HomeMy WebLinkAbout07/03/95 Board of Public Works MinutesREGULAR MEETING I JULY 3. 1995 The regular meeting of the Board of Public Works was convened at 9:33 a.m. on Monday, July 3, 1995, by Board President John E. Leszczynski, with Mr. Leszczynski and Mrs. Jenny Pitts Manier present. Board Member James R. Caldwell and Board Attorney Anne Bruneel were not present. AGENDA ITEM ADDED Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, an Agenda item for a Contractor Bond was added to the Agenda. APPROVE MINUTES OF PREVIOUS MEETING Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the minutes of the regular meeting of the Board held on June 26, 1995, were approved. PUBLIC HEARING - TRANSIENT MERCHANT LICENSE Mr. Leszczynski advised that this was the date set for the Board's Public Hearing concerning the issuance of a Transient Merchant License, as submitted by Mr. Joseph R. Gargano, 1701 Granvia Altamire, Palos Verdes Estates, California, to conduct a trade show at the Holiday Inn - Downtown, on Friday, July 14, 1995, from 7:00 p.m. until 10:00 p.m., to conduct the sale of Disney collectibles. Mr. Leszczynski noted that favorable recommendations were received from the Police Department, Fire Department and the Building Commissioner. There being no one present wishing to address the Board concerning this matter, the Public Hearing was closed. Therefore, upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, theLicense Application was approved, and forwarded to the Deputy Controller's office for issuance of a Transient Merchant License. OPENING OF BIDS - ABANDONED VEHICLES This was the date set for receiving and opening of sealed bids for the above referred to abandoned vehicles. The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri- County News which were found to be sufficient. OPENING OF QUOTATIONS - WHITCOMB/KELLER ADDITION - ENTRANCE WAY PILLAR REPAIR - PROJECT NO. 95-45 Mr. Leszczynski advised that this was the date set for the receiving and opening of sealed Quotations for the above referred to project. INC. 1904 Hartman Drive South Bend, Indiana 1 F� REGULAR MEETING JULY 3, 1995 Quotation was submitted by Mr. James Marnocha, President QUOTATION: $4,950.00 Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the above Quotation was referred to the Division of Engineering for review and recommendation. OPENING OF QUOTATIONS - STUDEBAKER NATIONAL MUSEUM - CONCRETE PATCHING Mr. Leszczynski advised that this was the date set for the receiving and opening of sealed Quotations for the above referred to project. The following Quotations were opened and read: KASER SPRAKER CONSTRUCTION. INC. 25487 West State Road 2 South Bend, Indiana 46619 Quotation was submitted by Mr. Joe Winters, Project Manager QUOTATION: Patch all beams longer than four (4) feet using epoxy bonding and epoxy grout $19,906.00 Epoxy bonding with Speedcrete $13,290.00 For beams less than four (4) feet, apply epoxy $ 3,500.00 And apply Speedcrete $ 3,200.00 Beam patching seven (7) locations on second floor level to be patched with epoxy application $ 1,371.00 And apply Speedcrete $ 924.00 After all areas have been considered, a total amount for using an epoxy application is $24,777.00 compared to $17,414.00 for using a Speedcrete application Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the above Quotation was referred to the Division of Engineering for review and recommendation. AWARD BID - ONE (1) SINGLE AXLE DUMP TRUCK Mr. Matthew Chlebowski, Director, Division of Equipment Services, advised the Board that on June 19, 1995, bids were received and opened for the above referred to equipment. After reviewing those bids, Mr. Chlebowski recommends that the Board award the contract to Wise International Trucks, 4849 West Western, South Bend, Indiana, in the amount of $57,104.00. Therefore, Mrs. Manier made a motion that the recommendation be accepted and the bid be awarded as outlined above. Mr. Leszczynski seconded the motion which carried. AWARD BID - TWO (2) 15.000 LB. GVW DUMP TRUCKS Mr. Matthew Chlebowski, Director, Division of Equipment Services, advised the Board that on June 19, 1995, bids were received and opened for the above referred to equipment. After reviewing those bids, Mr. Chlebowski recommends that the Board award the contract to Gates Chevrolet, 401 South Lafayette, South Bend, Indiana, in the amount of $63,522.00. Therefore, Mrs. Manier made a motion that the recommendation be accepted and the bid be awarded as outlined above. Mr. Leszczynski seconded the motion which carried. REGULAR MEETING JULY 3, 1995 APPROVE CONSTRUCTION CONTRACT - CHALFANT HEIGHTS ENTRANCE SIGNS - PROJECT NO. 94-97 Mr. Leszczynski advised that in accordance with the bid awarded on June 19, 1995, to- MJW Masonry, Inc., Orange Road, South Bend, Indiana, in the amount of $2,800.00 for the above referred to project, a Contract in said amount was being submitted for Board approval. Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the Contract was approved and the appropriate Certificate of Insurance and Waiver of Lien as submitted were filed. APPROVE CONSTRUCTION CONTRACT - 219 N. HILL STREET SIDEWALK/CURB/ALLEY LIGHTING - PROJECT NO 95-29 Mr. Leszczynski advised that in accordance with the bid awarded on June 26, 1995 to Kaser-Spraker Construction, 25487 West State Road 2, South Bend, Indiana, in the amount of $24,803.00 for the above referred to project, a Contract in said amount was being submitted for Board approval. Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the Contract was approved and the appropriate Certificate of Insurance, Performance Bond and Labor and Materials Payment Bond as submitted were filed. APPROVE CONSTRUCTION CONTRACT - NEAR WESTSIDE PARTNERSHIP CENTER SERVICE AREA - SIDEWALK CURB AND APPROACH REPAIRS - PROJECT NO. 94-89 Mr. Leszczynski advised that in accordance with the bid awarded on June 26, 1995, to Phend & Brown, Post Office Box 218, Milford, Indiana, in the amount of $127,070.00 for the above referred to project, a Contract in said amount was being submitted for Board approval. Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the Contract was approved and the appropriate Certificate of Insurance, Performance Bond and Labor and Materials Payment Bond as submitted were filed. APPROVE COMMUNITY DEVELOPMENT CONTRACT The following Community Development Contract was presented to the Board for approval: Bureau of Housing $123,508.00 Continue Affordable Loan Activity - Low to Moderate Homeowner Rehab Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the above referred to Contract was approved and executed. APPROVAL OF AGREEMENT - ENGINEERING SERVICES - RIVER NORTH WALKWAYBIKEWAY ALONG NORTHSIDE BOULEVARD - KEN HERCEG & ASSOCIATES Mr. Leszczynski stated that the Board is in receipt of an Agreement between the City of South Bend and Ken Herceg & Associates, 211 West Washington, South Bend, Indiana, for engineering services for the design of the River North Walkway/Bikeway along Northside Boulevard, from three hundred (300) feet east of the Cooper Bridge to the East side of Veterans Memorial Park. Mr. Leszczynski noted that the Agreement is in the amount of $66,800.00. Therefore, upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the Agreement was approved and executed. APPROVE CHANGE ORDER - STUDEBAKER MUSEUM - ASBESTOS ABATEMENT - PROJECT NO. 95-31 Mr. Leszczynski advised that Mr. Bob Allen, Public Construction Manger, has submitted Change Order No. 1 on behalf of Specialty Systems, Inc., 1408 Elwood Avenue, South Bend, Indiana, indicating that the Contract amount be increased $738.00 for a new Contract sum including this Change Order in the amount of $20,222.00. Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the Change Order was approved. APPROVE CHANGE ORDER - COLLEGE FOOTBALL HALL OF FAME - THEME SCULPTURE - MUSEUM SERVICES INC. Mr. Leszczynski advised that Mr. David W. Fox, Gerard Hilferty and Associates, 14240 Route 550, Athens, Ohio, has submitted Change Order No. 1, on behalf of Museum Services, Inc., 1220 SE Veitch Street, Gainsville, Florida, indicating that the Contract amount be increased $1,000.00 for 1 IJ 1 REGULAR MEETING JULY 3, 1995 a new Contract sum including this Change Order in the amount of $168,258.00. Upon a motion madeby Mrs. Manier, seconded by Mr. Leszczynski and carried, the Change Order was approved. APPROVE CHANGE ORDERS - COLLEGE FOOTBALL HALL OF FAME - AUDIO VISUAL ELEMENTS - DONNA LAWRENCE PRODUCTIONS Mr. Leszczynski advised that Mr. David W. Fox, Gerard Hilferty and Associates, 14240 Route 550, Athens, Ohio, has submitted Change Orders No. AV-8 and AV-9, on behalf of Donna Lawrence Productions, Inc., 624 Baxter Avenue, Louisville, Kentucky, indicating that the Contract amount be increased $12,408.00 for a new Contract sum including this Change Order in the amount of $2,342,225.00. In addition, Change Order No. AV-9 was submitted, for an increase of $21,135.00, for a new Contract sum including this Change Order in the amount of $2,363,360.00. Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the Change Orders were approved. APPROVAL OF ADDENDUM I - COLLEGE FOOTBALL HALL OF FAME - PROFESSIONAL SERVICES AGREEMENT - SCULPTURE BASIS Mr. Leszczynski stated that the Board is in receipt of Addendum No. 1, for the above referred to project. Ms. Kim Crowley, Sculpture Basis, Inc., stated that this Addendum amends the scope of services to be provided by the Sculptor, increasing the Agreement in the amount of $18,360.00, and recommended approval. Additionally, the Professional Services Agreement was executed on August 10, 1992. Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the Addendum was approved and executed. ADOPT RESOLUTION NO.42-1995 - DISPOSAL OF CITY -OWNED PROPERTY Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the following Resolution was adopted: RESOLUTION NO.42-1995 A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS ON DISPOSAL OF UNFIT AND/OR OBSOLETE PROPERTY WHEREAS, it has been determined by the Board of Public Works that the following property is unfit for the purpose for which it was intended and is no longer needed by the City of South Bend: 1980 HUBER MAINTAINER MODEL 850 VIN # M251 WHEREAS, Indiana Code 36-1-11-6 permits and establishes procedure for disposal of personal property which is unfit for the purpose for which it was intended and which is no longer needed by the City. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend that the one (1) item listed above is no longer needed by the City, is unfit for the purpose for which it was intended; and has an estimated value of less than Five Thousand Dollars ($5,000.00). BE IT FURTHER RESOLVED, that said equipment may be transferred or sold at public auction or private sale, without advertising. Jacob, Clerk ADOPT RESOLUTION NO. 43-1995 - TRANSFER OF CITY OWNED PROPERTY TO THE CITY OF MISHAWAKA Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the following Resolution was adopted: RESOLUTION NO. 43-1995 A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS FOR THE TRANSFER OF ONE (1) HUBER MAINTAINER FROM THE SOUTH BEND DIVISION OF EQUIPMENT SERVICES TO THE CITY OF MISHAWAKA WHEREAS, I.C. 36-1-11-8 governs the exchange of property by the City with another governmental entity; and WHEREAS, the City of South Bend Division of Equipment Services desires to donate the following equipment to the City of Mishawaka, as this equipment is obsolete and no longer suited for use in the motor vehicle fleet of the Department: 1980 HUBER MAINTAINER MODEL 850, VIN # M251 WHEREAS, the City of Mishawaka is in need of this equipment to add to its motor vehicle fleet and seeks the transfer by the South Bend Division of Equipment Services to it of said equipment; and WHEREAS, it is the desire of the City of South Bend Division of Equipment Services to transfer said equipment to the City of Mishawaka. NOW THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend that in consideration of the equipment transfer as set out above, the City conveys the following Equipment to the City of Mishawaka: 1980 HUBER MAINTAINER MODEL 850 VIN # M251 The transfer of said equipment shall be effective upon the adoption of a Resolution substantially identical in its terms to the terms of this Resolution by the City of South Bend for St. Joseph County. WHEREAS, this equipment has already been declared obsolete by the Board pursuant to Resolution No.42-1995, adopted on July 3, 1995. Jacob, Clerk 1 T 6 7- ; REGULAR MEETING JULY 11995 APPROVAL OF RECOMMENDATION - TO CONDUCT BLOCK PARTY Mr. Leszczynski stated that favorable recommendations have been received by the Division of Engineering, Police Department and the City Attorney's office, in reference to a request as submitted by Ms. Tina Coleman, 2022 %2 Miami Street, South Bend, Indiana to conduct the above referred to block party, on Friday, September 1, 1995, from 2:00 p.m. until 10:00 p.m., on Donald Street from Miami Street, to the first alley east of Miami. Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the recommendation was approved. APPROVAL OF RECOMMENDATION - TO CONDUCT BLOCK PARTY Mr. Leszczynski stated that favorable recommendations have been received by the Division of Engineering, Police Department and the City Attorney's office, in reference to a request as submitted by Ms. Melissa DeClercq, 130 North Hawthorne Drive, South Bend, Indiana to conduct the above referred to block party, on Saturday, August 19, 1995, from 3:00 p.m. until 10:00 p.m., on Hawthorne Drive from Colfax to Washington Streets. Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the recommendation was approved. APPROVAL OF RECOMMENDATION - TO CONDUCT NEIGHBORHOOD WALK AND PICNIC Mr. Leszczynski stated that favorable recommendations have been received by the Division of Engineering, Police Department and the City Attorney's office, in reference to a request as submitted by Ms. Carla Spradlin, Planner, Community and Economic Development, on behalf of the Near Westside Neighborhood Partnership Center to conduct the above referred to block party on Saturday, July 8, 1995, from 10:00 a.m. until 12:00 p.m., on North Johnson Street, from Bertrand to Kenwood Streets. Upon a motion made by Mrs. Manier, seconded by Mr Leszczynski and carried, the recommendation was approved. APPROVAL OF RECOMMENDATION - TO CONDUCT PARISH FESTIVAL - OUR LADY OF HUNGARY CHURCH Mr. Leszczynski stated that favorable recommendations have been received by the Division of Engineering, Code Enforcement, Police Department and the City Attorney's office, in reference to a request as submitted by Mr. Richard Gratzol, Festival Coordinator, Our Lady of Hungary Church, 829 West Calvert Street, South Bend, Indiana to conduct the above referred to Parish Festival, on Saturday, July 15, 1995, from 3:30 p.m. until 11:30 p.m., on South Chapin Street between West Calvert and Bruce Streets. Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the recommendation was approved. APPROVE REOUEST TO ADVERTISE FOR THE RECEIPT OF BIDS - ONE (I)TWO TON VIBRATORY ROLLER Mr. Matthew Chlebowski, Director, Division of Equipment Services, requested permission to advertise for the receipt of bids for a two (2) ton vibratory roller, to be used by the City Street Department. Mrs. Manier made a motion that the request be approved. Mr. Leszczynski seconded the motion which carried. APPROVE REOUEST TO ADVERTISE FOR THE RECEIPT OF BIDS - ONE (1) ALLEY MAINTAINER Mr. Matthew Chlebowski, Director, Division of Equipment Services, requested permission to advertise for the receipt of bids for one (1) alley maintainer for use by the City Street Department. APPROVE REOUEST TO ADVERTISE FOR THE RECEIPT OF BIDS - CONCRETE IMPROVEMENTS Mr. John Leszczynski, Director, Department of Public Works, requested permission to advertise for the receipt of bids for concrete improvements in the City of South Bend. Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the above referred to Title Sheet was approved and signed. FILING OF MONTHLY NEIGHBORHOOD BUSINESS DEVELOPMENT CORPORATION REPORT - JUNE 1995 Mr. Sam Mercantini, Executive Director, Neighborhood Business Development Corporation, submitted the monthly report for June 1995, and recommended the report be filed. Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the report was filed. 1 REGULAR MEETING JULY 3, 1995 APPROVE CLAIMS Mr. Kevin Horton, City Controller, submitted claims in the amount of $813,815.74 and recommended approval. Additionally, Mr. Juan Manigault, Executive Director, WDS of Northern Indiana, submitted two (2) lists containing claims in the amount of $23,992.63 and $250,997.30 and recommended approval. Mrs. Manier made a motion that the claims be approved and the reports as submitted be filed. Mr. Leszczynski seconded the motion which carried. APPROVE CONTRACTOR BONDS Mr. Larry D. Spradlin, Sr., Engineer, Division of Engineering, recommended that the following Contractor Bond be approved as follows: South Bend Motel Corp Approved Effective July 3, 1995 Mr. Leszczynski made a motion that the recommendation be accepted and that the Bond be approved as outlined above. Mrs. Manier seconded the motion which carried.
