REGULAR MEETING AUGUST 7 1995
The regular meeting of the Board of Public Works was convened at 9:32 a.m. on Monday, August
7, 1995, by Board President John E. Leszczynski, with Mr. Leszczynski and Mr. James R. Caldwell
present. Board Member Jenny Pitts Manier was not present. Also present was Board Attorney Anne
Bruneel.
AGENDA ITEMS ADDED
Upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, Agenda items for
an Agreement, Traffic Control Devices, and a Request to Advertise for the Receipt of Bids was
added.
AGENDA ITEM STRICKEN
Upon a motion made by Mr. Leszczynski, seconded by Mr. Caldwell and carried, the Agenda item
for a Staff Support Agreement was stricken from the Agenda.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Mr. Leszczynski, seconded by Mr. Caldwell and carried, the minutes of the
regular meeting of the Board held on July 31, 1995, were approved.
OPENING OF BIDS - SALE OF CITY OWNED PROPERTY - 1039 LASALLE COURT
This was the date set for receiving and opening of sealed bids for the above referred to property. The
Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News

It was noted that the bid received from GranDesign, 1352 Lincolnway East, South Bend, Indiana,
was rejected, as no bid bond was included. Upon a motion made by Mr. Caldwell, seconded by Mr.
Leszczynski and carried, the bid was rejected.
Upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the above bids
were referred to Mr. Bernard Kish, College Football Hall of Fame, for review and recommendation.
AWARD BID - WASHINGTON AVENUE AT CIRCLE AVENUE IMPROVEMENTS -
PROJECT NO.95-63
Mr. Carl P. Littrell, Director, Division of Engineering, advised the Board that on July 31, 1995, bids
were received and opened for the above referred to project. After reviewing those bids, Mr. Littrell
recommends that the Board award the contract to the lowest bidder, Kaser-Spraker Construction,
Inc., 25487 W. State Road 2, South Bend, Indiana, in the amount of $14,777.00. Therefore, Mr.
Caldwell made a motion that the recommendation be accepted and the bids be awarded as outlined
above. Mr. Caldwell seconded the motion which carried.
AWARD BID - TWO (2) TWO TON VIBRATORY ROLLERS
Mr. Matthew Chlebowski, Director, Division of Equipment Services, advised the Board that on July
24,1995, bids were received and opened for the above referred to equipment. After reviewing those
bids, Mr. Chlebowski recommends that the Board award the contract to the low bidder, Deeds

