The regular meeting of the Board of Public Works was convened at 9:35 a.m. on Monday,
December 19, 1994, by Board President John E. Leszczynski, with Mr. Leszczynski, Mr. James R.
Caldwell and Mrs. Jenny Pitts Manier present. Board Attorney Anne Bruneel was not present.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, the minutes of the
regular meeting of the Board held on December 12, 1994, were approved.
AGENDA ITEMS STRICKEN
Upon a motion made by Mr. Leszczynski, seconded by Mr. Caldwell and carried, agenda items to
request to advertise for receipt of bids for the Water Works Building at 125 W. Colfax and to
approve the title sheet for same were stricken from the agenda.
PUBLIC HEARING - ADOPTION OF RESOLUTION - LEASE PROPERTY AT 937 SOUTH
BEND AVENUE FOR A PARTNERSHIP CENTER
Mr. Leszczynski advised that this was the date set for the Board's Public Hearing concerning the
lease of property at 937 South Bend Avenue and the necessity of said lease for a Partnership Center.
Mr. John Broden, Assistant City Attorney, was present, and recommended approval of the Lease.
There being no one else present wishing to address the Board concerning this matter, the Public
Hearing was closed.
Therefore, upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, Resolution
No. 43-1994 was adopted and the lease approved.
RESOLUTION NO.43-1994
A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY
OF SOUTH BEND, INDIANA, DECLARING ITS INTENT TO LEASE
THE PROPERTY AT 937 SOUTH BEND AVENUE, SOUTH BEND, INDIANA,
FOR USE AS A NEIGHBORHOOD PARTNERSHIP CENTER
WHEREAS, the City of South Bend is desirous of establishing several Neighborhood
Partnership Centers in order to build stronger neighborhoods by bringing municipal and community
services directly to the neighborhoods; and
WHEREAS, the property at 937 South Bend Avenue, South Bend, Indiana, has been
selected as a site for a Neighborhood Partnership Center; and
WHEREAS, this property at 937 South Bend Avenue, South Bend, Indiana, contains
approximately 1,500 square feet, an area sufficient to accommodate the activities for which the
Neighborhood Partnership Center is intended; and
WHEREAS, the Board of Public Works of the City of South Bend, Indiana, on December
19, 1994, received a petition ("Petition") signed by at least fifty (50) taxpayers of the City of South
Bend, Indiana, requesting that the Board lease the premises at 937 South Bend Avenue, for a term
of one year, with an annual rental not to exceed Seven Thousand Two Hundred and Ninety -Nine
Dollars and Ninety -Six Cents ($7,299.96); and
WHEREAS, the Board also received, on December 19, 1994, a certificate of the St. Joseph
County Auditor, certifying that the verifier of the Petition and at least fifty (50) of the signatories
of the Petition are taxpayers of property located within the corporate limits of the City of South
Bend; and

WHEREAS, the Board also received, on December 19, 1994, a proposed lease agreement
("Proposed Lease") concerning the lease of the premises as petitioned; and
WHEREAS, I.C. 36-1-10-7(2) requires, that prior to the Board's entering into a lease
agreement for said premises, that the South Bend Common Council, after investigation, determine
the lease of the premises is needed.
NOW THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of Sout
Bend, Indiana as follows:
1) That the Board of Public Works of the City of South Bend, Indiana, hereby expresses
its desire and intent to lease the premises at 937 South Bend Avenue, South Bend, Indiana, for its
use as a Neighborhood Partnership Center.
2) That the Petition, as certified by the St. Joseph County Auditor and submitted to the
Board on December 19, 1994, is hereby accepted for filing and made available for public inspection.
3) That the lease of the premises shall be for a term of one (1) year with an annual rental
not to exceed Seven Thousand Two Hundred and Ninety -Nine Dollars and Ninety -Six Cents
($7,299.96).
4) That the Proposed Lease is for the premises submitted to the Board on December 19,
1994, is hereby accepted for filing and made available for public inspection.
5) That the Board directs and authorizes that a Resolution be filed with the South Bend
Common Council with the City Clerk for consideration by the Common Council of the City of South
Bend, Indiana, a form of Resolution to establish, after investigation and consideration, its
determination that the lease of the premises described herein is needed.
6) That a public hearing on the proposed lease is hereby set for December 19, 1994, at
9:30 a.m. in the Board of Public Works Meeting Room, 1308 County -City Building, South Bend,
Indiana, 46601, at which hearing all persons desiring to be heard will be given the opportunity to
address whether the Proposed Lease is necessary and whether the proposed rental is fair and
reasonable.
7) That this resolution will be in full force and effect from and after its passage by the Board.

