APRIL 24, 1995
The regular meeting of the Board of Public Works was convened at on Monday, April 24, 1995, by
Board President John E. Leszczynski, with Mr. Leszczynski, Mr. James R. Caldwell and Mrs. Jenny
Pitts Manier present. Also present was Board Attorney Anne Bruneel.
ADD AGENDA ITEM
Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, an Agenda item to
Award Bids for -the 1995 Good Neighbors/Good Neighbors Program was added.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the minutes of the
regular meeting of the Board held on April 17, 1995, were approved.

This was the date set for receiving and opening of sealed bids for the above referred to project. The
Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News

Mr. Leszczynski advised that in accordance with the bid awarded on April 4, 1995, to Commercial
Diving Service, Inc., 1120 Rarig Avenue, Columbus, Ohio, in the amount of $284,496.00 for the
above referred to project, a Contract in said amount was being submitted for Board approval. Upon
a motion made by Mr. Leszczynski, seconded by Mr. Caldwell and carried, the Contract was
approved and the appropriate Certificate of Insurance, Performance Bond and Labor and Materials
Payment Bond as submitted were filed.
APPROVE CONSTRUCTION CONTRACT - ORGANIC RESOURCES BUILDING ADDITION
AND VENTILATION UPGRADE - PROJECT NO.95-09
Mr. Leszczynski advised that in accordance with the bid awarded on April 3, 1995, to Ziolkowski
Construction, Inc, 1005 South Lafayette Boulevard, South Bend, Indiana, in the amount of
$174,850.00 for the above referred to project, a Contract in said amount was being submitted for
Board approval. Upon a motion made by Mr. Leszczynski, seconded by Mr. Caldwell and carried,
the Contract was approved and the appropriate Certificate of Insurance, Performance Bond and
Labor and Materials Payment Bond as submitted were filed.
APPROVE PROPOSAL - ASBESTOS ABATEMENT MANAGEMENT SERVICES
STUDEBAKER MUSEUM - COLE ASSOCIATES
Mr. Leszczynski stated that the Board is in receipt of a Proposal for the above referred to project,
as submitted by Mr. William E. Stilson, President, Cole Associates, 2211 East Jefferson, South
Bend, Indiana, to provide asbestos abatement management services for the Studebaker National
Museum. Mr. Stilson noted that total project estimated fees will be $3,650.00 Upon a motion made
by Mr. Caldwell, seconded by Mrs. Manier and carried, the Proposal was approved and executed.
APPROVE AGREEMENT FOR ENGINEERING SERVICES - STUDEBAKER MUSEUM -
COLE ASSOCIATES.
Mr. Leszczynski stated that the Board is in receipt of an Agreement for Engineering Services to
prepare plans and specifications for the renovation of reopening the Studebaker Museum, as
submitted by Mr. William E. Stilson, President, Cole Associates, 2211 East Jefferson, South Bend,
Indiana. Mr. Stilson noted that a total project estimated fee will be $17,500.00. Therefore, upon a
motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the Agreement was
approved and executed.

the request to conduct a motorcade from the Odd Fellows Temple, 1625 N. Bendix Drive, to the City
Cemetery at 1:30 p.m., on May 21, 1995, in conjunction with Schuyler Colfax Day.
- TO CONDUCT CHET WAGGONER LITTLE LEAGUE ANNUAL PARADE
Mr. Leszczynski stated that favorable recommendations have been received from the Police
Department, Legal Department, Division of Engineering and the Park Department, in reference to
the request to conduct the Chet Waggoner Little League Annual Parade on April 29, 1995.
ADOPT RESOLUTION NO. 15-1995 - DISPOSAL OF CITY -OWNED PROPERTY
Upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the following
Resolution was adopted:
RESOLUTION NO. 15-1995
WHEREAS, the Board of Public Works of the City of South Bend, Indiana, has compiled
a current detailed inventory of all real property owned by the City of South Bend; and
WHEREAS, the Board of Public Works has reviewed said inventory of real property and it
finds that certain parcels of real estate now owned by the City of South Bend is not necessary to the
public use and is not set aside by State and City laws for public purposes; and
WHEREAS, the Board of Public Works finds that the property described below has an
assessed valuation of less than $2,000.00, that the cost of maintaining said parcels equals or exceeds
the estimated fair market value of the parcels, and that the highest and best use of the parcels is sale
to an abutting landowner.
WHEREAS, the Board of Public Works now wishes to take the necessary action to make it
possible for the Board, in the future, to sell said parcel of real estate pursuant to State statutes.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South

