REGULAR MEETING
APRIL 20, 1998
The regular meeting of the Board of Public Works was convened at 9:35 a.m. on Monday, April 20,
1998, by Board President James R. Caldwell, with Mr. Carl P. Littrell and Ms. M. Catherine Roemer
present. Also present was Board Attorney Michelle Engel.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the minutes of the regular
meeting of the Board held on April 13, 1998, were approved.
OPENING OF BIDS - TWO (2) MORE OR LESS, ARTICULATING WHEEL LOADER
This was the date set for receiving and opening of sealed bids for the above referred to equipment.
The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County

was rejected, as it did not contain a Bid Bond. Upon a motion made by Mr. Littrell, seconded by Ms.

Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the above bids were
referred to the Police Department for review and recommendation.
APPROVE CHANGE ORDER - OLIVE ROAD SEWER EXTENSION - PROJECT NO. 96-84
Mr. Caldwell advised that Mr. Toy Villa, Public Construction Manager, has submitted the Final
Change Order, on behalf of HRP Construction, Inc., Post Office Box 266, South Bend, Indiana
indicating that the Contract amount be increased $4,072.00 for a new Contract sum including this
Change Order by in the amount of $73,820.00. Upon a motion made by Mr. Littrell, seconded by
Ms. Roemer and -carried, the Change Order was approved.
APPROVE PROJECT COMPLETION AFFIDAVIT - EQUIPMENT SERVICES FACILITY
EXPANSION - PROJECT NO. 96-68
Mr. Caldwell advised that Mr. Toy Villa, Public Construction Manager, has submitted the Project
Completion Affidavit on behalf of the Robert Henry Corporation, 404 South Frances, South Bend,
Indiana, for the above referred to project, indicating a final cost of $580,947.00. Upon a motion
made by Mr. Littrell, seconded by Ms. Roemer and carried, the Project Completion Affidavit was
approved.
APPROVAL OF RECOMMENDATION - TO CONDUCT SECOND ANNUAL MEIJER
GOLDENHEART AWARD RELAY RUN
Mr. Caldwell stated that favorable recommendations have been received by the Division of
Engineering, Park Department, Police Department and the City Attorney's office, in reference to a
request as submitted by Mr. Steven VanWagoner, Meijer, Inc., 2929 Walker NW, Grand Rapids,
Michigan to conduct the above referred to run, on Monday, May 18, 1998, beginning at 11:00 a.m.,
on the designated route as submitted. Upon a motion made by Mr. Littrell, seconded by Ms. Roemer
and carried, the recommendation was approved.
APPROVAL OF RECOMMENDATION - TO CONDUCT WEST SIDE MEMORIAL DAY
PARADE
Mr. Caldwell stated that favorable recommendations have been received by the Division of
Engineering, Park Department, Police Department and the City Attorney's office, in reference to a
request as submitted by Ms. Adeline Jaskowiak, 727 South Illinois, South Bend, Indiana to conduct
the above referred to parade, on Monday, May 25, 1998, beginning at 8:00 a.m., on the designated
route as submitted. Upon a motion made by Ms. Roemer, seconded by Mr. Littrell and carried, the
recommendation was approved.
APPROVAL OF RECOMMENDATION - TO CONDUCT TOOTSIE ROLL HANDOUTS -
KNIGHTS OF. COLUMBUS
Mr. Caldwell stated that favorable recommendations have been received by the Division of
Engineering, Building Department, Fire Department, Police Department and the City Attorney's
office, in reference to a request as submitted by Mr. Martin Moorman, Knights of Columbus, 60155
Ruby Street, South Bend, Indiana to conduct the above referred to solicitation at the areas as
submitted, from May 9,1998 through May 30, 1998. Upon a motion made by Ms. Roemer, seconded
by Mr. Littrell and carried, the recommendation was approved.

