REGULAR MEETING
APRIL 28, 1997
The regular meeting of the Board of Public Works was convened at 9:31 a.m. on Monday, April 28,
1997, by Board Member James R. Caldwell, with Mr. Carl P. Littrell and Ms. M. Catherine Roemer
present. Also present was Board Attorney Anne Brunel.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the minutes of the
regular meeting of the Board held on April 21, 1997, were approved.
PUBLIC HEARING - TRANSIENT MERCHANT LICENSE - MARKETPRO COMPUTER
SHOWS, INC.
Mr. Caldwell advised that this was the date set for the Board's Public Hearing concerning a Transient
Merchant License, as submitted by Ms. Jeanette Winton, 5880 Hubbard Drive, Rockville, Maryland,
to conduct MarketPro Computer Shows, Inc., at the Century Center, on Saturday, May 3, 1997, from
9:30 a.m. until 4:00 p.m., for the sale of computer hardware, software and accessories. Mr. Caldwell
stated that favorable recommendations have been received by the Police Department, Fire
Department, and the Building Commissioner.
Mr. Mark Bradley, Century Center was present, and recommended approval. There being no one
else present wishing to address the Board concerning this matter, the Public Hearing was closed.
Therefore, upon a motion made by Mr. Caldwell, seconded by Mr. Littrell and carried, the
Application for a Transient Merchant was approved.
OPENING OF BIDS - INTERIOR/EXTERIOR PAINT AND EXTERIOR TRAFFIC PAINT
This was the date set for receiving and opening of sealed bids for the above referred to items. The
Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News
which were found to be sufficient. Upon a motion made by Mr. Littrell, seconded by Mr. Caldwell
and carried, the bids were read at the end of the meeting. The following bids were opened and

Order No. 3 on behalf of Precision Control Systems, 7141 West Morris Street, Indianapolis, Indiana
indicating that the Contract amount be increased $9,770.00 for a new Contract sum including this
Change Order in the amount of $532,446.47. Upon a motion made by Mr. Caldwell, seconded by
Mr. Littrell and carried, the Change Order was approved.
APPROVE CHANGE ORDER - NORTHSIDE BOULEVARD BIKEWAY/WALKWAY -
PROJECT NO. 95-22
Mr. Caldwell advised that Mr. Greg Scherpereel, Engineer, has submitted Change Order No. 3 on
behalf of Northern Indiana Construction, 55803 Dogwood Road, Mishawaka, Indiana indicating that
the Contract amount be increased $45,787.89 for a new Contract sum including this Change Order
in the amount of $1,101,529.14. Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and
carried, the Change Order was approved.
APPROVE CHANGE ORDER - ELDER PARKWAY - PROJECT NO. 95-65
Mr. Caldwell advised that Mr. Toy Villa, Public Construction Manager, has submitted Change Order
No. 3, on behalf of Rieth Riley Construction Co., Post Office Box 1775, South Bend, Indiana
indicating that the Contract amount be increased $2,560.00 for a new Contract sum including this
Change Order in the amount of $1,297,978.95. Upon a motion made by Mr. Littrell, seconded by

Completion Affidavit on behalf of Warner & Sons, 29099 U. S. Highway 3 3, Elkhart, Indiana, for the

Mr. Caldwell advised that Mr. Toy Villa, Public Construction Manager, has submitted the Project
Completion Affidavit on behalf of Torok Excavation, 54195 Burdette Road, South Bend, Indiana,
for the above referred to project, indicating a final cost of $28,375.75. Upon a motion made by Mr.
Caldwell, seconded by Mr. Littrell and carried, the Project Completion Affidavit was approved.

APPROVAL OF PROPOSAL - BOND COUNSEL SERVICES FOR PROPOSED COUNTY
ECONOMIC DEVELOPMENT INCOME TAX REVENUE BONDS
Mr. Caldwell stated that the Board is in receipt of a Proposal between the City of South Bend and
Baker & Daniels, 205 West Jefferson, South Bend, Indiana, for services as bond counsel on the
Trammel Crow/Memorial Project. Mr. Caldwell noted that the Agreement is in the amount of not
more than $20,000.00. Therefore, upon a motion made by Ms. Roemer, seconded by Mr. Littrell and
carried, the Proposal was approved and executed.
APPROVAL OF LETTER OF AGREEMENT - HALL OF FAME PRESS BOX SUPPLEMENTAL
LIGHTING
Mr. Caldwell stated that the Board is in receipt of a Letter of Agreement between the City of South
Bend and The Troyer Group, 415 Lincolnway East, Mishawaka, Indiana, for preparation of
documentation to receive bids for the Hall of Fame Press Box supplemental lighting. Mr. Caldwell
noted that the Letter of Agreement is in the amount of not to exceed $5,000.00. Therefore, upon a
motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the Letter of Agreement was
approved and executed..

