REGULAR MEETING
JANUARY 4, 1994.
The regular meeting of the Board of Public Works was convened at
9:35 a.m. on Tuesday, January 4, 1994, by Board President John E.
Leszczynski, with Mr. Leszczynski, Mr. James R.'Caldwell and Mrs.
Jenny Pitts Manier present. Also present was Assistant City
Attorney Anne Bruneel.
SELECTION OF BOARD PRESIDENT FOR 1994
Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and
carried, Mr. Leszczynski was selected as the Board President for
1994.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and
carried, the minutes of the regular meeting of the Board held on
December 20, 1993, were approved.

The Clerk tendered proofs of publication of Notice in the South
Bend Tribune and the Tri-County News which were found to be
sufficient.
Board Attorney Anne Bruneel advised that Audio Specialists, Inc.,
401 North Michigan Street, South Bend, Indiana, did not sign their
Bid Bond as Principal. Therefore, Mrs. Manier made a motion that
this bid be rejected for insufficiency of the Bid Bond. Mr.
Caldwell seconded the motion which carried.
Additionally, the bid of CBM Computer Center, 1808 East Bristol
Street, Suite G, Elkhart, Indiana, was not signed. Therefore, Mr.
Caldwell made a motion that this bid be rejected. Mrs. Manier
seconded the motion which carried.

Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and
carried, the above bids were referred to the City Controller's
office for review and recommendation.

Mr. Leszczynski advised that this was the date set for the Board's
Public Hearing regarding the application for a Transient Merchants
license for Thomas L. Clarkson, d/b/a TLC Antiques, RR6, Box 188,
Peru, Indiana. It is noted that Mr. Clarkson has applied for this
license in order to conduct an Antique Show at Union Station, 310
West South Street, South Bend, Indiana, from 12:00 noon to 9:00
p.m. on January 14-15, 1994 and from 12:00 noon to 5:00 p.m. on
January 16, 1994.
Mr. Clarkson was present and informed members of the Board that he
is planning to conduct an Antique Show at Union Station. In
response to questions from members of the Board, Mr. Clarkson
advised that this Antique Show has been held at the Union Station
for the past three or four years even though he was not the
promotor at that time. Mr. Clarkson noted that antiques will be
displayed and sold.
There being no one else present wishing to address the Board
concerning this matter and no written Memorandum in support of or
in opposition to the issuance of the license being received, Mr.
Leszczynski closed the Public Hearing on this matter.
It is noted that the Board is in receipt of favorable

recommendations concerning this license application from the
Police Department, Fire Department and the Building Department.
Therefore, Mr. Caldwell made a motion that the application be
approved and referred to the Deputy Controller's office for

ADOPT RESOLUTION NO. 1-1994 - CHANGING THE NAME OF MAPLE ROAD TO
BENDIX DRIVE
It was noted that on December 13, 1993, the Board received a
Memorandum from the Department of Public Works requesting that the
Board approve the change of name of Maple Road to Bendix Drive.
Maple Road is located between Cleveland Road Extension and Portage
Road, a distance of 1,134 feet. It is further noted that the
various City departments and bureaus have reviewed this request
and approval is recommended. Therefore, Mr. Caldwell made a
motion that the appropriate Resolution which has been prepared in
this regard be approved. Mrs. Manier seconded the motion which
carried and the following Resolution No. 1-1994 was adopted:

A RESOLUTION OF THE BOARD OF PUBLIC
WORKS OF THE CITY OF SOUTH BEND,
INDIANA, CHANGING THE NAME OF
MAPLE ROAD TO BENDIX DRIVE
WHEREAS, Section 18-2 of the South Bend Municipal Code gives
the Board of Public Works "control and supervision of the streets
within the city;" and
WHEREAS, Maple Road is located between Cleveland Road
Extension and Portage Road, a distance of 1134 feet, and is a part
of the City of the City of South Bend; and
WHEREAS, a change of name from Maple Road to Bendix.Drive is
logical since Maple Road follows the alignment of Bendix Drive and
is a physical extension of Bendix Drive to Portage Road; and
WHEREAS, no buildings are presently addressed on Maple Road
and all owners of property abutting Maple Road consent to the name
change to Bendix Drive, which consents have been filed with the
Board; and
WHEREAS, plans are being reviewed by the City for new
commercial buildings on Maple Road; and
WHEREAS, the change of name requested is necessary to reduce
confusion as to the location of the new commercial buildings; and
WHEREAS, the change of name requested will not adversely
affect the health, safety or welfare of the citizens of the City
of South Bend.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works
of the City of South Bend that the name of Maple Road be changed
to Bendix Drive effective immediately.

