HomeMy WebLinkAbout02/21/07 Board of Public Safety Minutesr~o 4 a 1 1 1 PUBLIC AGENDA SESSION FEBRUARY 21, 2007 The Board of Public Safety met in the Public Agenda Session at 8:10 a.m. on Wednesday, February 21, 2007 with President Jesusa Rodriguez, Board Members Donald Alford, Patrick D. Cottrell and Bruce J. BonDurant present. Board Member Juanita Dempsey was absent. Also present were Police Chief Thomas Fautz, Assistant Fire Chief Rick Switalski and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13~' Floor, County City Building, South Bend, Indiana. Board members discussed the following item(s) from that list: - Minutes There were no corrections to the minutes. - Addition of Agenda Items Chief Fautz stated that the Police Department had two additions to the agenda. The first was the January 2007 statistics and the second was a letter of donation to the South Bend Police Department K-9 Unit by the St. Joseph County Library in the amount of $125.00. - Findings -Police Department Mr. Bodnar submitted the Findings in the Anthony Ross grievance and stated that the Findings were prepared to reflect the Board's decision. - Towing Statistics -Police Department Mr. Bodnar noted that the number of tows was down for 2006. - Minimum Manning -Fire Department Mr. Bodnar stated that due to the small agenda of this meeting, he had requested the Fire Department to present to "the Board the minimum staffing requirements of the Fire Department. Mr. Bodnar indicated that this report is presented annually when time allows. Assistant Chief Switalski reviewed the submitted Article 20 of the Collective Bargaining Agreement which sets out the requirements of manpower on duty in a twenty-four hour shift, regulates the ten year Contract with the County for Paramedics and the Contract with Memorial Hospital's Neo-Natal Unit, and regulates time off for emergency leave. Mr. Alford stated that in his three years on the Board there had not been any minorities hired into the Fire Department and he was concerned about the hiring practices. Assistant Chief Switalski stated that the Fire Department makes attempts to go out and recruit from the Hispanic and African American communities, but they don't have a good response. He also noted that there is more of a problem in passing the written tests in those communities. The ranking system is based on their score on the written and oral test. The Agility Test is a pass or fail test. In an attempt to get more Hispanic and African American recruits, the Fire Department offers a tutoring session the week before the written test, free of charge. Assistant Chief Switalski noted that they still have a low turnout from those communities and the Fire Department is concerned about this and continues to work to correct the situation. BonDurant, Member FEBRUARY 21, 2007 The Board of Public Safety met in Executive Session on Wednesday, February 21, 2007, at 8:52 a.m. The meeting was held in the Mayor's Conference Room, 14th Floor, County City Building, South Bend, Indiana, for the purposes specified in I.C. 5-14-1.5-6.1 (b) (2) (B) and (b) (6) (A). President Jesusa Rodriguez and Board Members Donald Alford, Bruce J. BonDurant and Patrick Cottrell were present. Board Member Juanita Dempsey was absent. Also present were Police Chief Thomas Fautz, Assistant Fire Chief Rick Switalski and Board Attorney Thomas Bodnar. Board members did not discuss any subject matter other than the subject matter as specified in the Public Notice. Martin, Cler REGULAR MEETING FEBRUARY 21, 2007 1 1 The Board of Public Safety met in the regular meeting at 9:18 a.m. on Wednesday, February 21, 2007, with President Jesusa Rodriguez and Board Members Donald Alford, Bruce J. BonDurant and Patrick D. Cottrell present. Board Member Juanita Dempsey was absent. Also present were Police Chief Thomas H. Fautz, Assistant Fire Chief Rick Switalski and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13th Floor, County-City Building, South Bend, Indiana. APPROVE MINUTES OF PREVIOUS MEETINGS President Rodriguez advised that if there were no objections by members of the Board, the minutes of the Public Agenda Session, Executive Session, and Regular meetings of the Board held on January 31, 2007 and the Special Meeting held on February 8, 2007 would be accepted. There being PTO REGULAR MEETING FEBRUARY 21, 2007 no further discussion, upon a motion made by Ms. Rodriguez, seconded by Mr. Alford and carried, the minutes were accepted. POLICE DEPARTMENT FINDINGS OF GRIEVANCE NO. 07-01 -ANTHONY ROSS In a letter to the Board, Mr. Bodnar submitted the Findings of the grievance of Corporal Anthony Ross. Upon a motion by Mr. Cottrell, seconded by Mr. BonDurant and carried the Findings were accepted as