The regular meeting of the Board of Public Works was convened at 9:36 a.m. on Monday, May
11,1998, by Board President James R. Caldwell, with Mr. Carl P. Littrell and Ms. M. Catherine
Roemer present. Also present was Board Attorney Michelle Engel. Mr. Caldwell welcomed the new
Director of Public Works, Mr. Lew Powell, and also thanked Mr. Littrell for filling in as Acting .
Director.
AGENDA ITEMS ADDED/AGENDA ITEM TABLED
Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, three (3) Resolutions
were added to the agenda. The Bid Award for Miscellaneous Golf Course Equipment was tabled.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Ms. Roemer, seconded by Mr. Littrell and carried, the minutes of the regular
meeting of the Board held on May 4, 1998, were approved.
APPEAL DENIED - TAXI CAB DRIVER'S LICENSE - VERNON JOHNSON
This was the date set for the appeal of a Taxi Cab Driver's License, as requested by Mr. Vernon
Johnson. Ms. Ann Carol Simons, Assistant City Attorney, was present, and stated that Mr. Johnson
has a criminal history and a driving record, and should not be permitted to drive a cab. He has
speeding violations, driving without a proper license, and numerous failures to appear. The criminal
history stems from Mississippi, including robbery and criminal conversion. Detective Glen McQueen,
Police Department, was present, and attested to the criminal history of Mr. Johnson. He has accrued
five suspensions for driving with an improper license and for failure to appear. In 1984 he had two
(2) counts of burglary. By his own admission, Mr. Johnson has not responded to fines or court dates.
He presently had a conditional driver's license, based on his last DUI.
Mr. Vernon Johnson was present, and stated that the failure to appear in court was his own fault.
His conviction was in 1976, over twenty years ago, and he feels that it should not count after twenty
years. He has had points on his driver's license down to two (2), but with his first DUI, it went up
to ten (10) points on his license. Ms. Simon stated that he has not been driving with a license in the
City for the past decade. The taxi company he is working for is under advisement. His last DUI was
in December of 1997, for failure to stop at a railroad crossing, and that his continued failure to appear
for a court appearance shows a lack of responsibility. Mr. Vernon submitted a form showing his
name on Life Treatment Center application.
Mr. Johnson stated that the cab companies do not push the drivers to obtain a City license. He stated
that eighty percent of the drivers do not have licenses, and have never been asked to obtain them.
Ms. Simons replied that the cab companies are aware of their driver's requiring licenses, and the law
has remained unchanged. There was no one else present to make a statement. Upon a motion made
by Mr. Littrell, seconded by Ms. Roemer and carried, the appeal was denied.
OPENING OF BIDS - JANITORIAL SUPPLIES
This was the date set for receiving and opening of sealed bids for the above referred to items. The
Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News
which were found to be sufficient. The following bids were opened and publicly read:

Mr. Ken Zmudzinski, Environmental Services, advised the Board that on April 27, 1998, bids were
received and opened for the above referred to project. After reviewing those bids, Mr. Zmudzinski
recommends that the Board award the contract to Metro Environmental Contractors, Inc., I I I I West
Dundee Road, Wheeling, Illinois in the amount of $15,472.50. Therefore, Mr. Caldwell made a
motion that the recommendation be accepted* and the bid be awarded as outlined above. Ms. Roemer
seconded the motion which carried.
AWARD QUOTATION - SOUTHEAST NEIGHBORHOOD SITE PREPARATION - PROJECT
NO. 98-41-1
Mr. Marco Marian, Planning Department, advised the Board that on May 4, 1998, quotations were
received and opened for the above referred to project. After reviewing those quotations, Mr. Mariani
recommends that the Board award the contract to Bradberry Brothers, Inc., 20061 West Dice Street,
South Bend, Indiana, in the amount of $50,033.00. Therefore, Mr. Littrell made a motion that the
recommendation be accepted and the quotation be awarded as outlined above. Ms. Roemer seconded
the motion which carried.
APPROVE CHANGE ORDER - 1997 SEWER LINING PROGRAM - PROJECT NO. 98-52
Mr. Caldwell advised that Mr. Toy Villa, Public Construction Manager, has submitted Change Order
No. 1 on behalf of Insituform Midwest, Inc., Post Office Box 458, Lemont, Illinois indicating that
the Contract amount be increased $68,422.00 for a new Contract sum including this Change Order
in the amount of $826,165.00. Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and

