CITY OF SOUTH BEND PETE BUTTIGIEG, MAYOR <br />DEPARTMENT OF PUBLIC WORKS <br />Eric Horvath, Director <br />April 20, 2016 <br />Mr. Tim Scott <br />Council President, South Bend Common Council <br />4`h Floor, County -City Building <br />South Bend, IN 46601 <br />Re: Ordinance Amending the South Bend Municipal Code to clarify Assessment of Installation <br />Charges <br />Dear Council President Tim Scott, <br />Attached for filing with the South Bend Common Council is an Ordinance to amend the South <br />Bend Municipal Code in Chapter 7, Article 10 that contains sections involving construction fees for water <br />and sewer installation. In particular, it addresses assessment of installation charges, which are fees <br />intended to recoup the city's investment in the installation of new water mains and sewers. Users wishing <br />to connect to the system are charged a standard rate based on the size and /or dimension of their <br />property. <br />The purpose of this ordinance is so that fees are only required of users wishing to connect to <br />water mains and sewers constructed and funded by the City with the expectation of recoupment by the <br />City. Essentially, the current ordinance requires assessment fees of all connections and does not <br />differentiate between utilities installed by the City or a private developer or whether the utilities were <br />installed by the City as part of an economic development agreement. <br />This ordinance will clearly define exemptions for assessment charge. In addition, it simplifies the <br />presentation of the fee structure so as to reduce confusion. <br />Either I, or Director of Public Works Eric Horvath, will present this Bill to the Common Council at <br />its appropriate committee meeting and at the public hearing during the Common Council's regular <br />meeting. <br />Thank you for your consideration of this matter. <br />Sincerely, <br />6P C.
