Area Board of Zoning Appeals -September 2, 2009 <br />neighbor to such a use can reasonably expect a 15 - 25% reduction in value. The effect is a form of "external <br />obsolescence" where the nuisance factor of a property directly affects the value others. Simply put, the <br />proximity of a group home having the capacity defined in the permit application will have a significant and <br />detrimental effect for the neighbors' property values. And to just let you know there are five homes in the <br />circle, so this would effect, it's such a closed small circle it would effect every single one of us. We ask that <br />you turn this down. <br />MRS. STACEY NOETZEL: I reside 1448 Garland Circle. I'm actually in the circle. We have four small <br />children and I'm a little confused because they keep saying that there's not going to be cars there. But in the <br />past we've heard that there are going to be all these cars there. I little glimpse into the future. They've had <br />insurance work there and they've been having vehicles parked on the street which I don't if Van's pictures <br />show you where their house is, but they're on the mouth of the circle. So where they're parking is a very bad <br />like blind spot to see cars or children coming or going or playing. I guess my concern as a parent, I have small <br />children in ages from 5 to 11 months, so I guess I'm in fear of my children being hit by a car or other things <br />happening. We're not opposed to the children in the neighborhood, we're opposed to the traffic and the <br />congestion. I wanted to make that short, so that's my concern. <br />MR. JEREMY NOETZEL: I live with her at the same address, 1448 Garland Circle. We're probably, Van is <br />probably one of the longest residents of the circle who spoke earlier. We are the newest, we moved in in <br />November. When we were looking for a home we were looking for somewhere nice, peaceful, quiet, nice <br />little getaway from the city and it's a beautiful location. If I had known back then that we would be moving <br />into a house two houses down from a business with 8 to 10 children living there, 9, 10 people coming and <br />going, that's what their handout said. I don't know as a buyer I would have moved in there. I think it messes <br />up the tranquility of where we're at. It doesn't, like my wife said, it's not safe. There's too many cars. We <br />almost had an accident because of the way when the insurance work was being done, they had trucks being <br />parked there. It's just not the right place for this house. I just wanted to let you know, that we with small <br />children just fell that this is not the right location. Thank you. <br />MR. ROBERT SCHMUHL: My wife Judy and I live at 1441 Garland Circle. And we are right in between <br />the Gates and the Noetzels in the sense of timing. We've been there a few years and let me tell you the story <br />of our arrival to Garland Circle. We closed on a Friday and we drove out there on Saturday and there was a <br />car up against one of the homes of Garland Circle, in fact the Diltz home. And the driver of that had not rather <br />carefully navigated the circle and had ended up not only in their front yard but in their living room. So that we <br />are talking about a very unique situation. And I would stress in talking about it is remember, York Road is a <br />north-south thoroughfare that stops right at Garland Circle and Garland Road. It says no outlet. If someone is <br />looking for an address beyond that, the impulse is to turn left and go into Garland Circle. They don't know <br />that they are going into what is in effect a cul-de-sac. So the impulse is to put the foot to the accelerator and to <br />get out of that area just as quickly as possible, doing a good deal of damage to most of the lawns along <br />Garland Circle. I would say that with the four children living there it is a safety hazard as it is. I think it <br />would become more of a safety hazard if you had more vehicles coming around, it would indeed be I think a <br />safety hazard for any other girls living in the group home.
