Area Board of Zoning Appeals -September 2, 2009
MR. HAWLEY: I would to add that a second to the motion. I was born and raised on the south end of town.
I'm very familiar with Garland Circle. I watched Dr. Skillern's house being built there. I stood in it as it was
under construction. I used to sled up and down Robin Hood Lane and I think this property and this location
should remain as it was intended. A nice neighborhood. And I just think this is the wrong place for this
facility and so I second the motion.
A motion to send the petition to the Common Council with an Unfavorable Recommendation was made by
Mr. Phipps and seconded by Mr. Hawley.
MR. VELLEMAN: Yes.
MR. YOUNG: Yes.
MR. HAWLEY: Yes.
MR. PHIPPS: Yes.
MR. URBANSKI: Before I vote, I'd like to make one comment also. At the present time and for probably the
last nine years or ten years I've been on the Board of Directors of Families First which previously was called
The Fire House which serves the needs of young people who need visitation with there parents that is
supervised. And so I was very involved with the purchase of our last two houses that we had to buy. Very
concerned about many issues that was brought up by the neighborhoods and we put them in neighborhoods
that were adjacent to commercial. Yet it was a neighborhood setting. So I do vote yes to send it with an
unfavorable recommendation.
The motion carried unanimously.
After hearing the evidence on the petition, the Area Board of Zoning Appeals find that you did not
satisfy the Standards as set forth in I.C. 36-7-4-918.5; therefore, the petition was sent to the Common
Council with an Unfavorable Recommendation.
Based on the testimony presented, the Area Board of Zoning Appeals, after careful consideration, finds this
Special Exception is sent to the Common Council with an Unfavorable Recommendation and will issue
written Finding of Facts.
PETITION SENT TO Ti~E COMMON COUNCIL `'~dITI~ AN UNFAVOF.A>3LE
RECOMMENDATION
29