APPROVE 1994 NEONATAL AMBULANCE LEASE AND STAFFING AGREEMENT -
MEMORIAL HOSPITAL
Submitted to the Board for consideration was a 1994 Neonatal
Ambulance Lease and Staffing Agreement. This Agreement, between
the City and Memorial Hospital of South Bend, indicates that the
South Bend Fire Department will maintain the neonatal ambulances,
which are owned by the hospital and shall be on call for the
operation of the neonatal ambulances twenty-four (24) hours a day,
three hundred sixty five (365) days a year. Memorial Hospital
shall pay to the City a monthly fee of $3,806.66 in 1994,
$3,958.93 in 1995 and $4,117.29 in 1996. Additionally, the
hospital agrees to pay the Department an additional amount for
each transport in the second ambulance. The additional amount per
transport is $119.60 in 1994, $124.38 in 1995 and $129.26 in 1996.
It is noted that this Contract was approved and executed by the
Board of Public Safety at their regular meeting held on December
22, 1993. Therefore, Mr. Caldwell made a motion that this
Contract be approved and executed. Mrs. Manier seconded the
motion which carried.
APPROVE CONTRACT FOR EMERGENCY MEDICAL SERVICES - UNIVERSITY OF
NOTRE DAME - GENERAL MATTERS
Mr. Leszczynski advised that the Board is in receipt of a Contract
for Emergency Medical Services between the University of Notre
Dame and the South Bend Fire Department. The Contract indicates
that the South Bend Fire Department will provide to the University
emergency medical equipment and personnel for the events specified
by the University. The University will pay for the services as
follows:
Advanced Life Support unit staffed with two (2) St.
Joseph County certified paramedics:
$75.00 per hour per unit
Basic Life Support unit staffed with two (2) basic
E.M.T.'s:
$60.00 per hour
Paramedic supervisor to work with the University Control
Team (if requested):
$18.00 per hour
All transports from the specified event to St. Joseph Medical
Center will be billed to the patient per Ordinance No. 8269-92
effective June 19, 1992.
Mr. Caldwell made a motion that the Contract be approved as
submitted. Mrs. Manier seconded the motion which carried.

Ms. Marcia Townsend, Department of Community and Economic
Development, submitted to the Board an Agreement between the City,
by and through the Board of Public Works on behalf of the
Community and Economic Development Department and Neighborhood
Resources and Technical Services, Inc. It was noted that this
Agreement awards to NRTS the sum of $8,176.00 from the Next Door
Neighborhood Program. Mrs. Manier made a motion that this
Agreement be approved. Mr. Leszczynski seconded the motion which
carried. Board member James R. Caldwell abstained from voting on
this Agreement as he is a member of the Neighborhood Resources and
Technical Services Board.

of the property by the City,of South Bend. Therefore, Mr.

The Board is in receipt of a Grant of Easement from the City to
Northern Indiana Commuter Transportation District for the grade
crossing at Bendix Drive. It was noted that NICTD has completed
all of the improvements required by the City for the granting of
this Easement. Therefore, Mrs. Manier made a motion that this
Easement be approved. Mr. Caldwell seconded the motion which
carried.

Mishawaka, Indiana, in the amount of $46,900.00 for the Palais
Royale Building Tenant Space Improvement Project, a Contract in
this amount was submitted for Board approval. Mr. Leszczynski
made a motion that this Contract be approved. Mrs. Manier
seconded the motion which carried.
Additionally, Clean Air Systems, Inc., 23349 State Road 23 West,
South Bend, Indiana, has submitted the appropriate Construction
Contract, in the amount of $11,837.00, for the Asbestos Abatement
at 230-232, 240-242 Chapin and 736 Wayne Street. It is noted that
the Board awarded this bid on December 20, 1993. Mr. Leszczynski
made a motion that this Contract be approved. Mrs. Manier
seconded the motion which carried.
Finally, Warner & Sons, Inc., P.O. Box 87, Elkhart, Indiana,
submitted a Construction Contract for the demolition of structures
at 230-232, 240-242 Chapin and 736 West Wayne Street. The Board
awarded this bid, in the amount of $26,860.00, on December 20,
1993. Mrs. Manier made a motion that this Contract with Warner
and Sons be approved. Mr. Caldwell seconded the motion which

