TO FIRST NORTH/SOUTH ALLEY BETWEEN PR AST ST. <br />AND LINCOLNWAY WEST <br />Mr. Gilot indicated that Mr. Damon Howell, 840 N. Olive St., South Bend, Indiana, has <br />submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Engineering, <br />Streets, Community Investment, Solid Waste, and Police, and Fire Departments. The <br />recommendations indicated the vacation would not hinder the growth or orderly development of <br />the unit or neighborhood in which it is located or to which it is contiguous. The vacation would <br />not make access to the lands of the aggrieved person by means of public way difficult or <br />inconvenient. The vacation would not hinder the public's access to a church, school or other <br />public building or place. The vacation would not hinder the use of a public right-of-way by the <br />neighborhood inwhich it is located or to which it is contiguous. Therefore, Ms. Maradik made a <br />motion recommending approval of the request for vacation subject to notifying the petitioner that <br />they will only get half of the alley and that may not be enough space for a driveway, Mr. Relos <br />seconded the motion which carried. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE THE FIRST ALLEY <br />WEST OF FELLOWS RUNNING NORTH FROM MILTON. TO FIRST EAST/WEST ALLEY <br />Mr. Gilot indicated that Ms. Jennifer Smith, 1821 Fellows Street, South Bend, Indiana 46613, <br />has submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Fire <br />Department and Solid Waste. Favorable recommendations were received from Engineering <br />subject to a cross access agreement with the property owner at 1815 Fellows St., for the rear <br />facing garage to have access from the north or south. Community Investment stated loss of the <br />alley right-of-way would prevent garage access, making access to the lands of the aggrieved <br />person by means of public way difficult or inconvenient, and recommended against the vacation. <br />Ms. Maradik noted there are several homes on the alleyway and one garage and stated she would <br />therefore make a motion to recommend against the vacation request. Ms. Doran seconded the <br />motion which carried. <br />APPROVE TRAFFIC CONTROL DEVICE <br />Upon a motion made by Ms. Maradik, seconded by Mr. Relos and carried, the following traffic <br />control device was approved: <br />NEW INSTALLATION: Speed Limit, 40 mph and Reduced Speed Ahead; Removal <br />of Speed Limit, 30 mph <br />
