<br />SPECIAL MEETING JANUARY 6, 2006 <br />EXECUTIVE SESSION JANUARY 6, 2006 <br />The Board of Public Safety met in the Executive Session at 8:15 a.m. on Friday, January <br />6, 2006, with Board President Jesusa Rodriguez with Board Members Juanita Dempsey, <br />Patrick Cottrell and Donald L. Alford present. Also present were Police Chief Thomas <br />H. Fautz and Board Attorney Thomas Bodnar. <br />The meeting was held in the Mayor's Conference Room, 14~' Floor, County City <br />Building, South Bend, Indiana, for the purposes specified in I.C. 5-14-1.5-6.1 (b) (2) (B) <br />and (b) (6) (B) and adjourned at 3:25 p.m. <br />A special meeting of the Board of Public Safety was convened at 8:38 a.m. on Friday, <br />January 6, 2006 by Board President Jesusa Rodriguez. Board Members Donald L. <br />Alfori:, Juanita Dempsey and Patrick Cottrell were present. Also present was Board <br />Attorney Thomas Bodnar and Police Chief Thomas Fautz. <br />POLICE DEPARTMENT <br />FILING OF CHARGES -SERGEANT RONALD NOWICKI <br />Police Chief Thomas Fautz, in a letter to the Board presented the Board with a Filing of <br />Charges in the matter of Sergeant Ronald Nowicki, Charge 06-01. It is the <br />recommendation of Chief Thomas Fautz, that Sergeant Nowicki be suspended from duty <br />for twenty-one (21) calendar days. <br />COUNT I <br />On December 30, 2005, Sergeant Ronald Nowicki was found guilty of operating a <br />vehicle with a blood alcohol content 0.08 or above in violation of I.C. 35-50-3-4, a Class <br />D misdemeanor in the St. Joseph Superior Court, Cause Number 71D01-0512-CM- <br />10107. Such conduct violates I.C. 36-8-3-4(b)(1). <br />COUNT II <br />On December 240, 2005 Sergeant Ronald Nowicki, a member of the South Bend Police <br />Department, while off duty on State Road 2 in St. Joseph County, Indiana operated a <br />motor vehicle with a blood alcohol content of 0.08 or above. Said conduct violates I.C. <br />35-50-3-4, Rules 302.00(A)(1), (2) and (3) of the South Bend Police Department Duty <br />Manual and LC. 36-8-3-4(b)(B) and (H). <br />The Board instructed the Clerk to prepare the appropriate paperwork and deliver to <br />Sergeant Nowicki. <br />There being no further discussion, the Board accepted and filed Charge 06-01, in the <br />matter of Sergeant Ronald Nowicki. <br />ACCEPT AND APPROVE LETTER OF UNDERSTANDING -DESIGNATION OF <br />SHIFTS <br />Chief Thomas Fautz submitted a Letter of Understanding for the designation of shifts at <br />the South Bend Police Department, effective January 6, 2006. Midnight Shift is now <br />designation at "Third Detail"; Day Shift is designated at "First Detail"; and Afternoon <br />Shift is designated as "Second Detail". Upon a motion made by Ms. Dempsey, seconded <br />by Mr. Alford and carried, the Letter of Understanding was accepted and approved. <br />PRIVILEGE OF THE FLOOR <br />Ms. Nancy Sulok, South Bend Tribune, asked the Police Chief to clarify the various <br />"shifts". <br />ADJOURNMENT <br />There being no further business to come before the Board, President Rodriguez declared <br />the meeting adjourned at 8:46 a.m. <br />
