PUBLIC AGENDA SESSION SEPTEMBER 10 2009 2M <br />The Public Agenda Session of the Board of Public Works was onov000d at 10:38 a.m. on <br />September lO, 2009, hy Board President Mr Gary A. Gilot' with Board Member Carl Ld1reD <br />present. Board Member |0noa1d Inks was absent. Also po:nout was Board Attorney Cheryl <br />Greene. Board of Public \9ocbo Clerk, Linda M. Munin, presented the Board with o proposed <br />agenda of items presented by the public and by City Staff. <br />Board members discussed the following items from that list. <br />-Additioumde Agenda <br />Mr. Gikt noted the addition ofuProfessional Services Proposal with DLZ to the agenda. <br />- Transfer of Industrial Wastewater Discharge Permit <br />&4a. Kim Thompson, Environmental 0emlouo` noted Ba|dex (}aqpbyttuo 9/ire has <br />changed ownership and she iurequesting the Board teooiomo their discharge permit and <br />approve the transfer of the permit m the new owners, Suzuki Garpbyuau Corporation. <br />Cheryl Greene, Board Attorney, stated her concern was if the corporation had sold its <br />assets and who has the authority tosign. Mu. Thompson stated the parent company has <br />changed ownership and the permit m:goima they advise the Board of the obouge of <br />onmcmbip and provide 000py of letter tothe Board ofWorks informing Suzuki of the <br />requirements of the permit, which she has provided. <br />-MonthlyReportofOneraiuoo - Euvimnmectu| Somioun <br />Mr. A\ Greek, Envirnooucutu| Semloon' provided his division's monthly report for the <br />muodb of August. Be noted c*eu though rain fall was double the uomna{ levels, they <br />remained compliant nu all matters. <br />- Award Bid - Ireland Road Booster Station <br />Mr. John Wiltrout, Water Works, noted the award of this prcject would be subject to <br />financing due to fiouuciognot being io place oob| late November. <br />- Advertise for Bids - One (1) More or Less, Emergency Responder Driver Training Simulator <br />Chief Mark h1uwicki Fire Department, explained that this training device was the result <br />of grant the Fire Department v/oo for $450,000.00. Be noted this was an 80/20 grant <br />with the City being responsible for $90,000.00 of the cost of the equipment. The cost has <br />been appropriated out of Fire Department Capital. Mr. (]dot questioned whether this was <br />u specialized bid referencing a single source of equipment. M,. Nu,/icki stated they <br />expect to receive two or three bido, and the opucifio/ulnnx are open, not specific to a <br />particular brand. ChiufNovvioki explained that other Fire Departments would he allowed <br />to use the simulator at uoost yet to be determined. K4,. GUnt requested they figure out <br />useful life cost with depreciation. and charge based on those costs to cover their expense. <br />Mr. Gregg Zientara, City Controller, questioned whether it is a requirement for the Fire <br />Department to have ongoing driver training. Chie[Nowicki stated there is no state <br />requirement, but years ago the South Bend Fire Department took it on itself to require <br />continuing training uo reduce accident liability. <br />Professional Services Proposal —DLC Indiana, LLC <br />Ms. Ann Kolata, Community and Economic Development, stated the proposal from DLZ <br />Indiana, LLC' was to oversee Phase lY. Bid Package /\. of the Studebaker Demolition. <br />She noted the project originally was intended to be unde for business dcvo/nymum, but <br />with the development of the NANO toobon|ogy h6uA built there, the footings need to <br />come out. Ms. l{oleuu explained that NANO technology usually requires deep husenonu <br />levels for construction. She noted that DL3'o proposal time billed. If they don't use all of <br />the time proposed, the cost will huless. <br />Change Order ' Demolition ofB\BocnVeuionBuilding <br />Cheryl Greene, Bnmd Attorney, questioned who was doing the demolition of this <br />property. Mr. Littr U stated it was Code Enforcement. The building was being torn down <br />due ho being o safety hazard. <br />OPENING OF BIDS — LARGE DIAMETER SEWER GRIT REMOVAL — PROJECT NO. 109- <br />017 (WWTP OTHER CONTRACTUALS) <br />This was the date set for receiving and opening of sealed bids for the above referred to project. <br />The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri- <br />County News, which were found to be sufficient.