follows: The Board of Public Safety having heard argument at its regular meeting on January 31, 2007, as the fourth step of the grievance in this matter, finds that grievance was not timely filed. Section 2 of Article 24 of the 2006-2008 Working Agreement between the City of South Bend, Indiana and the Fraternal Order of Police South Bend Lodge No. 36 states that the three (3) days leave occurs only in the event of a child born to an employee or an employee's spouse. The word "spouse" was understood by both the FOP and the City of South Bend during negotiations to mean a legal wife or husband. While this Article could be renegotiated, it was understood to mean that it would not cover a child fathered out of wedlock. THEREFORE, THE GRIEVANCE IS DENIED. BonDurant, Member ACCEPT AND FILE 2006 SOUTH BEND POLICE TOWING STATISTICS The above referred to Report was submitted to the Board, as required by Resolution No. 62-2002. Mr. Bodnar rioted that the number of tows for 2006 are down from the previous year. The Board accepted and filed the Report. ACCEPT AND APPROVE RETIREMENT - PAUL HAMMONS President Rodriguez advised that Chief Thomas Fautz has submitted to the Board the Application and Declaration for Retirement for Lieutenant Paul Hammons effective February 23, 2007. Chief Fautz noted that he has served the Department with loyalty and distinction during the last thirty-two (32) years, eight (8) months and fourteen (14) days. Chief Fautz joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend Police Department and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Cottrell, seconded by Mr. BonDurant and carried, the retirement was accepted and approved. ACCEPT AND APPROVE RETIREMENT - JOHN MCMULLUM President Rodriguez advised that Chief Thomas Fautz has submitted to the Board the Application and Declaration for Retirement for Lieutenant John McMullum effective February 15, 2007. Chief Fautz noted that he has served the Department with loyalty and distinction during the last thirty-five (35) years, one (1) month and twenty-six (26) days. Chief Fautz joined the Board in thanking him for his commitment, dedication, and years of distinguished service to the South Bend Police Department and the citizens of South Bend. Members also wished him a long and happy retirement. Chief Fautz consulted with the FBI and was told the homicides should be included in the December 2006 statistics because they occurred in December. President Rodriguez indicated that unless there were questions or objections by members of the Board, the amended statistical report for the month of December 2006 as submitted by the Police Department would be accepted for filing. The donation is for the demonstration as part of the "Science Alive" fair. Upon a motion by Mr. Cottrell, seconded by Mr. BonDurant and carried, the donation was accepted. FIRE DEPARTMENT ACCEPT AND APPROVE RETIREMENT -THOMAS STACHOWIAK President Rodriguez advised that Chief Luther Taylor has submitted to the Board the Application and Declaration for Retirement for Lieutenant Paramedic Thomas Stachowiak effective February 12, 2007. Chief Taylor noted that he has served the Department with loyalty and distinction during the last thirty-five (35) years and eight (8) months. In his letter, Chief Taylor joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend Fire Department and the citizens of South Bend. Members also wished him a long and happy retirement. Chief Taylor noted that he has served the Department with loyalty and distinction during the last thirty-five (35) years and three (3) months. In his letter, Chief Taylor joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend Fire Department and the citizens of South Bend. ACCEPT AND APPROVE RETIREMENT -ROBERT MACIEJEWSKI President Rodriguez advised that Chief Luther Taylor has submitted to the Board the Application and Declaration for Retirement for Battalion Chief Robert Maciejewski effective February 11, 2007. Chief Taylor noted that he has served the Department with loyalty and distinction during the last thirty-eight (38) years and nine (9) months. In his letter, Chief Taylor joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend Fire Department and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Alford, seconded by Mr. BonDurant and carried, the retirement was accepted and approved. Chief Taylor noted that he has served the Department with loyalty and distinction during the last thirty-five (35) years and five (5) months. In his letter, Chief Taylor joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend Fire Department and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Alford, seconded by Mr. BonDurant and carried, the retirement was accepted and approved.
