HomeMy WebLinkAbout12/12/94 Board of Public Works MinutesREGULAR MEETING DECEMBER 12, 1994 The regular meeting of the Board of Public Works was convened at 9:34 a.m. on Monday, December 12, 1994, by Board Member James R. Caldwell, with Mrs. Jenny Pitts Manier present. Board President John E. Leszczynski was not present. Also present was Board Attorney Anne Bruneel. APPROVE MINUTES OF PREVIOUS MEETING AND SPECIAL MEETING Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the minutes of the regular meeting and the special meeting of the Board held on December 5, 1994, and December 6, 1994, respectively, were approved. AGENDA ITEM STRICKEN Upon a motion made Mrs. Manier, seconded by Mr. Caldwell and carried, an agenda item to award bids for radio equipment was stricken from the agenda. PUBLIC HEARING - SALE OF REAL PROPERTY - REAL ESTATE ADJACENT TO ELBEL GOLF COURSE - 51240 REDWOOD ROAD Mr. Caldwell advised that this was the date set for the Board's Public Hearing concerning the sale of Real Property adjacent to Elbel Golf Course. Bids for the above referred to property were opened at this time. Penny Fozo 7613 North Walker Road New Carlisle, Indiana 46552 Ten percent (10%) bid security was submitted BID: $20,000.00 Sandra L. Creager 3324 Hedge Maple Court South Bend, Indiana 46628 Ten percent (10%) bid security was submitted BID: $62,025.00 There being no one else present wishing to address the Board concerning this matter, the Public Hearing was closed. Therefore, upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the above bids were referred to the appropriate Bureaus for recommendation. PUBLIC HEARING - APPLICATION FOR TRANSIENT MERCHANT LICENSE - MICHIANA VALLEY HAMFEST Mr. Caldwell advised that this was the date set for the Board's Public Hearing concerning issuance of a license for transient merchant, as submitted by Mr. Robert L. Denniston, 21970 Kern Road, South Bend, Indiana, to conduct a Michiana Valley Hamfest'95 at the Century Center on Sunday, January 8, 1995, from 8:00 a.m. to 3:00 p.m., for the purpose of the sale of amateur radio and computers. Mr. Caldwell noted that favorable recommendations were received by the Police Department, Fire Department and the Building Department. There being no one present wishing to address the Board concerning this matter, the Public Hearing was closed. Therefore, upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, the application for Transient Merchant License was approved and referred to the Deputy Controller's Office for issuance of a license. OPENING OF BIDS - SOUND SYSTEM AND DIMMING CONTROL SYSTEM - CENTURY CENTER This was the date set for receiving and opening of sealed bids for the above referred to project. The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News which were found to be sufficient. APPROVE CHANGE ORDERS - COLLEGE FOOTBALL HALL OF FAME Mr. Caldwell noted that the Board is in receipt of a letter form Mr. R.A. APPROVE CHANGE ORDER NO 1 (FINAL) AND PROJECT COMPLETION AFFIDAVIT - BLACKTHORN GOLF COURSE WETLAND PLANTINGS Mr. Caldwell advised that Mr. Bob Allen, Public Construction Manager, has submitted Change Order No. 1 (Final) indicating that the contract amount be decreased by $4,032.60 for a new contract sum including this Change Order in the amount of $16,691.40. Additionally submitted was the Project Completion Affidavit indicating this new final cost. Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, Change Order No. 1 (Final) and the Project Completion Affidavit were approved subject to the filing of the appropriate three-year Maintenance Bond. APPROVE REVISION TO CHANGE ORDER - EDISON ROAD - WALSH & KELLY. INC. Mr. Caldwell stated that Mr. Toy Villa, Project Engineer, has submitted for approval, a revision to a Change Order for the above referred to project. The revision was for a Change Order approved on December 5, 1994, which was an increase of $21,740.46. The current Change Order revises the increase to $19,649.10, for a contract sum of $1,713,814.95. Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier, the revision to the Change Order was approved. APPROVE CONTRACT FOR PROJECT REVIEW - COLLEGE FOOTBALL HALL OF FAME Mr. Caldwell advised that the Board is in receipt of a Contract for project review between Merrit & Harris, Inc., 110 East 42nd Street, New York, New York, the City of South Bend, and Fuji Bank. It is noted that this Contract is in the amount of a maximum of $6,000.00. It is further noted that services to be provided include the current status of construction and general conformance to plans and specifications cations; to determine the general level of effectiveness of the development team; and to identify any procedures, areas of management, workmanship or materials which require corrective action. Therefore, upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the Contract was approved and executed. APPROVE ADDENDUM NO. 1 - STAFF SUPPORT CONTRACT - ECONOMIC DEVELOPMENT/CITY OF MISHAWAKA, INDIANA Mr. Caldwell advised that submitted to the Board for approval is Addendum No. 1 to the Agreement for Staff Support Contract, between the City of Mishawaka, Indiana, and the City of South Bend, on behalf of the Economic Development Department. Mrs. Manier advised that this Addendum No. lextends the Mishawaka Staff Support Contract to December 31, 1994. Therefore, upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, this Addendum No. 1 was approved and executed. AWARD BID - DE-ICING MATERIALS Mr. Sam Hensley, Director, Division of Transportation, advised the Board that on November 21, 1994, bids were received and opened for the above referred to materials. After reviewing those bids, Mr. Hensley recommends that the Board award the bids to North American Salt Co., 8300 College Boulevard, Overland Park, Kansas, 66210, for delivery of sodium chloride for their quoted bid price of $31.02, per ton, delivered. Additionally, Mr. Hensley recommends that the board accept the bid of Levy Company, Post Office Box 540, Portage, Indiana, for delivery of calcium chloride slag sand mixture and "all temp" (sodium chloride, calcium chloride and slag sand mixture) for their quoted bid price of $16.70 and $24.25 per ton, delivered. Therefore, Mrs. Manier made a motion that the recommendation be accepted and the bids be awarded as outlined above. Mr. Caldwell seconded the motion which carried. 