Councilmember Gavin Ferlic asked if they would still be operating the store already on Oliver <br />Street. <br />Mr. Chappuies stated that they are only going to be a landlord and not directly involved with <br />management of the store, they are building and leasing it. <br />Councilmember Dr. David Varner asked what policies the petitioner has to keep their parking <br />lots clean. <br />Mr. Chappuies stated it was not addressed at the Area Plan meeting but the petitioner can <br />respond. <br />Jordan Liss, Atwater Group who is the developer of the site served as the petitioner for this bill, <br />stated that it would mostly be handled through Code Enforcement giving us citations if we do not <br />keep the lot clean. <br />Mr. Chappuies also responded that there is not a whole lot that can be put into a written <br />agreement because they are not zoning enforceable issues and it is better handled by Code <br />Enforcement because it is property maintenance. Possibly there could be some sort of verbal <br />commitment. <br />Mr. Liss stated they will own and lease the property to Family Dollar. If it does become blighter <br />or has rubbish in this parking lots the best real course of action is to cite them accordingly. <br />Councilmember Dr. David Varner responded one of the problems he has seen with these types of <br />stores is that people tend to congregate in the parking lot and if the store sells motor oil they will <br />change their oil in the parking lot. Just the kind of store that leaves the area as less attractive and <br />if you have an agreement ahead of time by the owner then we are ahead of the game instead of <br />going through Code. It would just be easier as either part of the lease or some other mechanism. <br />Code should not have to go out and cite the property. <br />Councilmember Gavin Ferlic stated perhaps the easiest thing would be for the petitioner to give <br />us assurance that you will put some type of language like that in the lease. <br />Council Attorney Cekanski - Farrand stated anything like that would have to be specifically <br />related to the planning or zoning of the property and verbal assurance is really the best that can <br />be done due to the process dictated by state law. <br />Councilmember Oliver Davis arrived at 3:38 p.m. He informed the Committee that he did <br />address this issue at Area Plan as well. <br />Councilmember Gavin Ferlic stated he thinks he phrased his first question poorly and asked the <br />presenter and petitioner if Family Dollar would still have their store at Lincolnway and Olive. <br />Mr. Chappuies responded as far as he knows there are no plans to close the Olive store. <br />2 <br />