PUBLIC HEARING - TRANSIENT MERCHANT LICENSE - MICHIANA SPORT TRAVEL &
BOAT SHOW
Mr. Leszczynski advised that this was the date set for the Board's Public Hearing concerning an
application for Transient Merchant License for the Michiana Sport Travel & Boat Show, as
submitted by Mr. Melvin E. Wood, 326 North Victoria, Mishawaka, Indiana. The event is to take
place on February 3, 1995, from 3:00 p.m. to 9:00 p.m.; February 4, 1995, from 10:00 a.m. to 9:00
p.m.; and February 5, 1995, from 10:00 a.m. to 5:00 p.m., at the Century Center. Further, Mr.
Leszczynski noted that favorable recommendations have been received by the Building
Commissioner, the Police Department, Legal Department, and the Fire Department.

Mr. Melvin Wood was present, and stated that this show will be conducted to sell boats, fishing
tackle, outdoor equipment and services. There being no one else present wishing to address the
Board concerning this matter, the Public Hearing was closed.
Therefore, upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, the License
Application was approved.
OPENING OF BIDS - SOUTH BEND DAM CANOE PORTAGE & PARKS REPAIR - PROJECT
NO.94-67
This was the date set for receiving and opening of sealed bids for the above referred to project. The
Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News
which were found to be sufficient. The following bids were opened and publicly read:

APPROVE CONSTRUCTION CONTRACT - 512 ECLIPSE PLACE - INTERIOR ALTERATION
AND ENTRANCE RAMP - ZIOLKOWSKI CONSTRUCTION
Mr. Leszczynski advised that in accordance with the bid awarded on December 5, 1994, to
Ziolkowski Construction, Inc., Post Office Box 1106, South Bend, Indiana, in the amount of
$24,651.00 for the above referred to project, a Contract in said amount was being submitted for
Board approval. Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the
Contract was approved and the appropriate Certificate of Insurance, Performance Bond and Labor
and Materials Payment Bond as submitted were filed.
APPROVE AGREEMENT FOR FEASIBILITY STUDY - ACCESS FROM U.S. 31 TO NIMTZ
PARKWAY - COLE ASSOCIATES
Mr. Leszczynski advised that the Board is in receipt of an Agreement for a feasibility study between
Cole Associates, 2211 East Jefferson Boulevard, and the City of South Bend. It is noted that this
Agreement is in the amount of $17,545.00. Therefore, upon a motion made by Mr. Leszczynski,
seconded by Mr. Caldwell and carried, the Agreement was approved and executed.
APPROVE AGREEMENTS FOR ELECTRICAL SERVICE FOR STREET LIGHTING - F. JAY
NIMTZ PARKWAY - PHASE II - I&M ELECTRIC CO.
Mr. Leszczynski advised that the Board is in receipt of Agreements for electrical service between
Indiana Michigan Power Company, and the City of South Bend, at 3400 F. Jay Nimtz Parkway.
The Agreements are to provide electricity to the two points of service along F. Jay Nimtz

Parkway in the second phase, between Mayflower Road and Kenmore Street. The lighting system
is owned by the City, and the City's Bureau of Traffic and Lighting will perform all the maintenance.
The electricity will be metered and charged on Tariff SLCM (Street Lighting, Customer -Owned,
Metered). Therefore, upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and
carried, the Agreements were approved and executed.
PROGRAM - PHASE 1 -DIVISION OF EQUIPMENT AND PURCHASING SERVICES
Mr. Leszczynski advised that the Board is in receipt of a Proposal for the development of a
comprehensive Environmental Management Program between Triad Engineering Inc., 4410
Executive Boulevard, Fort Wayne, Indiana, and the City of South Bend. It is noted that this Proposal
is in the amount of $28,500.00. It is further noted that services to be provided include developing
a program that will identify, quantify, and respond to the environmental risks associated with
materials, processes, and equipment. Therefore, upon a motion made by Mr. Caldwell, seconded
by Mrs. Manier and carried, the Proposal was approved and executed.
APPROVE CHANGE ORDER - EDISON WATER TREATMENT PLANT - MADDOX
INDUSTRIAL CONSTRUCTION
Mr. Leszczynski advised that Mr. John Stancati, Director of Water Works, has submitted Change
Order No. 1 indicating that the Contract amount be decreased $1,820.00 for a new Contract sum
including this Change Order in the amount of $2,420,180.00. Upon a motion made by Mr. Caldwell,
seconded by Mrs. Manier and carried, the Change Order was approved.
APPROVE CHANGE ORDER - COLLEGE FOOTBALL HALL OF FAME
Mr. Leszczynski advised that Mr. R.A. Dieringer, Verkler, Inc., 4406 Technology Drive, South
Bend, Indiana, has submitted the following Change Orders, and recommended approval.
Reinke Construction Increase $ 290.46 New Contract Sum $367,014.46
Reinke Construction Increase $ 378.01 New Contract Sum $367,392.47
Colip Electric Corp. Increase $11,452.00 New Contract Sum $530,485.00

Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the Change Orders
were approved as outlined above.
AWARD BID - POLICE DEPARTMENT RADIO UPGRADE
Mr. Allan W. Miller, Director, Bureau of Communications, advised the Board that on October 17,
1994, bids were received and opened for the above referred to equipment. After reviewing those
bids, Mr. Miller recommends that the Board award the contract to Shearer Communications, Inc.,
South Bend, Indiana the amount of $91,902.00. It is noted that Shearer Communications, Inc. was
not the lowest bidder. The bids of D&L Communications, 3512 Cavalier Drive, Fort Wayne,
Indiana, and J&K, 2225 S. Tower View Drive, Columbia City, Indiana, the low and second -low
bidders, fail to meet specifications in several respects. The following conclusions were provided to
the Board:
Recommendation:
1. Reject J & K's bid as their equipment does not meet all published specifications, with no
exceptions requested, and it is felt the system bid will not meet requirements for public safe
use.
2. Reject D & L's bid as their equipment does not meet all published specifications, with no
exceptions requested, and the satellite receivers that were bid will probably be discontinued
the first quarter of 1995.
3. Both ERS and Shearer's proposals utilized identical equipment which met all
published specifications without exceptions.

4. Shearer Communications was lower in pricing than ERS.
Therefore it is recommended that the acceptance of Shearer Communications bid be accomplished.
D & L Communications
Although the lowest bid, not all of the equipment bid totally met all the published specifications.
There are specifications that were not met for the following bid items:
Repeater, both transmitter and receiver
Voting system
Satellite receivers
We requested full equipment specifications in order to compare published specifications of the bid
against the bid equipment. We have requested D&L to compare their equipment specifications
against the bid specifications and provide, line for line, confirmation of each specification. All
information received has been used for this discussion and evaluation. May it be noted that not all
equipment specifications requested were available. Equipment'Specification Sheets' received have
had conflicting statements when excerpts from the actual technical manual for the equipment were
compared. On the specification page in the technical manual provided, it states to refer to the
appropriate 'Specification Sheet' for complete specifications. In view of this, we have used the
Specification Sheets only when information was not available in the equipment specifications from
the actual technical manual for the equipment.
The following items are of specific and serious concern:
It is noted that 2 of the 4 main modules in the repeaters are not repairable by us nor D&L, and
therefore are required to be sent to the manufacturer for repairs and/or replacement. A fifth module,
the System Module which controls all functions of the repeater, is not repairable and must be
replaced if it fails. This information was provided by D&L. This means that, although we are a self -
maintained user, we will have to rely on the manufacturer to accomplish all repairs on these modules
for the life of the equipment.
The model of receiver bid for the satellite receivers is to be discontinued, most likely, in the first
quarter of 1995. This information was provided on 12 December by Pete Lascell, technical specialist,
of EGE. Additionally, Betty Wheeler, in the office of the Product Manager for EGE, advised the
replacement equipment is available and has a 4 to 6 week delivery time.
Thus, we would be purchasing equipment already out of manufacture at the time of delivery.
Additionally, most manufacturers of this type of equipment only maintain replacement parts for
discontinued products for a period of approximately 7 years. Our experience with this equipment
manufacturer, on replacement parts for discontinued products, has shown a trend for increased prices
(upwards of 150% or more) to waits in excess of 3 months if the part or parts is still listed as
available.
The voting comparator receiver card in this system is of the same design as of our present 22 year
old system, although the actual components have been updated. The power supply module is
identical to our present system power supply. The specified power output of the repeater with in -
cabinet duplexer is necessary to meet licensed effective radiated power ensuring adequate rf
penetration into buildings and structures. Unit bid would provide approximately 83% of
specification. The specifications for spurious emissions and rejections, EIA selectivity, and EIA
desensitivity is to ensure the minimum amount of interference to and from the repeater and loss of
receiver sensitivity. The specifications for voter timing is to ensure the fastest available activation
of the voter to ensure any transmitted unit identification data is not clipped and/or lost. To a-&w
that proper voting occurs between the co -located and remote receivers, a voice frequency filter may

be required. This filter provides circuitry designed to equalize the frequency response of the receiver
co -located with the voter, to the frequency response of the remote receivers to ensure that the best
audio is selected for transmission. The specifications for audio response, wireline output, and
equalization are to ensure adequate audio levels and audio quality are provided to compensate for
telephone line losses and variations.
J&K:
Although the second lowest bid, not all of the equipment bid totally met all the published

