impairing or interfering with the highway or with the free and safe flow
of traffic thereon;
2) Said encroachment shall not in any way prejudice or preclude the CITY'S rights with respect to the future use of the
portion of fire right-of-way;
3) The encroachment as it now exists shall in no manner be added to or enlarged in its present scope or dhmensions;
4) In the event of change of ownership of the fixture or any other item of personal property which constitutes the aforesaid
encroachment, this permit shall become null and void;
5) The CITY shall not be liable to APPLICANT for any damages caused to APPLICANT that arise out of or is incidental to
any activity and/or incidences authorized bythis permit;
6) In consideration of the granting of this Permit by the BOARD, APPLICANT shall indemnify, bold harmless and defend
tine CITY from and against any and all actions or causes of action which the CITY may suffer or incur by reason of
bodily injury, including death, to any person or persons, or by reason of damage to or destruction of any property,
including the loss thereof, arising out of or in any manner connected with any activity and/or incidences authorized by
this permit and/or any activities and/or incidences incidental thereto, or which the CITY may sustain or incur in
connection with any litigation, investigation, or other expenditures incidental thereto, .including any suit instituted by the
CITY to enforce the obligation of this agreement of indemnity.
It is the intent of the parties hereto that the APPLICANT shall indemnify the CITY under this indemnification clause to
the fullest extent permitted by law, except that APPLICANT shall not indemnify CITY for any damage or expense
caused by the sole negligence of the CITY,
This approval shall be binding upon everyone past or present, claiming any interest in and to the aforementioned encroachment.

RE: Request for approval of an encroachment for a projecting sign
for 106 N. Main Street, JMS Building,
South Bend, Indiana:
Dear Mr. Horvath:
August 12, 2016
Please accept this letter as our written request on behalf of our clients, JMS Development LLC and
Centier Bank, to ask for approval of an encroachment easement for a proposed "projecting sign" at the
JMS Building, 106 North Main Street, South Bend, Indiana.
JMS Development LLC, is the present owner of the JMS Building. The properly is zoned CBD —
Central Business District under the City of South Bend Zoning Classifications. JMS Development LLC is
in negotiations to lease office space to Centier Bank at the JMS Building. As part of the proposed lease
agreement, Centier Bank desires to have two (2) signs placed on the exterior of the JMS Building to
identify their location at 106 North Main Street for their patrons. The two signs consist of a proposed
"projecting" Blade sign to be placed at the southwest corner of the JMS Building. This proposed
projecting sign would be oriented to be seen from both Main Street and Washington Street. It would be
attached to the existing building with metal brackets. This projecting sign would encroach into the public
right-of-way of both Main Street and Washington Street. There will be a minimum 10 feet of clearance
between the bottom of the sign frame and the top of the public sidewalk. This projecting sign would
contain internally illuminated channel lettering.
The proposed signage meets the development standards for signs under the present zoning
classification for the "CBD" Central Business District for the City with approval from the City of South
Bend Board of Public Works for the proposed projecting sign encroaching into the public right-of-way.
Based on the Design Guidelines for signage in the South Bend Central Development Area, the two
(2) proposed signs for Centier Bank would require approval of Waivers for their location, type and size.
More specifically the following is being requested:
A). Proposed "projecting" Blade sign:
1. Approval by the Board of Public Works to allow for an encroachment easement for the proposed
"projection sign" which would have a maximum projection from the building fagade of 55 inches. This
would keep the projection sign a minimum of 13.5 feet from the edge of the curbing from Main Street
and 13 feet from the curbing of Washington Street.

Attached with this encroachment request is a photo of the proposed projecting sign and a diagram
showing the distance of the sign from the back of curbing for both Main Sheet and Washington Street.
If approved, the owner would per the City requirements sign the necessary hold harmless documents
for the encroachment easement.