APPROVAL OF REOUEST TO RESCIND PARTIAL BID AWARD - 1997 STREET
MATERIALS _
Mr. Carl P. Littrell stated that there were errors in the April 11, 1997 recommendation for awards
for the above referred to materials. The bid from an eighth .bidder, St. Joseph Materials Company,
was overlooked in making the tabulation. The unit price bid by Bit -Mat Products for Item 2 was
transposed on the tabulations, which affected the bid ranking. Mr. Littrell recommended that the
award of Item 2 go to the lowest bidder, Bit -Mat Products, at a unit rate of $124.71 per ton, and the
award to Koch Materials Company for this item be rescinded. Similarly, Mr. Littrell recommended
award to the lowest bidder, St. Joseph Materials Company, on Items 10 through 14, which will
require the earlier award to Klink Trucking for Item 12 to be rescinded, as follows:

WHEREAS, the City of South Bend (City) desires to establish a pension plan for firefighters
pursuant to the provisions of Section 401(a) of the Internal Revenue Code of 1986, as amended; and
WHEREAS, the Public Employees Benefit Services Corporation (PEBSCO) has been
selected to provide record keeping and administrative services for the pension plan.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF
THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
1) That the City appoints Public Employees Benefit Services Corporation (PEBSCO) to
provide record keeping, employee education, and other technical and administrative services relating
to the plan.
2) That the City hereby authorizes and directs M. Catherine Roemer (City Controller) and/or
Catherine Hubbard-Shead (Director of Human Resources) to perform all acts and sign all documents
necessary to put said plan into operation.
3) That Catherine Hubbard-Shead is hereby appointed as Trustee and upon acceptance, by
executing the Adoption Agreement of said plan, shall receive the necessary reports, notices, etc., from
Public Employees Benefit Services Corporation (PEBSCO) and Nationwide Life Insurance Company.

development of good quality, affordable housing for residents with low or moderate incomes; and
WHEREAS, the above -described real estate is in an area which has been targeted for
redevelopment; and
WHEREAS, I.C. 36-1-11-4.2 allows the Board to sell property not acquired through eminent
domain for the purpose of promoting an economic development project or facilitating compatible land
use planning; and
and
WHEREAS, the construction of affordable in -fill housing is consistent with these purposes;
WHEREAS, the Board will obtain joint appraisals on each parcel by two appraisers.

APPROVAL OF PURCHASE AGREEMENT - AMERICAN HOME DREAMS INC.
Mr. Caldwell stated that the Board is in receipt of an Agreement between the City of South Bend and
American Home Dreams, Inc., for in -fill housing for low to moderate families on Broadway Street.
Therefore, upon a motion made by Mr. Caldwell, seconded by Mr. Littrell and carried, the Agreement
was approved and executed. In addition, Mr. Jon Hunt, Executive Director, Community and
Economic Development, submitted a letter to the Board stating that the Board of Public Works will
consider the sale of City -owed lots to American Home Dreams, Inc., for the development of
affordable housing. AHDI is a private, non-profit company established to build or rehabilitate single-
family housing in South Bend's lower income neighborhoods. Mr. Hunt noted for the record that he
serves on the board of AHDI.

APPROVAL OF REQUEST TO ADVERTISE FOR STATEMENTS OF QUALIFICATIONS FOR
PROFESSIONAL SERVICES - DESIGN OF NEW PRELIMINARY TREATMENT - WWTP
In a letter to the Board, Mr. John Dillon, Director, Environmental Services, requested permission to
advertise for the above referred to services at the Wastewater Treatment Plant. Upon a motion made
by Ms. Roemer, seconded by Mr.. Littrell and carried, the request was approved.
APPROVAL OF RECOMMENDATION - TO CONDUCT CHET WAGGONER LITTLE
LEAGUE PARADE
Mr. Caldwell stated that favorable recommendations have been received by the Division of
Engineering, Park Department, Police Department and the City Attorney's office, in reference to a
request as submitted by Mr. Ray Snyder, 1335 Portage, South Bend, Indiana to conduct the above
referred to parade on Saturday, May 3, 1997, beginning at 8:00 a.m., on the designated route as
submitted. Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the
recommendation was approved.

Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation. Petition as
completed by Ms. Betsy Roessner, 729 Cushing Street, .South Bend,Indiana to vacate the following
alley:
The first east -west alley north of Lindsey Street from the west right-of-way line of North
Cushing Street to the east right-of-way line of the first north/south alley west of North
Cushing Street for a distance of approximately 128 feet in length and.14 feet in width. Part
located in Cushing and Lindsey's Sub, City of South Bend, St. Joseph County, Indiana.
Mr. Caldwell advised that the Board is in receipt of favorable recommendations concerning this
Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation,
Department of Economic Development and the Department of Public Works. Therefore, Mr.
Caldwell made a motion that the Board send a favorable recommendation to the Common Council
concerning this Vacation Petition. Ms. Roemer seconded the motion which carried.
APPROVE TRAFFIC CONTROL DEVICES
Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the following three (3)
traffic control devices were approved:

Ms. M. Catherine Roemer, City Controller, submitted claims in the amount of $1,188,614.09 dated
April 21, 1997 and recommended approval. Mr: Caldwell made a motion that the claims. be approved
and the reports as submitted be filed. Ms: Roemer seconded the motion which carried.

PRIVILEGE'OF THE FLOOR
Mr. Caldwell stated that Mr. Donald Cornelis, Fraternal Order of Police, extended an invitation to
Board of Public Works members to join them in their tribute to the departed police officers, on
Thursday, May 15, 1997, at 3:00 p.m., at the plaza of the Municipal Services Facility.
ADJOURNMENT
There being no further business to come before the Board, upon a motion made by Mr. Littrell,
seconded by Mr. Caldwell and carried, the meeting adjourned at 9:54 a.m.