0.1M0i REGULAR MEETING DECEMBER 12, 1994 AWARD BID - MISCELLANEOUS GOLF COURSE EQUIPMENT BLACKTHORN GOLF COURSE Mr. James Riggs, Department of Community and Economic Development, advised the Board that on December 5, 1994, bids were received and opened for the above referred to project. After reviewing those bids, Mr. Riggs recommends that the Board award the bids as follows: Item Q!y. The course currently owns the Toro Greensmaster 3100. The Jacobsen Reels as bid by Illinois Lawn Equipment do not meet this requirement. Staff recommends that the Board reject Illinois Lawn Equipment's bid for Item G as non -responsive. The following award recommendation is to be the next lowest, responsive and responsible bidder. G Greens Reel w/Groomer 3 Toro 04406 w/ aluminum Wiehle front rollers Kenney Machinery $ 7,260.00 Items A and B are to be delivered to Blackthorn Golf Course within thirty (30) days of receipt of award notice. Items C through G are to be delivered to the course on or about March 1, 1995. This award recommendation represents the following dollar value to the two successful bidders: Illinois Lawn Equipment $30,641.00 Kenney Machinery $42,750.00 Therefore, Mrs. Manier made a motion that the recommendation be accepted and the bids be �awarded as outlined above. Mr. Caldwell seconded the motion which carried. AMEND BID AWARD - FIRE TRUCK W Mr. Caldwell stated that Chief Luther Taylor, South Bend Fire Department, requests approval of the Board to increase the bid award for one (1) 1977 C-F Mack Fire Truck, to Renewed Performance, Post Office Box 196, Tipton, Indiana, by $6,820,00, for a total bid award of $70,134.00. Chief Taylor noted that Renewed Preformance was the only bidder. Further, the reason for the change was the additional cost for the option of front suction on the fire truck. Additionally, the Emergency Medical Services Capital Improvement Fund will be used for the funding in this project. Therefore, upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the bid award was amended and approved. REGULAR MEETING DECEMBER 12, 1994 APPROVE LICENSE APPLICATION - PUBLIC PARKING FACILITY Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the following license application was approved: Memorial Health Care Parking Services Lafayette Street and Bartlett Street South Bend, Indiana The above license application was approved and referred to the Deputy Controller's Office for issuance of a license. It was noted that the required Proof of Insurance as well as the hours and rates to be charged was attached to the application. FILE PETITION FOR RESERVED PARKING AREA Mr. Caldwell stated that the Board is in receipt of a Petition for Reserved Parking Area, as submitted by Ms. Sharon Brown, 5910 Winamac Lake Drive, Apt. 1B, Mishawaka, Indiana. Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the Petition for Reserved Parking Area was referred to the appropriate Bureaus for recommendation. APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE Mr. Caldwell stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Mr. Kevin T. Brugh and Ms. Janice Platz. The Consent indicates that in consideration for permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service to 19856 Jewell Avenue, South Bend, Indiana, (Key # 01-1060-1717), Mr. Brugh and Ms. Platz waive and release any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore, Mr. Caldwell made a motion that the Consent be approved. Mrs. Manier seconded the motion which carried. FAVORABLE RECOMMENDATION - PETITION TO VACATE PUBLIC RIGHT-OF-WAYS Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as completed by Mr. Jon R. Hunt, Director, Department of Community and Economic Development, to vacate the following public right of ways: Keasey Street from Michigan Street to Carroll Street. Some north/south and east/west alleys situated between Michigan Street and Carroll Street, and Ohio Street and vacated Elder Street. All more particularly described as follows. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The purpose of the vacation of the real property is to: Prepare a site for the development of St. Joseph County Juvenile Detention Center. SECTION V. This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. Member of the Common Council Mr. Caldwell noted that there is an error in the legal description on line five (5) of page 600. The legal description reads "...thence east along the north right-of-way line..." The correct call should be west. Mr. Caldwell advised that the Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, Department of Economic Development and the Department of Public Works. Therefore, Mr. Caldwell made a motion that the Board send a favorable recommendation to the Commo Council concerning this Vacation Petition. Mrs. Manier seconded the motion which carried. APPLICATION FOR TRANSIENT MERCHANT - HEIRLOOM IMAGES Mr. Caldwell stated that the Board is in receipt of a request for Application for Transient Merchant License, as submitted by Mr. Roger L. Smith, 8863 E. Black Point Road, Syracuse, Indiana, to conduct an Heirloom Images sale on Sunday, February 19, 1995, from 7:00 a.m. to 6:00 p.m., and Saturday, March 18, 1995, from 7:00 a.m. to 6:00 p.m., at the Century Center, for the purpose of selling new and used home computer equipment, photographic equipment, doll houses and furnishings, and assorted miniatures. Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the application was forwarded to the appropriate Bureaus for recommendation.