AWARD BID - TWO HUNDRED (200) MORE OR LESS SETS OF FIREFIGHTER
PROTECTIVE CLOTHING INCLUDING COATS PANTS AND SUSPENDERS
Fire Chief Luther Taylor advised that on December 6, 1993, the
Board opened bids for protective clothing for members of the South
Bend Fire Department. After reviewing the bids, the Department
recommends that the Board award the bid of A.A.A. Fire Equipment,
23002 Gardena Place, Elkhart, Indiana, in the amount of
$128,923.12 which includes a two per cent (2%) discount when paid
within twenty (20) days of delivery. Fire Chief Taylor noted that
this bid award includes protective coats and pants, suspenders,
radio pockets and PBI hoods. The total number of protective
clothing to be purchased by the Department is two hundred fifteen
(215) sets. Mr. Leszczynski made a motion that the recommendation
be accepted and the bid be awarded. Mr. Caldwell seconded the
motion which carried.
AWARD _BID _- DEMOLITION - 1424 SOUTH LAFAYETTE (LOT #10
In a Memorandum to the Board, Mr. Carl P. Littrell, Director,
Division of Engineering, advised that on December 20, 1993, the
Board opened seven (7) bids for demolition of buildings in the
Studebaker Corridor. Mr. Littrell noted that he has reviewed the
bids and found the amounts correct as read at the meeting.
Therefore, Mr. Littrell recommended that the Board award the low
bid of W.A. Bailey Construction, 17051 Millpond Trail, Plymouth,
Indiana, in the amount of $9,800.00. Mr. Caldwell made a motion
that the recommendation be accepted and the bid be awarded. Mr.
Leszczynski seconded the motion which carried.
FAVORABLE RECOMMENDATION - VACATION PETITION - 1ST E/W ALLEY N. OF
EAST WASHINGTON AVENUE
Mr. Leszczynski indicated that the Common Council has forwarded to
the Board a Vacation Petition as submitted by Joseph L. Amaral,
Attorney for Petitioners, Hammerschmidt, Amaral & Jonas, 224 West
Jefferson Boulevard, South Bend, Indiana, to vacate the following
alley:
The alley to be vacated is described as the first
east/west alley north of E. Washington Avenue from the
east right-of-way line of N. Frances Street to the west
right-of-way line of the first north/south alley east of
N. Frances Street for a distance of approximately 113
feet and a width of approximately 14 feet. The alley is
located at Cottrel's addition to the City of South Bend,
Indiana.
It is noted that the Petitioners are Troeger, Garcia and Ansari
Building Partnership, 922 West Colfax, South Bend, Indiana and
Duggan Shaffer, 120 North Francis Street, South Bend, Indiana.
Mr. Bill Attibey Pursell, representing Neighborhood Housing
Services, 803 North Notre Dame Avenue, South Bend, Indiana, and
the Northeast Neighborhood Council was present and addressed the
Board concerning this proposed vacation. Mr. Pursell stated that
the area in question is primarily residential and they are
concerned at this time that the alley not be vacated until the
Petitioner receives approval of their rezoning from residential to
commercial.
Mr. Leszczynski advised Mr. Pursell that the Board does not look
at whether or not the alley would cause an undue hardship to the
residents as the Common Council will consider that at their Public
Hearing concerning this proposed vacation.
Mr. Leszczynski advised that the Board is in receipt of favorable
recommendations concerning this Vacation Petition from the Legal