APPROVAL OF RECOMMENDATION - LICENSE APPLICATION - SIDEWALK SALE
PERMIT/ AGREEMENT FOR TEMPORARY USE OF A PUBLIC SIDEWALK FOR A
SIDEWALK CAFE
Mr. Caldwell stated that favorable recommendations have been received by the Division of
Engineering, Building Department, Design Review, Fire Department, Police Department and the City
Attorney's office, in reference to a request as submitted by Ms. Brenda Finnigan, the State Cafe, 216
South Michigan Street, South Bend, Indiana to place tables and chairs in the right-of-way in front of
the State Cafe. Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the
recommendation was approved, as well as the Agreement for Temporary Use of a Public Sidewalk
for a Sidewalk Cafe.
APPROVAL OF RECOMMENDATION - TO CONDUCT CANDLELIGHT WALK - AIDS
MINISTRIES
Mr. Caldwell stated that favorable recommendations have been received by the Division of
Engineering, Park Department, Police Department and the City Attorney's office, in reference to a
request as submitted by Mr. Michael Beatty, AIDS Ministries, Post Office Box 11582, South Bend,
Indiana to conduct the above referred to walk, on Sunday, May 3, 1998, on the designated route as
submitted. Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the
recommendation was approved.

Mr. Caldwell stated that favorable recommendations have been received by the Division of
Engineering, Code Enforcement, Park Department, Building Commissioner, Police Department and
the City Attorney's office, in reference to a request as submitted by Mr. Jose Pages, Post Office Box
303, Myakka City, Florida to conduct the above referred to circus, on April 23, 1998 at 1901 South
Kemble Street. Upon a motion made by Mr. Littrell , seconded by Ms. Roemer and carried, the
recommendation was approved.

APPROVAL OF REQUEST TO ADVERTISE FOR THE RECEIPT OF BIDS - JANITORIAL
SUPPLIES
In a memorandum to the Board, Mr. George Zana, Purchasing, requested permission to advertise for
the receipt of bids for the above referred to supplies. Mr. Zana stated that funding will be provided
from each department's fund. Therefore, upon a motion made by Mr. Caldwell, seconded by Ms.
Roemer and carried, the request to advertise for the receipt of bids was approved.
ADOPT RESOLUTION NO. 40-1998 - DISPOSAL OF CITY -OWNED PROPERTY
Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, Resolution No. 40-1998
was adopted by the Board of Public Works:
RESOLUTION NO. 40-1998
A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS
ON DISPOSAL OF UNFIT AND/OR OBSOLETE PROPERTY
WHEREAS, it has been determined by the Board of Public Works that the following property is
unfit for the purpose for which it was intended and is no longer needed by the City of South Bend:

WHEREAS, Indiana Code 36-1-11-6(c) permits and establishes procedure for disposal of
personal property which is unfit for the purpose for which it was intended and which is no longer
needed by the City.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South
Bend that the items listed above are no longer needed by the City; are unfit for the purpose for which
they were intended and have an estimated value of less than five thousand dollars ($5,000.00).
BE IT FURTHER RESOLVED, that said items may be transferred or sold at public auction
or private sale, without advertising. However, if the property is deemed worthless, such may be
demolished or junked.
ADOPTED this 20th day of April, 1998.

APPROVE TITLE SHEET - MAYFLOWER ROAD - PHASE IIA - PROJECT NO. 98-13
Mr. Caldwell advised that the Title Sheet for the above referred to project was being presented at this
time for execution. Upon a motion made by Mr. Caldwell; seconded by Ms. Roemer and carried, the
above referred to Title Sheet was approved and signed.
APPROVE CONTRACTOR AND PERFORMANCE BONDS
Mr. Larry D. Spradlin, Sr., Engineer, Division of Engineering, recommended that the following
Bonds be approved as follows:

Mr. Littrell made a motion that the recommendation be accepted and that the Bonds be approved as
outlined above. Ms. Roemer seconded the motion which carried.
APPROVE CLAIMS
Ms. M. Catherine Roemer, City Controller, submitted claims in the amount of $1,496,930.00 and
$2,031,416.99 and recommended approval. Additionally, Mr. Juan Manigault, Executive Director,
WDS of Northern Indiana, submitted two (2) lists containing claims in the amount of $222,816.94
and $40,132.04 and recommended approval. Ms. Roemer made a motion that the claims be approved
and the reports as submitted be filed. Mr. Littrell seconded the motion which carried.
ADJOURNMENT
There being no further business to come before the Board, upon a motion made by Mr. Caldwell,
seconded by Mr. Littrell and carried, the meeting adjourned at 10:08 a.m.