Equipment Company, 8015 East 45th Street, Lawrence, Indiana, in the amount of $19,670.00.
Therefore, Mr. Caldwell made a motion that the recommendation be accepted and the bid be
awarded as outlined above. Mr. Leszczynski seconded the motion which carried.
AWARD BID - ONE (1) ALLEY MAINTAINER
Mr. Matthew Chlebowski, Director, Division of Equipment Services, advised the Board that on July
24, 1995, bids were received and opened for the above referred to equipment. After reviewing those
bids, Mr. Chlebowski recommends that the Board award the contract to the lowest bidder, Deeds
Equipment, 8015 East 45th Street, Lawrence, Indiana, in the amount of $58,302.00. Therefore, Mr.
Leszczynski made a motion that the recommendation be accepted and the bid be awarded as outlined
above. Mr. Caldwell seconded the motion which carried.
AWARD BID - 1995 CONCRETE PAVEMENT REPAIRS - PROJECT NO.95-01
Mr. Carl P. Littrell, Director, Division of Engineering, advised the Board that on July 24, 1995, bids
were received and opened for the above referred to project. After reviewing those bids, Mr. Littrell
recommends that the Board award the contract to the low bidder, LaPorte Construction, Post Office
Box 577, Laporte, Indiana, in the amount of $92,992.04. Therefore, Mr. Caldwell made a motion
that the recommendation be accepted and the bid be awarded as outlined above. Mr. Leszczynski
seconded the motion which carried.
APPROVE CONTRACT FOR SERVICES OF ONE (1) ASSISTANT CITY ATTORNEY -
WORKFORCE DEVELOPMENT SERVICES
Mr. Leszczynski advised that the Board is in receipt of a Contract for the services of one (1)
Assistant City Attorney (John Broden) for Workforce Development Services of Northern Indiana
to provide advice and assistance on legal matters relating to the conduct of the WDS. It is noted that
this Contract is for the period of July 1, 1995 through June 30, 1996, and said services will be
available for a fixed fee of $500.00 per month for up to six (6) hours per month and $50.00 per hour
for each hour of assistance per month exceeding six (6) hours per month. Therefore, upon a motion
made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the Contract was approved and
executed.
APPROVE CONTRACT FOR EMERGENCY MEDICAL SERVICES - UNIVERSITY OF
NOTRE DAME FOOTBALL SEASON - 1995
Mr. Leszczynski advised that the Board is in receipt of a Contract for Emergency Medical Services
between the City of South Bend, and the University of Notre Dame for the 1995 football season.
Chief Taylor noted that the Contract includes:
Two (2) Advanced Life Support Units staffed with four (4) certified paramedics,
approved by St. Joseph County hospitals.
$75.00 per hour per unit
2. One (1) Basic Life Support Unit staffed with two (2) certified Emergency Medical
Technicians. This vehicle must be able to successfully pass through the stadium
tunnel onto the playing field.
$60.00 per hour
3. One (1) paramedic supervisor to work with the University control team.
$18.00 per hour
Therefore upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the
Contract was approved and executed.
APPROVAL OF AGREEMENT - ENGINEERING SERVICES - BLACKTHORN SEWER
SERVICE TO LOT 4 OF CORPORATE OFFICE PARK - PROJECT NO. 95-70
Mr. Leszczynski stated that the Board is in receipt of an Agreement between the City of South Bend
and Cole Associates, 2211 East Jefferson, South Bend, Indiana, for engineering services for a master
plan to determine a combination of the least disruptive and most cost effective gravity sewer route
to serve the existing and future parcels of the Blackthorn Corporate Office Park. Mr. Leszczynski

noted that the Agreement is in the amount of $2,900.00. Therefore, upon a motion made by Mr.
Caldwell, seconded by Mr. Leszczynski and carried, the Agreement was approved and executed.
APPROVAL OF AGREEMENT - AUDIT SERVICES FOR GRANTS - CROWE CHIZEK
Mr. Leszczynski stated that the Board is in receipt of an Agreement between the City of South Bend
and Crowe Chizek, 330 East Jefferson Boulevard, South Bend, Indiana, for audit services for the
City of South Bend Department of Community and Economic Development. The audit projects are
for William Richardson Court and Build Indiana Project, and Crowe Chizek proposes to audit the
financial statements of the each of the grants for the specific grant period. Mr. Leszczynski noted
that the Agreement is in the amount of $500.00 to $750.00 per grant. Therefore, upon a motion
made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the Agreement was approved and
executed.
APPROVE CHANGE ORDER NO. 1 (FINAL) AND PROJECT COMPLETION AFFIDAVIT -
STUDEBAKER NATIONAL MUSEUM - TEMPORARY FENCING - PROJECT NO 95-46
Mr. Leszczynski advised that Mr. Carl P. Littrell, P.E., Director, Division of Engineering has
submitted Change Order No. 1 (Final), on behalf of Schuell Fence Company, 22377 Adams Road,
South Bend, Indiana, indicating that the contract amount be increased by $90.00 for a new contract
sum including this Change Order in the amount of $7,390.00. Additionally submitted was the
Project Completion Affidavit indicating this new final cost. Upon a motion made by Mr. Caldwell,
seconded by Mr. Leszczynski and carried, Change Order No. 1 (Final) and the Project Completion
Affidavit were approved subject to the filing of the appropriate three-year Maintenance Bond.
APPROVE CHANGE ORDERS - UNDERGROUND FUEL STORAGE TANKS - PROJECT NO

