HomeMy WebLinkAbout01/29/96 Board of Public Works Minutes0 REGULAR MEETING JANUARY 29. 1996 The regular meeting of the Board of Public Works was convened at 9:35 a.m. on Monday, January 29, 1996, by Board President John E. Leszczynski, with Mr. Leszczynski, Mr. James R. Caldwell and Mrs. Jenny Pitts Manier present. Also present was Board Attorney Anne Bruneel. APPROVE MINUTES OF PREVIOUS MEETING Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the minutes of the regular meeting of the Board held on January 22, 1996, were approved. PUBLIC HEARING - LICENSE APPLICATION FOR TRANSIENT MERCHANT LICENSE - STAR TREK FESTIVAL Mr. Leszczynski advised that this was the date set for the Board's Public Hearing concerning a license application for a Transient Merchant License, as submitted by Mr. Vincent Anthony Menella, 1848 N.W. 97 Avenue, Plantation, Florida, to conduct Trek Day (Star Trek Festival), at the Century Center, on Sunday, February 25, 1996, from 12:00 p.m. until 5:00 p.m., to conduct the sale of photographs, posters and memorabilia from the Star Trek series. Mr. Leszczynski stated that favorable recommendations have been received by the Police Department, Fire Department and the Building Department. There being no one present wishing to address the Board concerning this matter, the Public Hearing was closed. Therefore, upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the license application was approved, and forwarded to the Deputy Controller's office for issuance of said license. OPENING OF BIDS - ABANDONED VEHICLES This was the date set for receiving and opening of sealed bids for the above referred to vehicles. The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News which were found to be sufficient. APPROVE CONSTRUCTION CONTRACT - EDISON ROAD SANITARY SEWER EXTENSION - PROJECT NO. 5-102 Mr. Leszczynski advised that in accordance with the bid awarded on January 15, 1996, to Herrman & Goetz, Inc., d/b/a Underground Services, 225 South Lafayette, South Bend, Indiana, in the amount of $81,059.63 for the above referred to project, a Contract in said amount was being submitted for Board approval. Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the Contract was approved and the appropriate Certificate of Insurance, Performance Bond and Labor and Materials Payment Bond as submitted were filed. APPROVE PROJECT COMPLETION AFFIDAVIT - WASTEWATER TREATMENT GRIT CHANNEL REBUILD - PROJECT NO. 95-75A Mr. Leszczynski advised that Mr. Roberto Flores, Environmental Services, has submitted the Project Completion Affidavit on behalf of Industrial Installations, 55587 Currant Road, Mishawaka, Indiana, for the above referred to project, indicating a final cost of $35,008.00. Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the Project Completion Affidavit was approved. APPROVAL OF AGREEMENT - MENTAL HEALTH PROVIDER - MADISON CENTER Mr. Leszczynski stated that the Board is in receipt of an Agreement between the City of South Bend and Madison Center, 403 East Madison, South Bend, Indiana, for providing mental health and substance abuse services for the City of South Bend employees. Therefore, upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, the Agreement was approved and executed. APPROVAL OF GRANT OF EASEMENT Mr. Leszczynski stated that the Board is in receipt of a Grant of Easement between the City of South Bend and Jim and Michelle Niespodzainy, on their property, described as: 0 1 1 1 REGULAR MEETING JANUARY 29, 1996 Lot 168, except the east 17.41 feet of Myers & Fun Chippewa Heights 3rd Addition to the City of South Bend, Indiana, Key Number 18-7148-626801 for the placement of a monitoring well on this property for purposes of monitoring ground water quality. The Niespodzainy's grant the City of South Bend a non-exclusive right, privilege and easement at the above mentioned property for the purpose of installing, maintaining, improving, repairing, and utilizing a monitoring well, together with the right of ingress to and egress from said easement. Therefore, upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, the Grant of Easement was approved and executed. Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, the above license applications were approved and referred to the Deputy Controller's Office for issuance of licenses. APPROVAL OF LICENSE APPLICATIONS - RUBBISH AND GARBAGE REMOVAL SERVICE Mr. Leszczynski stated that the Board is in receipt of favorable recommendations from the Department of Code Enforcement for License Applications for Rubbish and Garbage Removal Service for the following: Sylvester Mullins 115 Cherry Street South Bend, Indiana City of South Bend 3113 Riverside Drive South Bend, Indiana LeRoy Gorden 218 North Sadie South Bend, Indiana Browning -Ferris Industries 57820 Charlotte Avenue Elkhart, Indiana Superior Waste Systems 20645 W. Ireland Road South Bend, Indiana Mr. Leszczynski noted that the Bureau of Solid Waste has inspected all vehicles for each of the above listed businesses. Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the License Applications were approved. REQUESTS REFERRED Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and carried, the following requests were referred to the appropriate Bureaus and Departments for recommendation: 0 REGULAR MEETING JANUARY 29. 1996 - TO CONDUCT MARCH - INDIANA ODD FELLOWS Mr. Leszczynski stated that the Board is in receipt of an Application for Use of Public Right -of -Way, as submitted by Ms. Bertha McCain, Odd Fellows, 1625 North Bendix, South Bend, Indiana, to conduct a march on Sunday, May 19, 1996, from 1:30 p.m. until 2:30 p.m., on the designated route as submitted. - TO ENCROACH ONTO PUBLIC RIGHT-OF-WAY In a letter to the Board, Mr. Sean A. Hoade, The Double-Crossers, 18115 State Road 23, South Bend, Indiana, requested permission to videotape on the sidewalk of Colfax Avenue, and on Bellevue, south of Mishawaka Avenue, one morning between the dates of March 3 and March 10, 1996, for the purpose of videotaping a movie project, under the auspices of Indiana University at South Bend. APPROVE TITLE SHEET - NORTH PUMPING STATION - MASONRY RESTORATION - PROJECT NO. 96-12 Mr. Leszczynski advised that the Title Sheet for the above referred to project was being presented at this time for execution. Upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the above referred to Title Sheet was approved and signed. APPROVE CLAIMS Mr. Juan Manigault, Executive Director, WDS of Northern Indiana, submitted one list containing claims in the amount of $51,114.80 and recommended approval. Mrs. Manier made a motion that the claims be approved and the reports as submitted be filed. Mr. Caldwell seconded the motion which carried.
