The regular meeting of the Board of Public Works was convened at 9:34 a.m. on Monday, April 10,
1995, by Board President John E. Leszczynski, with Mr. Leszczynski, Mr. James R. Caldwell and
Mrs. Jenny Pitts Manier present. Also present was Board Attorney Anne Bruneel.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the minutes of the
regular meeting of the Board held on April 3, 1995, were approved.
AGENDA ITEMS ADDED
Upon a motion made by Mr. Leszczynski, seconded by Mr. Caldwell and carried, the following
Agenda items were added: a Construction Contract for Project No. 94-88; a Request to Conduct a
Parade; and a Request to Encroach onto Public Right -of -Way.
OPENING OF BIDS - 1995 STREET MATERIALS
This was the date set for receiving and opening of sealed bids for the above referred to materials.
The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County
News which were found to be sufficient. The following bids were opened and publicly read:

APPROVE CONTRACT FOR COLLECTION SERVICES - MIDWEST COLLECTION
SERVICES
Mr. Leszczynski advised that the Board is in receipt of a Contract for Collection Services between
the City of South Bend and Midwest Collection Services, Inc., 3222 Mishawaka Avenue, South
Bend, Indiana. It is further noted that services to be provided include after due notice to the owner
or other parties of interest, clearing of trash, litter, debris, garbage, vegetation, and similar materials,
removal of abandoned vehicles, and securing or demolishing structures. Therefore, upon a motion
made by Mr. Caldwell, seconded by Mrs. Manier and carried, the Contract was approved and
executed.
APPROVE CONTRACT FOR SOUTHEAST REDEVELOPMENT AREA SITE CLEARANCE -
PHASE I STRUCTURE REMOVAL PACKAGE - PROJECT NO 94-72
Mr. Leszczynski advised that the Board is in receipt of a Contract for the above referred to project
between B&J Excavation, 1104 West Donald, South Bend, Indiana, and the City of South Bend. It
is noted that this Contract is in the amount of $89,975.00. It is further noted that services to be
provided include removal of thirty-three (33) residential structures. Therefore, upon a motion made
by Mrs. Manier, seconded by Mr. Caldwell and carried, the Contract was approved and executed.
APPROVE CONTRACT FOR SAMPLE-EWING REDEVELOPMENT AREA - SITE
CLEARANCE PHASE I - STRUCTURE REMOVAL PACKAGE 3 - PROJECT NO. 95-15
Mr. Leszczynski advised that the Board is in receipt of a Contract for the above referred to project
between Warner & Sons, 29099 U.S. 33, Elkhart, Indiana, and the City of South Bend. It is noted
that this Contract is in the amount of $29,500.00. It is further noted that services to be provided
include structure removal of (4) commercial properties at 918-922, 1014, 1020 and 1104-12 South
Michigan Street. Therefore, upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier
and carried, the Contract was approved and executed.
APPROVE COMMUNITY DEVELOPMENT CONTRACTS
The following Community Development Contracts were presented to the Board for approval:

It is noted that Jim Caldwell is a member of the Center for the Homeless ExecutiveBoard, therefore,
he abstained from voting on this Contract. Upon a motion made by Mrs. Manier, seconded by Mr.
Leszczynski and carried, the Contract for the Center for the Homeless Shelter Activity was approved
and executed. Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the
Housing Development Corporation Lease/Purchase Program Contract was approved and executed.
APPROVE CONTRACT FOR IRONWOOD DRIVE STRUCTURE REMOVAL - PROJECT NO.
94-88
Mr. Leszczynski advised that the Board is in receipt of a Contract for structure removal between
Warner & Sons, 29099 State Road 33, Elkhart, Indiana, and the City of South Bend. It is noted that
this Contract is in the amount of $6,300.00. It is further noted that services to be provided include
the clearing of structures at 1901 and 1911 South Ironwood. Therefore, upon a motion made by Mrs.
Manier, seconded by Mr. Leszczynski and carried, the Contract was approved and executed.