Mr. Leszczynski advised that Mr. Bob Allen, Manger, Public Construction, has submitted Change
Orders No. 4, 5 and 6, on behalf of Advanced Pollution Technologists, Limited, 3505 North Home
Street, Mishawaka, Indiana, and recommended approval as follows:

REPAIRS - PROJECT NO.95-48
Mr. Leszczynski advised that Mr. Carl P. Littrell, P.E., Director, Division of Engineering, has
submitted Change Order No. 1, on behalf of McDaniel Fire Systems, 1055 West Joliet Road,
Valparaiso, Indiana, indicating that the Contract amount be increased $0.00 for a new Contract sum.
by including this Change Order in the amount of $14,966.00. Upon a motion made by Mr.
Leszczynski, seconded by Mr. Caldwell and carried, the Change Order was approved.
APPROVE CHANGE ORDER - COLLEGE FOOTBALL HALL OF FAME - THEME
SCULPTURE - MUSEUM SERVICES INC.
Mr. Leszczynski advised that Mr. David Fox, Hilferty & Associates, 14240 Route 550, Athens,
Ohio, has submitted Change Order No. CO #2, on behalf of Museum Services, Inc.,1220 SE Veitch
Street, Gainesville, Florida indicating that the Contract amount be increased $851.70 for a new

Contract sum including this Change Order in the amount of $169,109.70. Upon a motion made by
Mr. Caldwell, seconded by Mr. Leszczynski and carried, the Change Order was approved.
APPROVE PROJECT COMPLETION AFFIDAVIT - CHALFANT HEIGHTS ENTRANCE
SIGNS
Mr. Leszczynski advised that Mr. Bob Allen, Public Construction Manager, has submitted the
Project Completion Affidavit, on behalf of MJW Masonry, 62276 Orange Road, South Bend,
Indiana, for the above referred to project, indicating a final cost of $2,800.00. Upon a motion made
by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the Project Completion Affidavit was
approved.
APPROVE PROJECT COMPLETION AFFIDAVIT - STUDEBAKER NATIONAL MUSEUM -
REMOVAL OF LOOSE CEILING MATERIAL - PROJECT NO.95-40
Mr. Leszczynski advised that Mr. Carl P. Littrell, Director, Division of Engineering, has submitted
the Project Completion Affidavit, on behalf of Kaser Spraker Construction, 25487 West State Road
2, South Bend, Indiana, for the above referred to project, indicating a final cost of $40,082.56. Upon
a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the Project Completion
Affidavit was approved.

Mr. Zmudzinski stated that the revisions are necessary because South Bend's Sewer Use Ordinance
has received approval from the Environmental Protection Agency allowing the City to modify the
oil and grease monitoring requirements and limits. Therefore, upon a motion made by Mr.

Leszczynski, seconded by Mr. Caldwell and carried, the Industrial Pretreatment Permit Revisions
were approved.
ADOPT RESOLUTION NO. 55-1995 - EMERGENCY MEDICAL SERVICES OUTSTANDING
ACCOUNTS
Upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the following
Resolution was adopted:
RESOLUTION NO.55-1995
WHEREAS, the City of South Bend, through its Emergency Medical Services Department,
charged the persons on the attached documents for ambulance services; and
WHEREAS, the charges have not been paid to the City of South Bend after at least three
notices were sent to the person who received the services; and
WHEREAS, the Federated Collection Agency has made every attempt to collect the
aforementioned charges, and has not been successful; and
WHEREAS, the Indiana State Board of Accounts has instructed the City to write off all
uncollectible accounts after every attempt to collect them has been made; and
WHEREAS, the City of South Bend by and through its Board of Public Works, desires to
write off the accounts listed on the attached documents;
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works, that the attached
documents totaling $209,594.16 be written off the accounts receivable of the City of South Bend as
uncollectible.

such terms and conditions as the parties agree; and
WHEREAS, the Family & Children's Center Properties Management, Inc. (FCC), is an
Indiana nonprofit corporation and is desirous of acquiring the Real Property from the City so that
FCC may construct a new facility upon the Real Property; and
WHEREAS, the City, through the Board, is desirous of transferring the Real Property to FCC
for a nominal sum so that the Real Property may be used for that purpose; and
WHEREAS, FCC desires to acquire the Real Property free and clear of all structures which
are currently located upon the Parcels; and
WHEREAS, the South Bend Redevelopment Commission has agreed with the City to accept
financial responsibility for the removal of such structures from the Real Property.

Upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the
following Resolution was adopted:

ACCEPTING THE TRANSFER OF REAL PROPERTY
FROM THE SOUTH BEND REDEVELOPMENT COMMISSION
WHEREAS, the City of South Bend, Department of Redevelopment
(Redevelopment), whose governing body is the South Bend Redevelopment Commission
(the "Commission") is the owner of the following described real property situated in St.
Joseph County, Indiana:

desire to transfer the Real Property to the City of South Bend, Indiana; and
WHEREAS, the City of South Bend is desirous of acquiring the Real Property from the
Commission, but only upon the condition that the Commission assume financial responsibility for
removing any structures which may be situated upon any of the Parcels of the Real Property; and

WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend
(the "Board") has custody of and may maintain all real property of the City of South Bend; and
WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend, acting by and through the
Board, may exchange or transfer property with another governmental entity upon terms and
conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical
resolutions of each entity; and
WHEREAS, the Commission has agreed to transfer the Real Property to the City of South
Bend and has agreed to assume financial responsibility for the removal of any structures situated
upon any of the Parcels of the Real Estate, and the City of South Bend, acting by and through the
Board has agreed to accept the transfer of the Real Property from the Commission for the payment
of a nominal consideration.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS

Commission, the Clerk of the Board is hereby authorized and directed to pay to the Commission,
on behalf of the Board, the sum of One Dollar ($1.00) per parcel conveyed and to cause the
recording of said quitclaim deed.
4. That this Resolution shall be in full force and effect upon its adoption.

FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY
Mr. Leszczynski indicated that the Common Council has submitted to the Board a Vacation Petition
as completed by Mr. Steven A. Medich, 420 Cottage Grove Street, South Bend, Indiana, to vacate
the following alley:
the first east -west alley north of W. Oak Street from the east right-of-way line of N. Cottage
Grove Street to the west right-of-way line of the first north -south alley east of N. Cottage Grove
Street for a distance of approximately 111.5 feet and a width of approximately 13.86 feet.
Mr. Leszczynski advised that the Board is in receipt of favorable recommendations concerning this
Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation,
Department of Economic Development and the Department of Public Works. Therefore, Mr.
Caldwell made a motion that the Board send a favorable recommendation to the Common Council
concerning this Vacation Petition. Mr. Leszczynski seconded the motion which carried.
FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY
Mr. Leszczynski indicated that the Common Council has submitted to the Board a Vacation Petition
as completed by John and Nicole Flint, 2002 Carlisle Street, South Bend, Indiana to vacate the
following alley:
the first east -west alley north of W. Delaware Street from the east right-of-way line of S. Carlisle
Street to the west right-of-way line of the first north -south alley east of South Carlisle Street for
a width of 12 feet and a length of approximately 120 feet. Part situated in Highland Park First
Addition to the City of South Bend, St. Joseph County, Indiana
Mr. Leszczynski advised that the Board is in receipt of favorable recommendations concerning this
Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation,
Department of Economic Development and the Department of Public Works. Therefore, Mr.
Caldwell made a motion that the Board send a favorable recommendation to the Common Council
concerning this Vacation Petition. Mr. Leszczynski seconded the motion which carried.
APPROVAL OF RECOMMENDATION - TO CONDUCT BLOCK PARTY
Mr. Leszczynski stated that favorable recommendations have been received by the Division of
Engineering, Police Department and the City Attorney's office, in reference to a request as submitted
by Ms. Juanita Dempsy, Eastside Mender's Organization, 1246 East Howard Street, South Bend,
Indiana to conduct the above referred to block party, on Saturday, August 5, 1995, from 1:00 p.m.
until 12:00 a.m., on Howard Street between 1224 East Howard and 1250 East Howard, and the 1000
block of Duey. Therefore, upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and
carried, the recommendation was approved.
APPROVAL OF RECOMMENDATION - TO CONDUCT BLOCK PARTY
Mr. Leszczynski stated that favorable recommendations have been received by the Division of
Engineering, Police Department and the City Attorney's office, in reference to a request as submitted
by Ms. Barb Dickerson, 1321 Wall Street, South Bend, Indiana to conduct the above referred to
block party, on Saturday, August 12, 1995, from 12:00 p.m. until 12:00 a.m., on Wall Street, from
Twyckenham to Sunnyside. Therefore, upon a motion made by Mr. Caldwell, seconded by Mr.
Leszczynski and carried, the recommendation was approved.
APPROVAL OF RECOMMENDATION - TO CONDUCT BLOCK PARTY
Mr. Leszczynski stated that favorable recommendations have been received by the Division of
Engineering, Police Department and the City Attorney's office, in reference to a request as submitted
by Ms. Sue Guibert, 1332 East Monroe, South Bend, Indiana to conduct the above referred to block
party, on Saturday, August 12, 1995, from 3:00 p.m. until 10:00 p.m., in the 1300-1400 blocks of

