RESOLUTION 3795-07 Passed by the Common Council of the City of South Bend, Indiana September 24, Attest: City Clerk Vice President of Common Council Presented by me to the Mayor of the City of South Bend, Indiana September 25, 20 07 Approved and signed by me so.,r nmF,n r ~ ~ 20 U 7 07 20 City Clerk ~- RESOLUTION NO. 3 7 ~ S - D A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS 2500 Green Tech Drive AS AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A TEN-YEAR REAL PROPERTY TAX ABATEMENT FOR Mother Earth, LLC (Green Tech Transfer & Recycling LLC) WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 2500 Green Tech Drive, South Bend, Indiana, and which is more particularly described as follows: That part of the Northeast Quarter of Section 23, Township 37 North, Range 2 East, Portage Township, City of South Bend, St Joseph County, Indiana, which is described as Beginning at a point on the East line of said quarter section which is N. 00 degrees-32"-42"E., 633.94 feet from the Southeast corner of said Northeast Quarter, thence North 89 degrees-32'-08"W. a distance of 513.91 feet; thence N. 00 degrees-37'-40" E. a distance of 92.64 feet; thence N. 89 degrees-32'-08 W. a distance of 280.00 feet; thence N. 00 degrees- 37'- 40" E. a distance of 467.98 feet; thence S. 89 degrees-26'-14" E. a distance of 197.94 feet, thence N. O1 degrees-49'-53" E, a distance of 32.63 feet; thence S. 89 degrees-15'-43" E. a distance of 46.11 feet; thence S. 89 degrees- 26'-14" E. a distance of 548.32 feet to the East line of said Northeast Quarter, thence S. 00 degrees-32'-42" W. along said East line a distance of 591.88 feet to the point of beginning containing 10.05 acres. and which has no Key Number presently, as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6-1.1-12.1-2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrance's and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Real property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted Real property tax deduction for a period often (10) years, and further determines that the petition, the Memorandum of Agreement between the Petitioner and the City of South Bend, and the Statement of Benefits comply with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6-1.1-12 et sea. SECTION III. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approved by the Mayor. Also attached is a copy of the petition, Statement of Benefits form, and supporting information. The report contains the Department's findings relative to the above petition. The petitioner, Mother Earth, LLC (Green Tech Transfer & Recycling LLC) proposes to rehabilitate a Brownfield site and construct a new state-of--the-art trash transfer/recycling facility. The site is currently owned by St. Joseph County. It will be purchased by Mother Earth, LLC who will in turn lease the site to Green Tech Transfer & Recycling LLC. Mother Earth, LLC is seeking aten-year real property tax abatement, and a representative of Mother Earth, LLC (Green Tech Transfer & Recycling LLC) will be available to meet with the Committee on Monday, August 27, 2007. Pursuant to Chapter 2, Article 6, Section 2-82 of the Municipal Code of the City of South Bend, this petition was referred to the Department of Community and Economic Development for purposes of investigation and preparation of a report determining whether the area qualifies as an Economic Revitalization Area pursuant to 1.C.6-1.1-12.1 and whether all zoning requirements have been met. The Department of Community and Economic Development has reviewed the petition, investigated the area, and makes the following report. PROJECT SUMMARY Green Tech Transfer & Recycling LLC/Mother Earth, LLC are proposing to develop a 10.05 acre Brownfield Development site as astate-of--the-art trash recycling/transfer facility. The site is currently owned by St. Joseph County because of back property tax collection issues with the site. It will be purchased by Mother Earth and leased to Green Tech. The project is on the former Studebaker Plant 8 site off of Ewing Avenue. The prior decaying building on the site is being 98% recycled upon deconstruction. Anew 52,800 sq. ft processing facility will be constructed. The estimated cost of the new building, driveways and storage infrastructure is $1,608,000. The amount of waste that will be converted annually in the facility is estimated at 8,400,000 pounds. Material brought to the transfer station will be unloaded onto the tipping floor, inspected and sorted. Recyclable material will be moved to automatic and manual sorting conveyor and baler systems to be processed and marketed. Non-recyclable material will be transported to approved landfills. EMPLOYMENT IMPACT Per the petition, it is estimated that the total project will create (9) nine new, permanent, full-time jobs and (0) zero part-time, permanent jobs within the first year representing a new annual payroll of $217,256. The project is developing a completely new facility and, therefore, does not have any existing employees. ABATEMENT QUALIFICATION 1. A review of the tax abatements previously granted finds that the petitioner has not been granted or associated with any previous tax abatements: 2. The Building Commissioner has reviewed the petition and finds the property to be properly zoned for the proposed project. 3. A review of the Tax Abatement Ordinance No. 9394-03 finds that the petitioner does meet the qualifications fora (10) ten-year real property tax abatement under Section 2-79, Industrial Developments in the City-wide District.