No. 3 on behalf of Youngs Excavating, Inc., 50563 Dusty Trail Court, Granger, Indiana indicating
that the Contract amount be increased $9,596.00 for a new Contract sum including this Change Order
in the amount of $420,445.62. Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and
carried, the Change Order was approved.
APPROVE FINAL CHANGE ORDER AND PROJECT COMPLETION AFFIDAVIT -
SOUTHEAST PARTNERSHIP SIDEWALK CURB AND APPROACH IMPROVEMENTS -

Mr. Caldwell advised that Mr. Toy Villa, Public Construction Manager has submitted the Final
Change Order on behalf of Batteast Construction Company, Inc., 430 East LaSalle, South Bend,
Indiana indicating that the contract amount be increased by $5,435.20 for a new contract sum
including this Change Order in the amount of $85,815.20. Additionally submitted was the Project
Completion Affidavit indicating this new final cost. Upon a motion made by Mr. Littrell, seconded
by Ms. Roemer and carried, the Final Change Order and the Project Completion Affidavit were
approved subject to the filing of the appropriate three-year Maintenance Bond.

subject to the filing of the appropriate three-year Maintenance Bond.
APPROVE CONSTRUCTION CONTRACT - 1998 PUBLIC WORKS PARTNERSHIP
PROGRAM - ZONES 1 AND 5 - PROJECT NO. 98-27
Mr. Caldwell advised that in accordance with the bid awarded on March 30, 1998, to Niles Concrete
Sawing and Construction, Inc., 2580 East Detroit Road, Niles, Michigan, in the amount of
$202,537.50 for the above referred to project, a Contract in said amount was being submitted for
Board approval. Upon a motion made by W. Littrell, seconded by Ms. Roemer and carried, the
Contract was approved and the appropriate Certificate of Insurance, Performance Bond and Labor
and Materials Payment Bond as submitted were filed.
APPROVAL OF PROPOSAL FOR SUBDIVISION AND VARIANCE SERVICES - AMERICAN
HOME DREAMS FIRST MINOR, BROADWAY STREET

Welding & Fabrication, Inc., 1670 East Davis Drive, Terre Haute, Indiana, in the amount of
$978,300.00 for the above referred to project, a Contract in said amount was being submitted for
Board approval. Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the
Contract was approved.
APPROVAL OF AGREEMENT - TEMPORARY USE OF THE PUBLIC SIDEWALK FOR A
SIDEWALK CAFE - IRISH ROSE TEA ROOM
Mr. Caldwell stated that the Board is in receipt of an Agreement between the City of South Bend and
Ms. Tina Thornton, Irish Rose Tea. Room, 230 South Michigan, South Bend, Indiana, for use of the
public sidewalk for a sidewalk cafe at 230 South Michigan. Therefore, upon a motion made by Mr.
Caldwell, seconded by Ms. Roemer and carried, the Agreement was approved and executed.
APPROVAL OF GRANT AGREEMENT - NEIGHBORHOOD YOUTH GRANT PROGRAM
Mr. Caldwell stated that the Board is in receipt of an Agreement between the City of South Bend and
the Berean SDA Church, 601 West Colfax, South Bend, Indiana, for a youth group project,
consisting of the formation of a signing choir for the hearing impaired.. Mr. Caldwell noted that the
Agreement is in the amount of $2,000.00. Therefore, upon a motion made by Caldwell, seconded
by Ms. Roemer and carried, the Agreement was approved and executed.