SCOREBOARD AGREEMENT - COVELESKI STADIUM
Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the following

A RESOLUTION OF THE BOARD OF PARK COMMISSIONERS
APPROVING ASSIGNMENT AND EXTENSION OF
SCOREBOARD AGREEMENT
WHEREAS, the Board of Public Works of the City of South Bend, Indiana, entered into a
contract with Fair -Play Scoreboards, a division of Fairtron Corporation, on March 30, 1987, for the
installation of a scoreboard at Stanley Coveleski Regional Stadium, to be paid for by advertisers
secured by Fair -Play; and
WHEREAS, the term of said agreement was for a period of ten (10) years; and
WHEREAS, Palisades Baseball d/b/a South Bend Silver Hawks wishes to install a new
scoreboard replacing the old scoreboard from Fairtron Corporation; and
WHEREAS, the Silver Hawks will obtain a maintenance agreement which will relieve the
City of South Bend from any maintenance responsibilities and will continue to share with the City
of South Bend revenues generated by selling commercial spots on the message center; and
WHEREAS, the title to the scoreboard shall be in the name of the City of South Bend.
IT IS THEREFORE RESOLVED AS FOLLOWS:
(1) That the Board of Public Works approves the assignment of the contract dated March
30, 1987, from Fairtron Corporation to Palisades Baseball, a California limited partnership.
(2) That said contract shall be extended for an additional ten (10) years from the date of
approval of this resolution and also by the City of South Bend Board of Public Works.
(3) That this resolution is conditioned upon the South Bend Silver Hawks providing all costs
of the dismantling of the old scoreboard, installation and cost of the new scoreboard, and obtaining
for the benefit of the City of South Bend a maintenance agreement.
(4) That the title to the new scoreboard shall be in the name of the City of South Bend.

ADOPT RESOLUTION NO.24-1995 - DISPOSAL OF CITY -OWNED PROPERTY
Upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the following
Resolution was adopted:
RESOLUTION NO.24-1995
WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of the City of South Bend the
right and duty to have custody of, control of, use of, and dispose of in accordance with Indiana
statutes, all real and personal property owned by the City of South Bend; and
WHEREAS, the Common Council of the City of South Bend passed as amended on January
11, 1988, Ordinance No. 7847-88 which mandates the Board of Public Works of the City of South
Bend to determine that the sidearm of a police officer who retires in good standing is surplus
property and no longer useful to the City of South Bend; and
WHEREAS, CORPORAL MATTHEW PUECKER has retired from the South Bend Police
Department after thirty-five (35) years of service and the Board of Public Safety of the City of South
Bend has determined that he has retired in good standing; and
WHEREAS, I.C. 36-1-11-6 permits and establishes procedure for disposal of personal
property which is no longer needed by the City and which is unfit for the purpose for which it was
intended;
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South
Bend that sidearm Serial No. AD18979, a .40 caliber Sig -Sauer sidearm, is no longer needed by the
City and is unfit for the purpose for which it was intended and has an estimated fair market value
of less than Five Hundred Dollars ($500.00).
BE IT FURTHER RESOLVED that said property be disposed of and removed from the City
inventory.

Mr. Leszczynski made a motion that the recommendation be accepted and that the Bond be approved
as outlined above. Mrs. Manier seconded the motion which carried.

APPROVE CLAIMS
Mr. Kevin Horton, City Controller, submitted claims in the amount of $4,043,899.53 and
recommended approval. Additionally, Mr. Juan Manigault, Executive Director, WDS of Northern
Indiana, submitted one list containing claims in the amount of $59,842.43 and recommended
approval. Mr. Leszczynski made a motion that the claims be approved and the reports as submitted
be filed. Mrs. Manier seconded the motion which carried.
ADJOURNMENT
There being no further business to come before the Board, upon a motion made by Mr. Leszczynski,
seconded by Mr. Caldwell and carried, the meeting adjourned at 10:02 a.m.
