Upon a motion made by Mr. Gilot, <br />seconded by Mr. Inks and carried, the Occupancy in the Right-of--Way was approved. <br />APPROVAL OF ACCEPTANCE OF RETENTION BASINS IN SOUTIII AND <br />SUBDIVISION INTO CITY OF SOUTH BEND'S INVENTORY <br />In a memorandum to the Board, Mr. Tony Molnar, Engineering, submitted a Corporate <br />Warranty Deed for two (2) retention basins in the Southland Subdivision, and <br />recommended the Board accept them into the Cite of South Bend"s in~cntur~. \1r. Juc;, <br />Hickey, ROJO Development, has closed his development business and is offering them to <br />the City. Mr. Littrell stated a condition be placed on the acceptance, which is the taxes <br />for 2005 payable and any 2006 taxes payable in 2007 be paid by Mr. I-Iickey. Upon a <br />motion made by Mr. Gilot, seconded by Inks and carried, the acceptance of the retention <br />basins, subject to Mr. Hickey paying the taxes as stated above, was approved. <br />APPROVAL OF TRIPLE TRAILER PERMIT -YELLOW TRANSPORTATION <br />Mr. Gilot stated a Triple Trailer Permit has been submitted to the Board for approval by <br />Mr. Ronald Ganus, Yellow Transportation, 1300 South Walnut, South Bend, Indiana, for <br />ingress and egress from the Toll Road. Upon a motion made by Mr. Littrell, seconded by <br />Mr. Inks and carried, the Triple Trailer Permit was approved. <br />APPROVAL OF LETTER OF CREDIT <br />Mr. Tony Molnar, Division of Engineering, submitted the following Letter of Credit to <br />the Board and recommended approval: <br />LETTER OF CREDIT NO. 70-0026682 <br />ISSUED BY: MFB Bank -Cleveland Woods Development <br />FOR: Fernwood Phase III <br />AMOUNT: $61,870.00 <br />EXPIRES: February 7, 2007 <br />IMPROVEMENT: Sanitary Sewer Facilities in Subdivision <br />Mr. Inks made a motion that the Letter of Credit, as outlined above, be approved. Mr. <br />Littrell seconded the motion, which carried. <br />ADOPT RESOLUTION NO. 5-2006 -DISPOSAL OF CITY-OWNED PROPERTY <br />Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 0~-006 <br />WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of the City of South <br />Bend the right and duty to have custody of, control of, use of, and dispose of in <br />accordance with Indiana statutes, all real and personal property owned by the City of <br />South Bend; and <br />WHEREAS, the Common Council of the City of South Bend passed as amended <br />on January 9, 1995, Ordinance No. 8570-95 which states that upon retirement with <br />twenty (20) or more years of service: <br />"Upon retirement with twenty (20) or more years of service to the City of South <br />Bend, Indiana, a sworn member of the South Bend Fire Department shall be <br />entitled to retain as his or her own personal property, the fire helmet used by such <br />Firefighter immediately prior to giving notice of his or her retirement." <br />1 <br />A <br />1 <br />and <br />