FAME GRAND OPENING
In a letter to the Board, Mr. Paul Borowski, College Football Hall of Fame, requested permission
to close several streets on Wednesday, August 23, 1995, beginning at 6:00 a.m. through Saturday,
August 26, 1995, beginning at 6:00 a.m. on the designated list as submitted., in conjunction with the
College Football Hall of Fame Grand Opening Ceremonies.
- TO CONDUCT HOMECOMING PARADE - RILEY HIGH SCHOOL
In a letter to the Board, Assistant Principal Anthony Byrd, Riley High School, 405 East Ewing,
South Bend, Indiana, requested permission to conduct a h homecoming parade, on Friday,
September 22, 1995, beginning a 5:00 p.m., on the designated route as submitted.
APPROVE REQUEST TO ADVERTISE FOR THE RECEIPT OF BIDS- PARTS FOR REBUILD
OF GRIT CHANNEL - PROJECT NO.95-75
In a memorandum to the Board, Mr. Carl P. Littrell, P.E., Director, Division of Engineering,
requested permission to advertise for the receipt of bids for parts for the rebuilding of grit channel.
Mr. Littrell stated that this request is on behalf of the Division of Environmental Services. Upon a
motion made by Mr. Leszczynski, seconded by Mr. Caldwell and carried, the request was approved.
APPROVE CONTRACTOR BOND
Mr. Larry D. Spradlin, Sr., Engineer, Division of Engineering, recommended that the following
Contractor Bond be approved as follows:

Mr. Leszczynski made a motion that the recommendation be accepted and that the Bond be approved
as outlined above. Mr. Caldwell seconded the motion which carried.

FILING OF MONTHLY NEIGHBORHOOD BUSINESS DEVELOPMENT REPORT - JULY

Mr. Leszczynski stated that Mr. Sam Mercantini, Executive Director, Neighborhood Business
Development Corporation, has submitted the July 1995 report, and recommended it be approved.
Upon a motion made by Mr. Leszczynski, seconded by Mr. Caldwell and approved, the report was
filed as submitted.
APPROVE CLAIMS
Mr. Kevin Horton, City Controller, submitted claims in the amount of $1,424,533.02 and
$3,136,864.93 and recommended approval. Additionally, Mr. Juan Manigault, Executive Director,
WDS of Northern Indiana, submitted one (1) list containing claims in the amount of $313,560.13
and recommended approval. Mr. Caldwell made a motion that the claims be approved and the
reports as submitted be filed. Mr. Leszczynski seconded the motion which carried.

There being no further business to come before the Board, upon a motion made by Mr. Caldwell,
