REGULAR MEETING <br />JUNE 12.2006 -~ ~' <br />RESOLUTION NO. 34-2006 <br />1 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH <br />BEND. INDIANA REGARDINGPOLKY CONCERNING FIRE HYDRANTS <br />WHEREAS, fire protection is one of the principal reasons cities were formed in <br />this country and fire protection remains one of the principal services a city provides to its <br />citizens; and <br />WHEREAS, to provide adequate fire protection ,South Bend has established a <br />system of fire hydrants located throughout the City; and <br />WHEREAS, any other use of the fire hydrants diminishes their capacity and could <br />hinder the effectiveness of the response of the South Bend Fire Department to fires; and <br />WHEREAS, communal gardens and other beautification projects do benefit the <br />City of South Bend. <br />NOW, THEREFORE BE IT RESOLVED: . <br />1. Fire hydrants are to be used for fire protection purposes only. <br />2. Any previous practice of allowing not-for-profit corporations and others to <br />use water from fire hydrants for sprinkling purposes is hereby <br />discontinued. <br />3. Non-profit organizations may cause a credit to be applied to a South Bend <br />Water Department account under the following circumstances: <br />1 <br />a. Anon-profit organization and the South Bend Water Department <br />customer shall submit a joint written application for the credit; <br />b. The organization operates or maintains a communal garden or similar <br />project which beautifies the City of South Bend, but requires <br />watering; <br />c. South $end Water Works shall either meter or estimate the amount of <br />usag~~;for sprinkling over the course'of one (1) year and allow a credit <br />for the additional amount of water that it is estimated the customer <br />would be billed; and <br />d. The site serviced by the account shall be as near as practical to the <br />sprinkling site and the sprinkling operation shall not unduly interfere <br />with traffic or the rights of other property owner. <br />4. The Water Works Engineer shall have the discretion to allow variances <br />from this policy when necessary. <br />5. The policy shall not create any property rights for any person or <br />organization, no does it prohibit the modification of the credit or change of <br />this policy by the Board of Public Works for any reason at any time <br />without prior notification to the customer or organization. <br />1 <br />DATED June 12;, 2006. <br />ATTEST: <br />s/Angela K. Inks, Member <br />APPROVAL OF METER DOWNSIZING POLICY -WATER WORKS <br />Mr. Andy Wierzbicki, Water Works, proposed a change to the meter downsizing policy. <br />This policy proposes that the homeowner hire a plumber to supply a1L required fittings to <br />make the requested downsizing. Upon a motion made by Mr..`Gilot, seconded by Mr. <br />Inks and carried, the updated policy was approved. <br />