APPROVAL OF AGREEMENT - CHALFANT HEIGHTS AGREEMENT
Mr. Leszczynski noted that the Board is in receipt of an Agreement between the City of South Bend
and the Chalfont Heights Neighborhood Asociation, for reconstruction of two (2) identification
signs at the entrance. Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried,
the Agreement was approved and executed.
APPROVAL OF GRANT OF LICENSE - GMS REALTY, INC.
Mr. Leszczynski noted that the Board is in receipt of a Grant of License between the City of South
Bend, and GMS Realty, Inc., 3575 Portage Road, South Bend, Indiana, which grants and conveys
to GMS Realty a revokable, non-exclusive license at the location of 3575 Portage set forth and
described for the alteration, removal, modernization, maintenance and use of two existing free-
standing signs. Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, the
Grant of License of approved and executed.

Upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the above referred
to Change Orders were approved.
APPROVE CHANGE ORDER NO.4 (FINAL) AND PROJECT COMPLETION AFFIDAVIT -
BLACKTHORN CLUBHOUSE - ZIOLKOWSKI CONSTRUCTION - PROJECT NO. 92-62
Mr. Leszczynski advised that Mr. Bob Allen, Public Construction Manager, has submitted Change
Order No.4 (Final), on behalf of Ziolkowski Construction, 1005 South Lafayette, South Bend,
Indiana, indicating that the contract amount be increased by $9,460.00 for a new contract sum
including this Change Order in the amount of $799,623.89. Additionally submitted was the Project
Completion Affidavit indicating this new final cost. Upon a motion made by Mr. Caldwell,
seconded by Mr. Leszczynski and carried, Change Order No. 4 (Final) and the Project Completion
Affidavit were approved subject to the filing of the appropriate three-year Maintenance Bond.
ADOPT RESOLUTION NO.20-1995 - TRANSFER OF REAL PROPERTY FROM THE SOUTH
BEND REDEVELOPMENT COMMISSION
Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the following

FROM THE SOUTH BEND REDEVELOPMENT COMMISSION
WHEREAS, the City of South Bend, Department of Redevelopment (Redevelopment),
whose governing body is the South Bend Redevelopment Commission (the "Commission") is the

Joseph County, Indiana:

WHEREAS, inspections of the property has been completed by the Department of Code
Enforcement and the Fire Prevention Bureau as required by Chapter 4, Article 4, Section 4-51 of the
Municipal Code; and
WHEREAS, the Department of Code Enforcement and the Fire Prevention Bureau have
found that such premises are fit and proper for the maintenance and operation of such business; and
WHEREAS, Chapter 4, Article 4, Section 4-51 of the Municipal Code requires adoption of
a Resolution of the Board of Public Works recommending the renewal of the license application.

STRUCTURE REMOVAL PACKAGE 3 - PROJECT NO. 95-15
Mr. Carl P. Littrell, Director, Division of Engineering, advised the Board that on March 27, 1995,
bids were received and opened for the above referred to project. After reviewing those bids, Mr.
Littrell recommends that the Board award the contract to Warner & Sons, 29099 U.S. 33, Elkhart,
Indiana, in the amount of $29,500.00. Therefore, Mr. Leszczynski made a motion that the
recommendation be accepted and the bids be awarded as outlined above. Mr. Caldwell seconded
the motion which carried.
APPROVAL OF RECOMMENDATION TO VACATE AN ALLEY
Mr. Leszczynski noted that favorable recommendations have been received from the Division of
Engineering, Area Plan Commission, Department of Economic Development, Fire Department,
Department of Sanitation, Police Department and the City Attorney's Office, in reference to the alley
vacation on the following:
The first east -west alley north of East Jefferson Boulevard from the east right-of-way line
of S. St. Peter to the east right-of-way line of the first north -south alley east of St. Peter, and
the first east -west alley south of East Washington Avenue from the west right-of-way line
of S. Notre Dame Avenue to the east right-of-way line of the first north -south alley west of
S. Notre Dame Avenue. Also a right-of-way described as Beginning at the northeast corner
of Lot 3 Y 5 in part of Cottrell's 1 st Addition to Lowell in the City of South Bend, Indiana.
The Petition to Vacate the Public Right -of -Way was submitted by Mr. Victor J. Pantea, Teacher's
Credit Union, 110 S. Main Street, South Bend, Indiana. Therefore, upon a motion made by Mr.
Leszczynski, seconded by Mrs. Manier and carried, the recommendation was approved.
APPROVAL OF RECOMMENDATION TO CLOSE WASHINGTON STREET - MEMORIAL
DAY ACTIVITIES
Mr. Leszczynski advised that favorable recommendations have been received from the Police
Department, Division of Engineering and the Legal Department, in reference to the request to close
Washington Street between Main Street and Lafayette Boulevard for approximately one hour on
Monday, May 29, 1995, beginning at 2:00 p.m., in conjunction with Memorial Day activities to be
conducted in front of the Sailors and Soldiers Monument on the Court House lawn. Therefore, upon
a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the recommendation was
approved.
APPROVAL OF RECOMMENDATIONS FOR LICENSE APPLICATION
- PERU CIRCUS
Mr. Leszczynski noted that favorable recommendations have been received by the Police
Department, Legal Department, Division of Engineering, Park Department and Code Enforcement,
in reference to the request to conduct the "Peru Circus" on June 10 and 11, 1995, from 1:00 p.m. to
8:00 p.m. at the Potawatomi Zoo. Upon a motion made by Mr. Caldwell, seconded by Mr.
Leszczynski and carried, the License Application for a Circus was approved.

