- ~ <br />r <br />within the Area, as more particularly described in Exhibit B, attached hereto and made a part <br />hereof; and <br />WHEREAS, the Commission previously adopted a redevelopment plan for the <br />Area entitled the "Northeast Neighborhood Development Area Development Plan" (hereinafter <br />referred to as the "Development Plan"), and the Commission desires to amend such Development <br />Plan (the "Plan Amendment") by including provisions for the establishment of the Housing <br />Program and Allocation Area No. 2 within the boundaries of the Area, as set forth in Exhibit C, <br />attached hereto and made a part hereof; and <br />WHEREAS, the Department, pursuant to the Act, has previously conducted <br />surveys and investigations and has thoroughly studied the Area within the City; and <br />WHEREAS, upon such surveys, investigations and studies being made, the <br />GOmmission finds that the Plan Amendment, which Plan Amendment is attached hereto and is <br />hereinafter adopted in this Resolution, cannot be achieved by regulatory processes or by the <br />ordinary operations of private enterprise without resort to the powers allowed under the Act due <br />to the lack o[' public improvements, the existence of improvements or conditions that lower the <br />value of the land below that of nearby land, or other similar conditions, and that the public health <br />and welfare will be benefited by the accomplishment of the Plan Amendment, which shall <br />include the Housing Program a~1d Allocation Area No. 2 within the Area; and <br />WHEREAS, the Commission has previously caused. to be prepared maps and <br />plats of the Area_ said maps and plats of the Area showing the boundaries of the Area, the <br />location of the various parcels of property, streets and alleys and other features affecting the <br />acquisition, clearance, replatting, replanning, rezoning, or redevelopment of the Area, indicating <br />the parcels of property to be excluded from acquisition, and the parts of the Area that are to be <br />devoted to public ways, levees, sewerage, parks, playgrounds, and other public purposes under <br />the plans for the economic development of the Area as adopted herein; and <br />WHEREAS, the Commission has determined that it currently has no intention to <br />acquire real property as part of the Plan Amendment adopted herein; and <br />WHEREAS, the Department (under the title of the Department of Community <br />and Economic Development) has previously consulted with persons interested in or affected by <br />the proposed Housing Program and has provided the affected neighborhood associations, <br />residents, and township assessors with an adequate opportunity to participate in an advisory role <br />in planning, implementing, and evaluating the proposed Housing Program; and <br />WHEREAS, the Department held a public meeting in the affected neighborhood <br />on May 30, 2007 to obtain the views of neighborhood associations and residents and published <br />notice of such meeting in accordance with IC 5-3-1; and <br />WHEREAS, there was presented to this meeting of the Commission for its <br />consideration and approval, a copy of the Plan Amendment, which Plan Amendment consists of <br />forty-ei ht (48) pages, and is attached hereto as Exhibit C; and <br /> <br />BDDBOI 4766100v2 - 2 - <br />
