The regular meeting of the Board of Public Works was convened at 9:35 a.m. on Monday, March
11, 1996, by Board President John E. Leszczynski, with Mr. Leszczynski, Mr. James R. Caldwell
and Mrs. Jenny Pitts Manier present. Also present was Board Attorney Anne Bruneel.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the minutes of the
regular meeting of the Board held on March 4, 1996, were approved.
OPENING OF BIDS - ABANDONED VEHICLES
This was the date set for receiving and opening of sealed bids for the above referred to vehicles. The
Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News

Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the above bids were
referred to the Division of Equipment Services for review and recommendation.
APPROVE CHANGE ORDER - COLLEGE FOOTBALL HALL OF FAME - RITSCHARD
BROTHERS - PROJECT NO.93-09
Mr. Leszczynski advised that Mr. R.A. Dieringer, Verkler, Inc., 4406 Technology Drive, South
Bend, Indiana, has submitted Change Order No. 7, on behalf of Ritschard Brothers, Inc., 1204 West
Sample Street, South Bend, Indiana indicating that the Contract amount be increased $1,135.00 for
a new Contract sum including this Change Order in the amount of $301,597.29. Upon a motion
made by Mr. Leszczynski, seconded by Mr. Caldwell and carried, the Change Order was approved.
APPROVE CHANGE ORDERS - INSTALLATION OF EXHAUST SYSTEMS AT SOUTH
BEND FIRE STATIONS - PROJECT NO. 95-84
Mr. Leszczynski advised that Mr. Bob Allen, Public Construction Manager, has submitted Change
Orders No. 1, 2 and 3, on behalf of O.J. Shoemaker, 1008 Lincolnway East, South Bend, Indiana,
and recommended approval as follows:

Orders No. 1 (Final) for the above referenced Zones, on behalf of Phend & Brown, Inc., Post Office

'Additionally submitted were the Project Completion Affidavits for each Zone indicating the new
final cost. Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the
Change Orders and the Project Completion Affidavits were approved.
APPROVE AMENDED CHANGE ORDER NO. 2 AND PROJECT COMPLETION AFFIDAVIT -
REMOVAL OF UNDERGROUND STORAGE TANKS - PROJECT NO. 95-73
Mr. Leszczynski advised that Mr. Bob Allen, Public Construction Manger has submitted an
Amended Change Order No. 2 indicating that the new contract sum be corrected to read
$115,375.00. It was noted that on March 4, 1996, Change Order No. 2 indicated a new contract sum
of $110,500.00, which was an incorrect sum of the Change Order amount of $12,450.00 plus the
sum of contract prior to Change Order 2. Additionally submitted was the Project Completion
Affidavit indicating this new final cost. Upon a motion made by Mr. Caldwell, seconded by Mrs.
Manier and carried, the Amended Change Order and the Project Completion Affidavit were
approved.
AWARD BID - ONE (1) 1500 G.P.M. PUMPER - FIRE DEPARTMENT
Fire Chief Luther Taylor advised the Board that on March 4, 1996, bids were received and opened
for the above referred to apparatus. Upon reviewing those bids, Chief Taylor recommends that the
Board award the contract to Midwest Fire & Safety Equipment Co., Inc., (Pierce), 1605 Prospect
Street, Indianapolis, Indiana the amount of $199,977.00. Additionally, in reviewing the bid, two (2)
items were removed from the base bid of $199,977.00 which amounted to $21,179.00, and an
equipment option was added, bringing the total amount of the bid award to $200,230.00 Therefore,
Mrs. Manier made a motion that the recommendation be accepted and the bids be awarded as
outlined above. Mr. Caldwell seconded the motion which carried.
APPROVAL OF RECOMMENDATION - TO CONDUCT INFANCIA MEXICANA WALK
Mr. Caldwell stated that favorable recommendations have been received by the Division of
Engineering, Park Department, Police Department and the City Attorney's office, in reference to a
request as submitted by Mr. Savino Rivera, Infancia Mexicana, Post Office Box 8042, South Bend,
Indiana to conduct the above referred to 5K run and 1 mile walk, on Saturday, May 4, 1996, from
9:00 a.m. until 11:00 a.m. on the designated route as submitted. Therefore, upon a motion made by
Mr. Caldwell, seconded by Mrs. Manier and carried, the recommendation was approved.
APPROVAL OF RECOMMENDATION - TO CONDUCT RUN. JANE. RUN - YWCA
Mr. Caldwell stated that favorable recommendations have been received by the Division of
Engineering, Park Department, Police Department and the City Attorney's office, in reference to a
request as submitted by Ms. Kit Banta, YWCA, 802 North Lafayette Boulevard, South Bend,
Indiana, to conduct the above referred to run, on Sunday, August 18, 1996, on the designated route
a submitted. Therefore, upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried,
the recommendation was approved.
APPROVAL OF APPLICATION - SIDEWALK CAFE
Mr. Caldwell stated that the Board is in receipt of favorable recommendations from the Fire
Department, Division of Engineering, Building Department, Legal Department and the Design
Review Committee for a License Application for a Sidewalk Cafe, as submitted by Mr. Mark
Borkowski, RJ's Espresso Shoppe, 109 West Washington Street, South Bend, Indiana. Additionally
submitted was the Agreement for Temporary Use of the Public Sidewalk for a Sidewalk Cafe. Upon
a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the Application for a
Sidewalk Cafe and the Agreement were approved.

