RESOLUTION NO. Sl_L_L-1L <br />A RESOLUTION OF THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND APPROVING THE ISSUANCE <br />OF A SCRAP DEALER'S LICENSE FOR WEAVER TRUCK <br />AND EQUIPMENT COMPANY. <br />WHEREAS, the Common Council of the City of South Bend <br />recognizes the contributions that recycling operations such as <br />junk and scrap yards make to the community; and the Council further <br />realizes that such operations must be reasonably regulated in order <br />to minimize any environmental or.aesthetic nuisances which may be <br />created by the operations of scrap and junk yards within the city; <br />and <br />WHEREAS, the Common Council of the City of South Bend <br />has enacted reasonable rules and regulations with regard to the <br />issuance of licenses and the operations of the scrap and junk dealers; <br />and <br />WHEREAS, although Weaver Truck and Equipment is not <br />considered a junk dealer under the definition of same in Ordinance <br />No. 6621 -79, the requirement for licensing the premises as a scrap <br />yard is based upon the nature of the articles stored on the property <br />rather than the specific nature of the business being conducted; <br />and <br />WHEREAS, in accordance with the requirements of <br />Ordinance No. 6621 -79, inspections of the premises are required to <br />be completed by the Neighborhood Code Enforcement Office and the <br />Fire Prevention Bureau; and it has been determined that no code <br />violations exist on the property of Weaver Truck and Equipment <br />Company, 3700 Gertrude Street; and <br />WHEREAS, the Board of Public Works, at its meeting held <br />on July 20, 1981, approved the issuance of a scrap dealer's license <br />for Weaver Truck and Equipment Company, 3700 Gertrude Street, <br />subject to approval of the Common Council. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of <br />the City of South Bend, Indiana, as follows: <br />SECTION I. That the license application for Weaver <br />Truck and Equipment Company, 3700 Gertrude Street, be approved based <br />upon the favorable review . of the property by the Neighborhood Code <br />Enforcement Office and the Fire Prevention Bureau in accordance with <br />the inspection reports attached hereto and made a part hereof as. <br />required by Ordinance No. 6894 -81. <br />SECTION II.
