PUBLIC AGENDA SESSION SEPTEMBER 6.2006
The Board of Public Safety met in the Public Agenda Session at 8:03 a.m. on Wednesday,
September 6, 2006 with President Jesusa Rodriguez. Board Members Juanita Dempsey, Donald
Alford, Patrick D. Cottrell and Bruce J. BonDurant were present. Also present were Board
Attorney Thomas Bodnar, Police Chief Thomas Fautz, and Fire Chief Luther Taylor.
The meeting was held in the Board of Public Works Meeting Room, 13t" Floor County City
Building, South Bend, Indiana.
Board members discussed the following item(s) from that list:
- Minutes
Board Members reviewed the minutes and found the following errors:
Pte, under the title "Hearing -Charge 06-06", first sentence, the word "the" should
be added before "Board".
Page 84, under the title "Contract -Emergency Medical Services", fifth sentence, the
word "Lift" should be changed to "Life".
Page 84, under the title "Contract -Emergency Medical Services", third sentence,
"twelve (12)" should be changed to "seven (7)".
Page 86, under the title "Employee of the Month", fifth sentence, the word "burglary"
should be changed to "robbery".
Page under the title "Approval of Agreement", fifth sentence, the word "Lift" should
be changed to "Life".
- Resolution no. 44-2006 -Fire Department Application Process
Mr. Bodnar noted Resolution 44-2006 would be added to agenda. Chief Taylor
apologized for the lateness of the submittal. Mr. Bodnar stated in the past the Fire
Department was giving enhancements of 1-2 points for a) war veterans and b) South
Bend resident of 3-5 years. The State legislature passed an amendment giving
preferences to individuals who have lost a parent in the line of duty as an Indiana police
officer or firefighter. Resolution 44-2006 recommends a two (2) point enhancement for
a war veteran; one (1) point enhancement for an applicant who has passed all tests (oral
and written) and mother or father who has died in the line of duty and one (1) point
enhancement for a person who has resided within the corporate limits of South Bend at
least three (3) of the five (5) years prior to the date of the agility test. Chief Taylor stated
there is a maximum of three (3) points.
ADJOURNMENT
There being no further business to come before the Board,. President Rodriguez declared the
meeting adjourned at 8:40 a.m.

EXECUTIVE SESSION SEPTEMBER 6.2006
The Board of Public Safety met in Executive Session on Wednesday, September 6, 2006, at 8:42
a.m. The meeting was held in the Mayor's Conference Room, 14`h Floor, County City Building,
South Bend, Indiana, for the purposes specified in I.C. 5-14-1.5-6.1 (b) (2) (B) and (b) (6) (A).
President Jesusa Rodriguez and Board Members Juanita Dempsey, Donald Alford, Bruce J.
BonDurant and Patrick Cottrell were present. Also present were Board Attorney Thomas
Bodnar, Police Chief Thomas Fautz, and Fire Chief Luther Taylor. Board members did not
discuss any subject matter other than the subject matter as specified in the Public Notice. The
meeting adjourned at 9:10 a.m.

The Board of Public Safety met in the regular meeting at 9:15 a.m. on Wednesday, September 6,
2006, with President Jesusa Rodriguez and Board Members Juanita Dempsey, Donald Alford,
Bruce J. BonDurant and Patrick D. Cottrell present. Also present were Police Chief Thomas
Fautz, Fire Chief Luther Taylor and Board Attorney Thomas Bodnar.
The meeting was held in the Board of Public Works Meeting Room, 13`h Floor, County City
Building, South Bend, Indiana.
ACCEPT MINUTES OF PREVIOUS MEETINGS
Mr. BonDurant made a motion that the minutes of the Public Agenda Session, Executive
Session, and Regular meetings of the Board held on August 16, 2006, along with a Special
Meeting of July 14, 2006 be accepted, with the noted corrections. Mr. Alford seconded the
motion which carried.
FIRE DEPARTMENT
ACCEPT AND APPROVE FINDINGS OF FACT -CHARGE 06-06 -BRIAN BARTLETT
The Findings of Fact in the matter of Charge 06-06 against Brian Bartlett was submitted to the
Board. Upon a motion made by Mr. Cottrell, the Board found that Engineer Brian Bartlett be
suspended for a period of twenty (20) consecutive eight (8) hour calendar days without pay and
be demoted to the rank of First Class Firefighter for a period of six (6) months, such suspension
and demotion to begin on the 6`h day of September 2006. Mr. BonDurant seconded the motion
which carried.