Department, Police Department, Fire Department and Division of
Engineering. However, the Division of Environmental Services has
advised that they recommend against this vacation as the alley is
used as an entry into this and connecting alleys. These alleys
are narrow and difficult for the trash trucks to maneuver into.
Loss of this entry site would make it very difficult to service
the people on these alleys.
Additionally, the Area Plan Commission has indicated that the
Petitioners wish to rezone this parcel to allow the construction
of a parking lot to service an office building located across
North Frances Street. The vacation of the subject alley is needed
to allow enough site area to access the proposed parking spaces.
If the rezoning is not granted there would be no need to vacate
the alley which appears to be used by the residents of this block.
Therefore, the staff of the Area Plan Commission recommends that a
decision on this Petition be tabled until the rezoning issue is
resolved. Also, there appears to be an error in the description
of the alley. The subject alley is not the first east/west alley
north of East Washington Avenue along North Frances Street.
Rather it is the second. There is an unimproved alley located to
the south of the petition area running east 113 feet from North
Frances Street.
The Department of Economic Development has recommended that this
Petition be denied. Mr. Larry Magliozzi, Department of Community
and Economic Development advises that the Petition states that the
vacation of this segment of the alley may not be detrimental to
traffic circulation or to the adjoining properties. What is of
concern is that the vacation of this alley is a prelude to a much
larger, neighborhood land use issue.
Mr. Jack Dillon, Director, Division of Environmental Services,
advised members of the Board that should this alley be vacated it
may become necessary for residents on this alley to switch to curb
side trash pick-up as the trash trucks would have to back-up out
of the alley.
Mr. Caldwell made a motion that the Board send an unfavorable
recommendation to the Common Council concerning this proposed
vacation. Mrs. Manier seconded the motion which carried. Mr.
Leszczynski opposed this motion.

permission to conduct their Annual Traditional March from the
County -City Building to the Century Center. Participants

beginning at 12:00 noon and lasting one (1) hour on the
sidewalk outside the Federal Court Building at the corner of
Jefferson Boulevard and Main Streets. Ms. MacDonell noted
that protestors symbolically call to mind the January 22,
1973 U.S. Supreme Court decision legalizing abortion. Ms.
MacDonell further noted that last year it was necessary to
process around the entire block to remain orderly because of
the volume of people attending. As always, protestors will
be peaceful and prayerful.
APPROVE APPLICATIONS FOR PERMIT - SPECIALIZED COLLECTION SERVICES
Mr. Leszczynski advised that pursuant to the terms of the trash
and rubbish removal ordinance, the Board is in receipt of Permit
applications from private trash haulers who desire to continue
their business within the City. The following eleven (11) Permit
applications have been submitted:

It is noted that attached to each application was a list of
individuals to which these vendors will provide services. It is
also noted that these applicants must still obtain a Rubbish and
Garbage Removal license from the City. Mr. Caldwell made a motion
that these Permit applications be approved. Mrs. Manier seconded
the motion which carried.
APPROVE EXCAVATION BOND
Mr. Larry D. Spradlin, Sr., Divl.sion of Engineering, recommended
that the Board approve the Bond for Excavation in the Streets for
Duane E. & Douglas Tepe, d/b/a `L'epe Excavation, effective January
4, 1994. Mr. Leszczynski made a motion that this recommendation
be accepted and the Bond be approved. Mr. Caldwell seconded the
motion which carried.
FILING OF ENVIRONMENTAL CLEAN-UP OF LOTS REPORTS
Mr. Leszczynski advised that the Department of Code Enforcement
has submitted four (4) lists containing sixty-nine (69) City owned
and miscellaneous properties which were cleaned by the Department
from December 13, 1993 to December 24, 1993. Mr. Leszczynski made
a motion that the lists as submitted be accepted for filing. Mr.
Caldwell seconded the motion which carried.

FILING OF HUMANE SOCIETY MONTHLY REPORT - NOVEMBER 1993
Mr. Leszczynski indicated that the Board is in receipt of the
monthly report as submitted by the Humane Society of St. Joseph
County, Inc., for the month of November, 1993. The report
indicates the type and number of animals handled for the City of
South Bend. Mr. Leszczynski made a motion that the report be
accepted for filing as submitted. Mr. Caldwell seconded the
motion which carried.
FILING OF CERTIFICATES OF INSURANCE
Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and
carried, Certificates of Insurance for LaFree Excavating, Inc.,
1251 West Third Street, Osceola, Indiana and Industrial
Installations, Inc., 55587 Currant Road, Mishawaka, Indiana 46545
were accepted for filing.
APPROVE CLAIMS
Mr. Kevin Horton, City Controller, submitted claims in the amounts
of $681,365.32 and $1,892,254.53 and recommended approval.
Additionally, Mr. Juan Manigault, Executive Director, WDS of
Northern Indiana, submitted a list containing claims in the amount
of $20,174.41 and recommenced approval. Mrs. Manier made a motion
that the claims be approved and the reports as submitted be filed.
Mr. Leszczynski seconded the motion which carried.
