ti~' a <br />dsAs <br />t ZONING AND ANNEXATION COMMITTEE <br />AUGUST 10, 2009 <br />Oliver Davis, Vice-Chairperson, Zoning & Annexation Committee called the meeting to <br />order at 3:51 p.m. <br />The following were in attendance: <br />Committee Members Present: Tom LaFountain, David Varner <br />Other Councilmember's Present: Ann Puzzello, Henry Davis, Tim Rouse, Karen White <br />Other's Present: Christa Nayder, Bernie Feeney, Tom Price, Rita Kopala, Don Inks <br />Agenda: Bill No. 45-09 -Rezone 1351 & 1355 Pyle Avenue <br />In Chairperson Al Kirsits absence, Vice-Chairperson Oliver Davis called upon Christa <br />Nayder from the Area Plan Commission (APC) Staff to report on their findings and the <br />Commissions action. She reported the APC has sent an unfavorable recommendation to <br />Council basically feeling the "O" Office proposal was to intrusive in a residential area <br />Bernie Feeney representing the petitioner countered. Supplying a site plan and photos <br />(attached) he said the building would actually improve the area by removing two <br />unsightly homes and providing a handsome, landscaped buffer to the residential <br />neighborhood. Councilmember Puzzello supported by Councilmember Rouse asked <br />questions about fencing, landscape and retention pond safety. Ultimately Bernie Feeney <br />agreed to a 6' fence height along with plantings 6' high. Based upon these written <br />commitments Councilmember Varner motioned to send to full Council with a favorable <br />recommendation. Councilmember Varner seconded and all affirmed. <br />There being no further business to come before the committee at this time, Vice <br />Chairperson Oliver Davis, adjourned the meeting at 4:15 p.m. <br />~, Vide-Chairperson <br />Annexation Committee <br />