Chief Luther Taylor submitted to the Board the monthly report for t}ie month of July 2006
complied by the Prevention/Inspection Bureau of the Fire Department.

Chief Taylor noted fire incidents were down in July. Re-inspections were up, however, this is
not unusual. One reason could be firefighters' vacation schedules. There being no further
discussion, the Monthly Statistical Analysis was accepted and filed.
ADOPT RESOLUTION NO. 44-2006 -SOUTH BEND FIRE DEPARTMENT APPLICATION
PROCESS
Upon a motion made by Mr. Cottrell, seconded by Mr. BonDurant and carried, the following
Resolution was adopted by the Board of Public Works:

WHEREAS, the South Bend Fire Department has, for more than two decades, been
utilizing an application process whereby applicants are hired on the basis of their scores; and
WHEREAS, the Indiana legislature has amended I.C. 36-8-4-10 to give preferences to
the individuals who have lost a parent in the line of duty as an Indiana police officer or
firefighter.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC SAFETY OF
THE CITY OF SOUTH BEND, INDIANA, the South Bend Fire Department shall change the
preferences and enhancements as follows:
1. A war veteran. who has been honorably discharged from the United States Armed
Forces and who has passed all the tests shall receive a two (2) point enhancement
on a scale of 100.
2. An applicant who has passed all tests and mother or father died in the line of duty
while a sworn firefighter or municipal or county police officer in Indiana shall
receive a one (1) point enhancement.
3. A person who resided within the corporate limits of the City of South Bend at
least three (3) of the five (5) years prior to the date of the agility test (time in
military service excluded) shall receive a one (1) point enhancement.
4. The maximum enhancement of the score shall be three (3) points.
Adopted this 6`h day of September 2006.

POLICE DEPARTMENT

ACCEPT AND APPROVE RETIREMENT -CAPTAIN JOEL WOLVOS
President Rodriguez advised that Chief Thomas Fautz has submitted to the Board the
Application and Declaration for Retirement for Captain Joel Wolvos effective September 5,
2006. Chief Fautz noted that has served the Department with loyalty and distinction during the
last thirty-six (36) years, one (1) month and nineteen (19) days. Chief Fautz joined the Board in
thanking him for his commitment, dedication and years of distinguished service to the South
Bend Police Department and the citizens of South Bend. Members also wished him a long and
happy retirement. Upon a motion made by. Mr. Alford, seconded by Mr. BonDurant and carried,
the retirement was accepted and approved.
ACCEPT AND FILE DONATIONS TO SOUTH BEND POLICE DEPARTMENT
Chief Thomas Fautz advised the Board of generous donations made to the South Bend Police
Department. This money was donated to the South Bend Police Department K-9 Unit by the
following businesses and individuals in the community:

There being no further discussion, the donations were accepted and filed.
ACCEPT AND FILE DONATION TO SOUTH BEND POLICE DEPARTMENT
Chief Thomas Fautz advised the Board a generous donation of $200.00 was made to the South
Bend Police Department by the Community Leadership Council and $50.00 by the River Park
Neighborhood Association. This donation was directed to go towards expenses associated with
the National Night Out event. There being no further discussion, the donation was accepted and
filed.
Chief Fautz distributed a Police Department organization chart, CALEA information, and a
brochure on a boxing program to the Board. Chief Fautz gave an overview of the Police
Department and their divisions.
ADJOURNMENT
There being no further business to come before the Board, President Rodriguez declared the
meeting adjourned at 9:19 a.m.