Mr. Leszczynski noted that favorable recommendations have been received by the Division of
Engineering, Code Enforcement, Police Department and the Fire Department, for the following

Mr. Leszczynski noted that favorable recommendations have been received by the Department of
Code Enforcement for a License Application for Garbage and Rubbish Removal Service for V& J
Removal, 1804 Lincolnway East, South Bend, Indiana. It is noted that the Bureau of Solid Waste
has inspected the vehicles to be used, and have been found them to be in compliance. Therefore,
upon a motion made by Mr. Leszczynski, seconded by Mr. Caldwell and carried, the License
Application was approved.
- SCRAP DEALER
Mr. Leszczynski noted that favorable recommendations have been received by Code Enforcement
and the Fire Department, in reference to the License Application for a Scrap Dealer for South Bend
Scrap & Processing, 1305 Prairie Avenue, South Bend, Indiana. Upon a motion made by Mr.
Leszczysnki, seconded by Mr. Caldwell and Carried, the License Application was approved.
REQUESTS REFERRED:
Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, the following requests
were referred to the appropriate Bureaus and Departments for review and recommendation:
- TO CONDUCT MOTORCADE - COLFAX DAY
In a letter to the Board, Mr. Paul T. Kunz, Grand Encampment of Indiana, 56060 Currant Road,
Mishawaka, Indiana, requested permission to conduct a motorcade to the City Cemetery at 1:30 p.m.
on May 21, 1995, in conjunction with Colfax Day.
- TO ENCROACH ON PUBLIC RIGHT-OF-WAY
In a letter to the Board, Mr. Don Berta, Gibson -Lewis, 1001 West 1 lth Street, Mishawaka, Indiana,
requested permission to place a 30 yard dumpster on the parking lane of Navarre Street, 100 linear
feet from Michigan Street in South Bend. Mr. Berta noted that Gibson Lewis will be doing
renovation work for Memorial Hospital and will need the dumpster to be in place for six (6) months.
- TO CONDUCT A PARADE
In a letter to the Board, Mr. Dan Moreno, Chet Waggoner Little League, Post Office Box 3744,
South Bend, Indiana, requested permission to conduct the Chet Waggoner Little League Annual
Parade, on April 29, 1995.
- ENCROACH INTO PUBLIC -RIGHT-OF-WAY
In a letter to the Board, Mr. Kenneth Fedder, Allen, Fedder, Herendeen & Kowals, 205 West
Washington, South Bend, Indiana, requested permission to permit a portion of a sign at South Bend
Discount Liquor, 3227 West Sample Street, to extend into the public right-of-way.

Leszczynski, seconded by Mrs. Manier, the report was filed.
APPROVE CLAIMS
Mr. Kevin Horton, City Controller, submitted claims in the amount of $715,372.55 and
recommended approval. Additionally, Mr. Juan Manigault, Executive Director, WDS of Northern
Indiana, submitted one (1) list containing claims in the amount of $32,056.19 and recommended
approval. Ms. Ann Kolata, Community and Economic Development, submitted claims for the
College Football Hall of Fame and recommended approval. Mr. Leszczynski made a motion that
the claims be approved and the reports as submitted be filed. Mrs. Manier seconded the motion
which carried.
