and ~ recorded as Instrument No. 9520538; and (iii) an Addendum to the Declaration of <br />• Protective Covenants and Restrictions of Blackthorn Corporate Center approved by Authority <br />Resolution No. 108 and by Commission Resolution No. 1445 adopted on July 3, 1996, as <br />recorded as Instrument No. 9707058 (collectively, the "Covenants and Guidelines") and <br />WHEREAS, the Owners' Association at Blackthorn, which is comprised of <br />owners of land within the Office Park, have approved and presented certain <br />amendments to the Covenants and Guidelines, and the Commission and the <br />Authority providing for: <br />4.7.2 Support Office/Research. A reduction in the floor area requirement for <br />office from 50% to 33%. <br />7.4.3 Open Space and Parking Landscape Areas. Rather than the property owner <br />maintaining all landscaping, the lawn in the Landscape Easement Area will <br />be maintained by the Owner of said Site. The plantings in the Landscape <br />Easement Area will be maintained by the Association in accordance with <br />the provisions of this Declaration and the Guidelines. <br />Development Guidelines <br />Landscaping <br />4.b. Shrubs no longer have to be of 3 foot in height at time of <br />planting when used as a screen for parking <br />;and <br />WHEREAS, the Commission and the Authority desire to amend the Covenants and <br />Guidelines in the manner presented and to enact the Covenants and Guidelines with the <br />amendments as set forth in Exhibit A; and <br />NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment <br />Commission that: <br />1. The Covenants and Guidelines are hereby amended and shall be as set forth in <br />Exhibit A attached hereto and incorporated herein by reference. <br />2. The Covenants and Guidelines, as amended, are hereby approved and ordered <br />executed and attested by the Commission President or Vice-President and attested by the <br />Commission Vice-President or Secretary, respectively. <br />3. The Secretary of the Commission is hereby directed to record in the Office of the <br />St. Joseph County Recorder a copy of this Resolution, along with all attachments and a copy of <br />any resolution concerning the same approved by the Authority. <br />4. This resolution shall be in filll force and effect from and after its adoption. <br />~__~ <br />