WHEREAS, under Indiana Code 36-9-6-3, the Board of Public Works of the City of South
Bend has custody of and may maintain all real property of the City of South Bend; and
WHEREAS, the City, through the Board, is desirous of transferring the Real Property to the
South Bend Heritage Foundation, a nonprofit corporation, exempt from income taxation under 501(c)
of the Internal Revenue Code, for development of three (3) sites for residential construction; and
WHEREAS, the Board received favorable recommendations for the transfer of the Real
Property to the South Bend Heritage Foundation from the Department of Code Enforcement,

WHEREAS, the City of South Bend, Indiana (City), acting by and through the Board of
Public Works, hereby expresses its desire to acquire Real Property from the Commission; and
WHEREAS, Redevelopment is desirous of transferring the Real Property to the City; and
WHEREAS, pursuant to I.C. 36-7-14-3, the South Bend Redevelopment Commission
("Commission") is the governing body of the City of South Bend, Department of Redevelopment and,
pursuant to I.C. 36-7-14-12.2 may dispose of the Real Property; and
WHEREAS, pursuant to I.C. 36-7-14-3, Redevelopment, acting by and through Commission,
may exchange or transfer property with another governmental entity upon terms and conditions

FROM SOUTH BEND REDEVELOPMENT COMMISSION
Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the following
Resolution was adopted by the Board of Public Works:
RESOLUTION NO. 48-1998
A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE
CITY OF SOUTH BEND, INDIANA ACCEPTING THE TRANSFER OF
REAL PROPERTY FROM SOUTH BEND REDEVELOPMENT COMMISSION
WHEREAS, the City of South Bend, Indiana, Department of Redevelopment
(Redevelopment) is the owner of the following described real property situated in St. Joseph County,
Indiana:
See Exhibit A attached
(hereinafter referred to as the Real Property), and;
WHEREAS, the City of South Bend, Indiana (City), acting by and through the Board of
Public Works, hereby expresses its desire to acquire Real Property from the Commission; and
WHEREAS, Redevelopment is desirous of transferring the Real Property to the City; and
WHEREAS, pursuant to I.C. 36-7-14-3, the South Bend Redevelopment Commission
("Commission") is the governing body of the City of South Bend, Department of Redevelopment and,
pursuant to I.C. 36-7-14-12.2 may dispose of the Real Property; and
WHEREAS, pursuant to I.C. 36-7-14-3, Redevelopment, acting by and through Commission,
may exchange or transfer property with another governmental entity upon terms and conditions
agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions
of each entity.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF
THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS:
1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and generally
described as follows:

by Commission to the City of South Bend, Indiana, shall be, and hereby is, accepted, subject to the
adoption of a resolution by the South Bend Redevelopment Commission substantially identical in its
terms and conditions to this resolution.
2. That upon receipt of fully executed quitclaim deed(s) to the Real Property from
Commission, the Clerk of the Board of Public Works of the City of South Bend, Indiana is hereby
authorized and directed to cause the recording of said quitclaim deed(s) in the Office of the St. Joseph
County Recorder.
3. That this Resolution shall be in full force and effect upon its adoption.

APPROVAL OF APPRAISAL OF CONRAIL RIGHT OF WAY
In a memorandum to the Board, Mr. Larry Magliozzi, Planning Department, requested approval of
an appraisal of the right of way, for a two mile segment of railroad that is being proposed by Conrail
for abandonment, as shown in the map as submitted. The fee for the appraisal will not be less than
$5,500 and will not exceed $7,500. Upon a motion made by Ms. Roemer, seconded by Mr. Caldwell
and carried, the request was approved.
APPROVAL OF RESIDENTIAL TAX ABATEMENT APPLICATION
In a memorandum to the Board, Mr. Marco Mariani, Planning, requested approval of a residential
tax abatement application for construction and sale of approximately twenty (20) new single family
homes in the Southeast Neighborhood. Upon a motion made by Ms. Roemer, seconded by Mr.
Caldwell and carried, the tax abatement application was approved.
APPROVAL OF REOUEST TO ADVERTISE FOR THE RECEIPT OF BIDS - NEAR WESTSIDE
PARTNERSHIP SERVICE AREA - PROJECT NO. 98-20
In a memorandum to the Board, Ms. Deb Martin, Division of Engineering, requested permission to
advertise for the receipt of bids for the above referred to project. Ms. Martin stated that this project
will replace curbs, sidewalks and approaches in the Near Westside Partnership Service Area., Funding
will come from CDGB funds. Therefore, upon a motion made by Mr. Littrell, seconded by Ms.
Roemer and carried, the request to advertise for the receipt of bids was approved.
APPROVAL OF REOUEST TO ADVERTISE FOR THE RECEIPT OF BIDS - WESTSIDE
PARTNERSHIP SERVICE AREA - PROJECT NO. 98-23
In a memorandum to the Board, Ms. Deb Martin, Division of Engineering,. requested permission to
advertise for the receipt of bids for the above referred to project. Ms. Martin stated that this project