ADOPT RESOLUTION NO. 19-1996 - DISPOSAL OF CITY OWNED PROPERTY
Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, the following
Resolution was adopted by the Board of Public Works:
RESOLUTION NO. 19 - 1996
A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS
ON DISPOSAL OF UNFIT AND/OR OBSOLETE PROPERTY
WHEREAS, it has been determined by the Board of Public Works that the following property
is unfit for the purpose for which it was intended and is no longer needed by the City of South Bend:
ONE (1) 1982 FORD 3 %2 TON - C REW & EQUIPMENT BODY WITH HOIST
ONE (1) 1991 CHEVROLET 5-10 2 DOOR BLAZER
ONE (1) 1989 CHEVROLET 3/4 TON - WITH VALVE MACHINE & EQUIPMENT BODY
ONE (1) CHEVROLET 3/4 TON - EQUIPMENT BODY
WHEREAS, Indiana Code 36-1-11-6(b) permits and establishes procedure for disposal of
personal property which is unfit for the purpose for which it was intended and which is no longer
needed by the City.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South
Bend that the items listed above are no longer needed by the City; are unfit for the purpose for which
they were intended and have an estimated value of more than one thousand dollars ($1,000.00).
BE IT FURTHER RESOLVED, the sale of said equipment shall be advertised in accordance
with I.C. 5-3-1, that sealed bids be accepted according to said advertisement, and that said property
be sold to the highest responsible bidder.

APPROVAL OF REQUEST TO ADVERTISE FOR THE RECEIPT OF BIDS - 1996 STREET
MATERIALS
In a memorandum to the Board, Mr. Carl P. Littrell, Director, Division of Engineering, requested
permission to advertise for the receipt of bids for the above referred to materials. Mr. Littrell stated
that this bid offering will provide prices of materials for use by the Bureau of Streets, Bureau of
Sewers and the Water Works. Funds for the purchases are appropriated in the operating budgets of
the above departments and in the appropriations from the Local Road and Street Fund. Therefore,
upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the request to advertise
for the receipt of bids was approved.

In a memorandum to the Board, Mr. Matthew Chlebowski, Director, Division of Equipment

APPROVAL OF REQUEST TO CONDUCT PUBLIC AUCTION - SOUTH BEND POLICE
DEPARTMENT
In a letter to the Board, Services Division Chief Richard Kilgore requested permission to conduct
a public auction to dispose of unclaimed property as allowed by law. Chief Kilgore stated that the
auction will be held on Saturday, April 13, 1996, at 8:30 a.m. in the garage area at the rear of 701
West Sample Street, by Kaser's Auction Service, a licensed auctioneer service. Additionally
submitted at this time was a Contract for Sale of Personal Property at Public Auction, submitted by
Kaser's Auction Service. Therefore, upon a motion made by Mr. Caldwell, seconded by Mrs.
Manier and carried, the request to conduct a public auction and the Contract for the Sale of Personal
Property at Public Auction were approved.

Mr. Caldwell advised that the Title Sheet for the above referred to project was being presented at this
time for execution. Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried,

Mr. Kevin Horton, City Controller, submitted claims in the amount of $1,171,763.76, dated March
4, 1996 and recommended approval. Additionally, Mr. Juan Manigault, Executive Director, WDS
of Northern Indiana, submitted two (2) lists containing claims in the amount of $48,587.97 and
$152,551.81 and recommended approval. Mr. Caldwell made a motion that the claims be approved
and the reports as submitted be filed. Mrs. Manier seconded the motion which carried.