The repeater bid is not programmable for the transmitter frequency. This specification is necessary
to ensure the availability and flexibility to exchange a high priority repeater with a lower priority
repeater in the case of a major failure with out changing repeater components. The specified power
output of the repeater with in -cabinet duplexer is necessary to meet licensed effective radiated powe
ensuring adequate rf penetration into buildings and structures. Unit bid would provide approximately
91% of specification. The specifications for spurious emissions and rejections, EIA selectivity, and
EIA desensitivity is to ensure the minimum amount of interference to and from the repeater and loss
of receiver sensitivity.
The specification for ferro-resonant power supply is to provide maximum possible built in protection
from power surges without loss of operations. The specifications for voter timing is to ensure the
fastest available activation of the voter to ensure any transmitted unit identification data is not
clipped and/or lost. The voting system that was bid is designed to accommodate up to four receivers
per voter card. This design allows for up to 32 receivers per system. Our system which has only 6
receivers would use only two voter cards.
Hence, the loss of one of the two cards, that would make up our system, would be cause for the loss
of up to two-thirds of the receivers at once. The desirability of individual receiver cards is that with
the failure of a card, only one remote receiver is lost. The loss of multiple receivers simultaneously
in this public safety application could jeopardize police officer safety and is deemed unacceptable.
To ensure that proper voting occurs between the co -located and remote receivers, a voice frequency

Although the second highest bid, all of the bid equipment met or exceeded the published
specifications. Specification information was forth coming as it was requested. Equipment
submitted will be in manufacture for some time to come as per communications between the
manufacturer and us. The overall design must meet or exceed the minimum specifications described
utilizing state-of-the-art equipment appropriate for the requirements of these systems. Exceptions
to the requirements must be stated and an explanation shall be made for each exception, giving in
detail the extent of the exception and the reason the exception is taken. The following is chart

Therefore, upon a motion made by Mr. Leszczynski, seconded by Mr. Caldwell and carried, the bid
was awarded to Shearer Communications, as outlined above.
FAVORABLE RECOMMENDATION - PETITION TO VACATE TWO ALLEYS
Mr. Leszczynski indicated that the Common Council has submitted to the Board a Vacation Petition
as completed by Mr. Dick Rohde, South Bend Transportation Corporation, 901 Northside Boulevard,
Bend, Indiana, to vacate the following alleys:
A north/south alley bounded by West South Street on the north and the railroad on the south.
Also a east/west alley bounded by Main Street on the west and Michigan Street on the east:
part situated in Martin and Tutt Addition to the City of South Bend, Indiana.
and
The first and second east/west alley north of E. Pennsylvania Avenue from the east right-of-
way line of S. Fellows Street to the west right-of-way line of S. Rush Street each being a
width of approximately 16 feet and a length of approximately 415.17 feet. Also the first
north/south alley east of S. Fellows Street from the south right-of-way line of E. Wenger
Street to the north right-of-way line of E. Pennsylvania Avenue for a width of approximately
14 feet and a length of approximately 384 feet, excluding the portion that intersects with the
east/west alleys. Part situated in Wenger's Fifth Addition to the City of South Bend.

APPROVE REVISION TO THE 1995 HOLIDAY SCHEDULE
Mr. Leszczynski stated that the Mayor's Office has submitted a revision to the 1995 Holiday
Schedule, which corrects the date of Martin Luther King Day from Monday, January 14, 1995, to
Monday, January 16, 1995. Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell, the
revision was approved.
APPROVE AND/OR RELEASE CONTRACTOR BONDS
Mr. Larry D. Spradlin, Sr., Engineer, Division of Engineering, recommended that the following
Contractor Bonds be approved and/or released as follows:

Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the following

Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, the following

FILING OF ENVIRONMENTAL CLEAN-UP OF LOTS REPORTS
Mr. Leszczynski advised that the Department of Code Enforcement has submitted two (2) lists
containing thirty-three (33) City owned and miscellaneous properties which were cleaned by the
Department from December 5, 1994 to December 8, 1994. Mr. Caldwell made a motion that the lists
as submitted be accepted for filing. Mrs. Manier seconded the motion which carried.

APPROVE CLAIMS
Mr. Kevin Horton, City Controller, submitted claims in the amount of $1,117,698.40 and
recommended approval. Additionally, Mr. Juan Manigault, Executive Director, WDS of Northern
Indiana, submitted one (1) list containing claims in the amount of $68,226.93 and recommended _
approval. Mrs. Ann Kolata, Community and Economic Development, submitted claims for the �.
College Football Hall of Fame and also recommended approval. Mr. Manier made a motion that th
claims be approved and the reports as submitted be filed. Mr. Caldwell seconded the motion which'
carried.