In a memorandum to the Board, Mr. Jason Durr, Environmental Services, requested permission to
advertise for the receipt of bids for the above referred to project. Mr. Durr stated that funding for
this project will come from Wastewater Treatment Capital Funds. Therefore, upon a motion made

In a memorandum to the Board, Mr. Carl Littrell, Division of Engineering, requested permission to
advertise for the receipt of bids for the above referred to project. Therefore, upon a motion made
by Mr. Littrell, seconded by Ms. Roemer and carried, the request to advertise for the receipt of bids
was approved.
FAVORABLE RECOMMENDATION - PETITION TO VACATE A STREET
Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as
completed by Mr. Phil Newbold, Memorial Hospital, 615 North Michigan, South Bend, Indiana, to
vacate the following alley:
West Navarre Street from the west right of way of North Michigan Street to the east right
of way of North Main Street for a distance of approximately 344 feet and a width of 82.5 feet.
Part located in South Bend (Original Town), City of South Bend, St. Joseph County.
Mr. Caldwell advised that the Board is in receipt of favorable recommendations concerning this
Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation,
Department of Economic Development and the Department of Public Works. Therefore, Mr.
Caldwell made a motion that the Board send a favorable recommendation to the Common Council
concerning this Vacation Petition. Ms. Roemer seconded the motion which carried.
FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY
Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as

to vacate the following alley:
The first north south alley east of Main Street from the south right of way of West Navarre
Street to the north right of way of the first east west alley south of West Navarre Street for
a distance of approximately 198 feet and a width of 14 feet. Part located in South Bend
(Original Town), St. Joseph County, Indiana.
Mr. Caldwell advised that the Board is in receipt of favorable recommendations concerning this
Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation,
Department of Economic Development and the Department of Public Works. Therefore, Mr.
Caldwell made a motion that the Board send a favorable recommendation to the Common Council
concerning this Vacation Petition. Ms. Roemer seconded the motion which carried.
APPROVAL OF RECOMMENDATION - TO CLOSE STREETS -NEIGHBORHOOD GARAGE
SALE
Mr. Caldwell stated that favorable recommendations have been received by the Division of
Engineering, Police Department and the City Attorney's office, in reference to a request as submitted
by Ms. Jamie McKinstry, 1141 Cleveland, South Bend, Indiana to conduct the above referred to
neighborhood garage sale, on Saturday, May 23, 1998, on Cleveland from Humbolt to Vassar. Upon
a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the recommendation was
approved.

APPROVAL OFRECOMMENDATION - TO CONDUCT BLOCK PARTY
Mr. Caldwell stated thatfavorable recommendations have been received by the Division of
Engineering, Code Enforcement, Police Department and the City Attorney's office, in reference to
a request as submitted by Ms. Donna Goins, 1050 North O'Brien, South Bend, Indiana to conduct
the above referred to block party, on Friday, June 12, 1998, from 3:00 p.m. until 8:00 p.m., on
O'Brien from Lincolnway to Vassar. Upon a motion made by Mr. Caldwell, seconded by Ms.
Roemer and carried, the recommendation was approved.
