Jacob, Jerk EXECUTIVE SESSION OCTOBER 25, 2006 The Board of Public Safety met in Executive Session on Wednesday, October 25, 2006, at 8:28 a.m. The meeting was held in the Mayor's Conference Room, 14th Floor, County City Building, South Bend, Indiana, for the purposes specified in I.C. 5-14-1.5-6.1 (b) (2) (B) and (b) (6) (A). President Jesusa Rodriguez and Board Members Juanita Dempsey, Donald Alford, Bruce J. BonDurant and Patrick Cottrell were present. Also present were Police Chief Thomas Fautz and Fire Chief Luther Taylor. Board Attorney Thomas Bodnar was not present; Assistant City Attorney Cheryl Greene was present in his absence. REGULAR MEETING OCTOBER 25.2006 The Board of Public Safety met in the regular meeting at 9:25 a.m. on Wednesday, October 25, 2006, with President Jesusa Rodriguez and Board Members Juanita Dempsey, Donald Alford, Bruce J. BonDurant and Patrick D. Cottrell present. Also present were Police Chief Thomas Fautz, and Fire Chief Luther Taylor. Board Attorney Thomas Bodnar was not present. Assistant City Attorney Cheryl Greene was present in his absence. The meeting was held in the Board of Public Works Meeting Room, 13`h Floor, County City Building, South Bend, Indiana. ACCEPT MINUTES OF PREVIOUS MEETINGS Upon a motion made by Mr. BonDurant, seconded by Mr. Alford and carried, the minutes of the Public Agenda Session, Executive Session, and Regular meetings of the Board held on September 27, 2006 were accepted, with the noted correction. POLICE DEPARTMENT ACCEPT PROPOSED CHANGES (GENERAL ORDERSI TO THE SOUTH BEND POLICE DEPARTMENT DUTY MANUAL - NARCOTIC EVIDENCE TROUBLE BOX -EVIDENCE: NARCOTICS - DOMESTIC VIOLENCE - DOMESTIC VIOLENCE: SWORN OFFICERS Chief Thomas Fautz submitted the above referenced proposed changes to the South Bend Police Department Duty Manual in the form of General. Chief Fautz requested the Board review and accept the proposed changes to the Duty Manual in the form of General Orders to the South Bend Police Department Duty Manual. Chief Fautz indicated this is an on-going quest to update the Duty Manual. Upon a motion made by Mr. Cottrell, seconded by Mr. BonDurant and carried, the proposed changes were accepted. ACCEPT RESOLUTION NO. 57-2006 -CONCERNING SPECIAL ASSIGNMENTS IN THE SOUTH BEND POLICE DEPARTMENT Upon a motion made by Mr. Cottrell, seconded by Mr. BonDurant and carried, an amended Resolution including criteria in Item No. 8 was accepted by the Board of Public Safety. It was noted special assignment includes the rank of Sergeant and Lieutenant. President Rodriguez referenced the letter of October 17, 2006 from the Fraternal Order of Police. RESOLUTION N0.57-2006 A RESOLUTION OF THE BOARD OF PUBLIC SAFETY CONCERNING SPECIAL ASSIGNMENTS IN THE SOUTH BEND POLICE DEPARTMENT WHEREAS, the promotion of qualified officers to the supervisory ranks of any paramilitary organization such as the South Bend Police Department is of utmost importance to the efficiency and morale of the department and to the well being of the citizens of South Bend; and WHEREAS, the best means of checking an officers ability to hold a superior rank is to observe the officer performing the duties of that rank; and WHEREAS, I.C. 36-8-3-7(a) authorizes the detailing of regular police officers to perform special duties within the City of South Bend; and WHEREAS, the South Bend Police Department wants to promote the best ranking officers. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND, INDIANA, that: The Chief of Police of the City of South Bend is authorized to assign special duties as sergeants or lieutenants to those officers he sees fit subject to the circumstances set forth below: The maximum time any officer maybe assigned to special duty shall be one year; 2. 3 4. The Chief shall have the power to reassign that officer from special duty to his regular assignment at any time; The Chief shall advise the Board of all such assignments or reassignments at its first regular meeting after the assignment; The Chief shall advise the Board of the performance of each officer serving a special assignment; 5. In accordance with I.C. 36-8-3-7 personnel assigned to perform a duty of the rank of lieutenant or sergeant shall be paid the same rate per diem as other lieutenants and sergeants in the South Bend Police Department while still assigned; 6. Persons considering special assignment as a sergeant or lieutenant shall be entitled to wear the insignia of that rank and otherwise be referred to by that title; 7. Nothing in this resolution or any actions taken under it shall be construed to give the authority to the Chief to make promotions, such power shall continue to reside exclusively in the Board of Public Safety and can only be exercised by the Board of Public Safety at an open meeting. 8. Evaluation criteria for the special assignment shall be consistent with the criteria set forth at Exhibit "A ", attached hereto and incorporated herein. Adopted this 25t" day of October, 2006. Jacob, Clerk ACCEPT SPECIAL POLICE COMMISSION -TERESA ERNSBERGER In a letter to the Board, Police Chief Thomas Fautz recommended that the following Special Police Commission be issued to Ms. Teresa Ernsberger for a Civilian Volunteer Officer, effective October 18, 2006, until revoked. Chief Fautz stated this Commission does not have the authority to be armed nor the powers of arrest. Upon a motion made by Mr. Cottrell, seconded by Mr. BonDurant and carried, the Special Police Commission was accepted. EMPLOYEE OF THE MONTH -SERGEANT LEE ROSS Sergeant Lee Ross was selected as Employee of the Month. The award is to recognize officers or civilian employees on the South Bend Police Department who have demonstrated actions noted by supervisors or citizens from both a professional law enforcement position and in support of the community policing efforts with citizens of South Bend. Chief Fautz noted Sergeant Ross has done a tremendous job on the police force. There being no further discussion, the recommendation was accepted and filed. FILING OF AMENDED MONTHLY STATISTICAL ANALYSIS REPORT -AUGUST 2006 Chief Thomas Fautz submitted an amended copy of the August stats. The previous report had incorrect year-to-date numbers. He noted the property damage figures were low for September.
